Organize Your Home for the School Year
It’s back-to-school time and that means all over town, parents are vowing that this year, they’ll finally be organized. There will be no more tears, threats, or lost field-trip permission slips. The kids will walk out the door with their completed homework and a healthy lunch snug in their backpacks. Here are some hints to get your families a little closer to that nirvana of a stress-free school morning. The ‘Launch Pad.’ The bloggers at OrganizedHome.com promote the idea of the Launch Pad: ensuring that each family member has his or her own dedicated space. Find a spot near the door – maybe a bookshelf that you can clear out and instead insert big plastic dishpans, each in a different color for each family member. When each family member comes home, all their “stuff” – backpacks, car keys, papers – goes in each dishpan. “Child comes home from school, tosses homework and lunch menus in her dishpan. Dad comes home and tosses paycheck, keys, billfold, receipts and pocket change into his dishpan. There things stay, safe and segregated, until they are needed next morning,” says OrganizedHome. com blogger Cynthia Ewer.
Calendars. The bigger, the better. It’s easier than ever to keep track of upcoming events and deadlines in your school’s online calendar, which you probably already know how to synch to your smartphone calendar app. But there’s something to be said for a big calendar on the kitchen wall – either paper or a whiteboard – with each family member’s events and deadlines written in their own shade of marker (maybe matching the Launch Pad dishpan!). Sunday nights are a great time for a quick family meeting to discuss who needs to stay late at school, leave early for a dentist appointment or go to basketball practice – and who is driving whom. Put that information on the calendar too, so everyone knows what to expect.
Plan lunches. We know about the 40-packs of potato chips, juice boxes and granola bars available at all the big-box discount stories, but a steady diet of packed snacks is not the healthiest or most appetizing option – nor is a 30-day supply of homemade peanut butter and jelly sandwiches stacked in the freezer. Again, cooking and parenting blogs can be a good resource: Bake and freeze a batch of pesto chicken veggie meatballs from the Super Healthy Kids website and pop a few – along with a dab of marinara sauce – in a zipper baggie with toothpicks. Make kabobs, as demonstrated on Delish.com. They can be stacked pieces of fruit and cheese, salami and cubes of carrots and celery, chicken with cooked potatoes and avocado.

MATERIALMAN’S LIEN SHOULD AFFECT CREDIT SCORE

Q: WE HIRED A CONTRACTOR TO HELP US MAKE SOME IMPROVEMENTS TO OUR BACK YARD. HE BUILT A PATIO, STAINED THE CONCRETE, AND DID A LOT OF LANDSCAPING. WE WERE PLEASED WITH THE FINAL RESULT, BUT THE CONTRACTOR’S ORIGINAL BID WAS CONSIDERABLY LESS THAN HIS FINAL BILL. ACCORDINGLY, WE REFUSED TO PAY A PORTION OF THE BILL. APPARENTLY, WHEN WE DIDN’T PAY HIM, HE DIDN’T PAY ONE OF THE SUPPLIERS, AND THEY PLACED A LIEN ON OUR HOUSE. WE EVENTUALLY RESOLVED MATTERS WITH HIM, HE PAID THE SUPPLIER, AND THE LIEN HAS BEEN REMOVED. WILL THIS LIEN, EVEN THOUGH IT HAS NOW BEEN REMOVED, HAVE ANY EFFECT ON OUR CREDIT RATING? A: This type of lien is commonly called a materialman’s lien. Often times, when subcontractors or supplies don’t get promptly paid for work they do on someone’s home, they will file a materialman’s lien. It’s their way of making sure you will eventually pay up. If you don’t, they have a claim on your property. Of course, homeowners want any materialman’s lien promptly removed once payment has been made. In your case, this seems to have happened.
Now, on to your question. All three of the creditreporting agencies - Experian, Equifax, and TransUnion — sift through public documents for state and federal tax liens. And, as a general rule, a tax lien will have a serious negative impact on a borrower’s credit rating - an impact that can last for years. However, none of the credit-reporting agency looks for materialman’s liens, so these types of liens are not reflected on a person’s credit report. Most of the credit reporting agencies think of a materialman’s lien as an insurance policy that the contractor holds, not necessarily a debt the consumer owes. Accordingly, they are not considered derogatory pieces of information, and should not have a negative impact on your credit score. There is however, one caveat. Several years ago, credit-reporting agencies did look for materialman’s liens. Therefore, it is possible an old one could still turn up on your credit report. This is why it’s a good idea for anyone who had one of these liens in the past to check their reports. The credit-reporting agencies all provide free copies of your report — and it’s important to review all three because they’re not the same. Details on how to get the reports are on each of the credit reporting agencies’ Web sites.

Q: WE BOUGHT OUR HOUSE A FEW YEARS AGO, BUT DID NOT HAVE A SURVEY DONE AT THE TIME. ACCORDING TO THE PREVIOUS OWNERS, OUR PROPERTY WAS PART OF A LARGER TRACT OF LAND AT ONE TIME, AND SEVERAL YEARS AGO, IT WAS DIVIDED INTO TWO LOTS, OURS AND OUR NEIGHBOR’S. WE ACTUALLY NEVER HAD ANY ISSUE WITH THE BOUNDARIES OF OUR PROPERTY UNTIL A FEW MONTHS AGO WHEN OUR NEIGHBORS BEGAN LETTING THEIR KIDS AND DOGS ROAM ALL OVER OUR PROPERTY. ULTIMATELY, WE DECIDED TO PUT UP A FENCE, BUT THE FENCE COMPANY TOLD US WE SHOULD GET A SURVEY FIRST. WHEN WE GOT THE SURVEY, WE FOUND OUT THAT OUR PROPERTY LINE WAS TEN FEET CLOSER TO OUR NEIGHBOR’S HOUSE THAN WE ORIGINALLY THAN WE THOUGHT. OF COURSE, OUR NEIGHBOR IS SAYING THAT THE SURVEY IS INCORRECT. WE WOULD LIKE TO RESOLVE THIS ISSUE, BUT DON’T KNOW HOW. THE LEGAL DESCRIPTION CONTAINED IN OUR CASH SALE, THE MOST RECENT SURVEY WE HAD DONE, AND EVEN THE OLDER SURVEYS SEEM TO BE IN OUR FAVOR, BUT OUR NEIGHBOR REFUSES TO CONCEDE THAT THE PROPERTY LINE IS WHERE THE SURVEYOR SAYS IT IS. A: Based on what your version of the events, it seems like you have followed the proper procedure in determining the boundaries of your property. You could go one step further and ask the surveyor to place stakes on the corners of your property to clearly outline the boundaries. And, since your neighbor’s cash sale is part of the public record, you should get a copy of it and give it to your surveyor. The surveyor can then make sure that

the boundary described in the neighbor’s cash sale matches the boundary described in your cash sale. If the descriptions match, your neighbor’s argument against your claim to the boundary is most likely a losing one. What is most puzzling about this is how you came to believe that your property boundary was off by ten feet. If you live in a rural area and have a rather large lot that doesn’t have clearly defined borders, this might explain it. However, most people know where there property begins and ends. However, if, you and your neighbor had an understanding as to the location of the boundary between your properties, and this understanding existed between the prior property owners, you might be in trouble. There is a concept in real estate law called adverse possession that gives land that has over time, been openly used by another the rights to that property. It is generally hard to prove adverse possession between neighbors. Since you indicated that there was no fence, it will be even harder for your neighbor to prove it. And, who has been paying the taxes on that 10 foot strip for the past several years? You might want to visit the tax assessor’s office to look at the map of the tax parcels in your area. If the tax parcel matches your property’s legal description, you can claim that you have been paying taxes on the ten feet in question, further weakening your neighbor’s claim of adverse possession. All of these issues taken together will give you a better picture of where the property lines are and whether the neighbor has any claim to the ten feet. Good luck.
