A Baby Boomers’ Guide to Aging in Place

If you’re one of the millions of American baby boomers approaching their 70s, you may be asking if now is an opportunity to move and downsize to a smaller, more manageable home, or to stay put in your current home and repurpose any extra space vacated by adult children. The answer depends on your unique circumstances, of course. But for those who decide to stay put — at least for the time being — now is a great time to begin considering which, if any, modifications your home may require to better suit your needs and ensure your safety as you get older. Rather than waiting until an incident occurs, be proactive about making alterations to your home that will help you avoid potential injury. Likewise, take advantage of a broad spectrum of new technologies that can make your home easier to manage and provide an extra layer of security.

Here are a few things to keep in mind if you are planning to “age in place.” Prioritize Your Wish List Take a good look at the rooms in your house to determine which ones fit your new lifestyle and which ones need some work. Some areas of the home might only need minor changes. Others might need to be repurposed altogether. Take the time to create a general plan and prioritize the items on your list. Focus on Improving Livability Many empty nesters hire expert remodelers to adapt their home to make it easier to maintain. Stairs can sometimes become a problem, but moving the master bedroom and the laundry room to the ground floor can be part of a solution. Doing so can give home owners many more years in the home they love without a sense of urgency to move to a single-story home. Building professionals who have earned the National Association of
Home Builders’ Certified Aging-in-Place Specialist (CAPS) designation have received training on how to build or renovate a home so that the occupants can live in it safely, independently and comfortably, regardless of their age. Make Use of Technology Everywhere you look these days, there is new technology. Why not put it to use in your house? Motion sensor light switches can illuminate a room as soon as you enter. They can also be connected with a home security and monitoring system, and could be configured to send help in the event of a fall or other accident. A smart refrigerator will notify you when you’re out of milk, or better yet, place an order to be delivered by your local grocer. A front door camera and microphone will allow you to see who is on your porch, even if you’re not there. If you can
dream it up, there is likely a technology solution out there for it. Expand Your Space Depending on the age of your home, you may find that, for example, your master bedroom or bath is too small for comfort. Look for opportunities to expand those rooms into adjacent, unused or underutilized spaces. A remodeling professional is the best person to help you determine what your options are to build your dream master bathroom or bedroom. They can also help you find ways to create a more open floorplan that is easier to navigate for those with mobility concerns. Incorporating these changes will not only create a home that suits a changing lifestyle, they also may increase the value of your home when you eventually decide it’s time to sell.

A FEW YEARS AFTER MY FATHER PASSED AWAY, MY STEPMOTHER REMARRIED. A FEW YEARS LATER, SHE DIED – ALSO WITHOUT A WILL. SHE DOESN’T HAVE ANY CHILDREN, BUT SHE DOES HAVE THREE NEPHEWS. HER HUSBAND STILL RESIDES IN THE HOME. DOES HE HAVE THE RIGHT TO CONTINUE TO LIVE IN THE HOUSE? WHAT IS THE PROPER DIVISION OF THE PROPERTY? A: Since you did not mention a prenuptial agreement between your father and stepmother, I assume the house was community property. That being said, when your father died without a will, according to Louisiana testate law, his one-half interest in the community home passed to you, subject to your stepmother’s usufruct – the right to live in the home until her death. by Louisiana law. Unfortunately, you did not give me enough information to tell you who would inherit her estate under Louisiana law. Nevertheless, the house is no longer subject to a usufruct and you now own a full onehalf of the home. Before you can do anything however, you will need hire an attorney to probate your father’s succession. You would be co-owners in indivision with whoever your stepmother’s heirs are. If you and the other co-owner(s) cannot agree on how to use the house, or you want to sell it and the other co-owner(s) don’t, you have the right to demand a judicial partition. The court can order a partition by licitation (sheriff’s sale) or by private sale. Once this has been done and costs had been paid, the proceeds would be distributed to the co-owners in proportion to their shares. It would be wise to create a separate checking account to keep track of your Lafayette residence’s income and expenses. Keeping good records of any expenses will also help you at tax time.
LOUD NEIGHBORS ARE RUINING OUR NEW HOME Q: MY WIFE AND I RECENTLY MOVED INTO A BEAUTIFUL NEW HOME IN WHAT SEEMED TO BE A PEACEFUL SUBDIVISION. I SAY “SEEMED TO BE” BECAUSE FOR THE LAST FEW WEEKS OUR NEIGHBORS HAVE BEEN HOSTING LOUD PARTIES AT LEAST TWO TIMES PER WEEK. THE LOUD MUSIC AND CONSTANT COMING AND GOING OF CARS HAS BEEN KEEPING US AWAKE AT NIGHT. AND OUR PATIENCE IS WEARING THIN. IS THERE ANY LEGAL ACTION WE CAN TAKE TO MAKE THEM STOP? A: Although you may rightfully decide to take certain legal courses of action to address the noise problem, you might be better able to solve your problems by attempting to talk to your neighbor about it. After all, there is a possibility that your neighbor is simply unaware of the level of noise his parties are producing, or that the noise is having a negative effect on you and your family. Also, there are probably other neighbors nearby who share your concerns. The more people who approach the “offending” neighbor peacefully, the greater the chance you will get a favorable response. If your neighbors don’t own the house, and are renting, you should contact the owner/landlord and ask them to speak to their tenants. They may not even be aware of the problem. Chances are, once they are made aware of the problem, they will take steps to get things under control. However, if complaining and peaceful requests are not working, you may want to get a copy of your local noise ordinance and show it to the neighbor. Almost every community prohibits excessive, unnecessary and unreasonable noise, and police are trained to enforce these laws. Your local library or office of the mayor or city

attorney can usually provide useful information on local noise ordinances. Additionally, many municipalities now have their local ordinances online - just use your favorite internet search engine and key in the name of your city or town. Most local noise ordinances designate certain “quiet hours” - for example, from 10:00 p.m. to 7:00 a.m. on weekdays, and until 8 or 9 a.m. on weekends. So what is acceptable in the eyes of the law at 10:00 a.m. on a Saturday morning may not be acceptable at 6 a.m. Also, many towns prohibit sustained noise that exceeds a certain decibel level. These decibel levels are set according to the time of day and the neighborhood zoning. When a neighbor complains, police normally place decibel level monitoring equipment on an estimated property line and take a reading. If the noise level is too high, your neighbor will usually receive a warning. Additional violations usually result in fines. As a last resort, if nothing else seems to work, you can sue your neighbor and ask the court for money damages or to order your neighbor to stop the offensive noise. Suits of this nature for money damages may be brought in small claims court, but a court order requiring your neighbor to stop the noise may only be obtained in district court. It bears repeating, however, that legal action and lawsuits should only be your last option, and should only be used if diplomacy and peaceful requests to your neighbor fail. By attempting to talk things out and resolve your problems peacefully, you get your problems addressed without having to sacrifice your friendly neighbor relationship.
