Recent natural disasters remind us that our lives can quickly be turned upside down with little warning. September is National Preparedness Month, which makes now a perfect time to prepare your family and household for emergency situations that are most likely to impact our area. The Federal Emergency Management Agency’s (FEMA’s) Ready.gov website provides information on how to be prepared for both natural and man-made disasters. FEMA recommends following these steps to plan ahead for emergency situations. Sign up for emergency alerts. Discuss with your family or household members how you will each receive emergency alerts and warnings. Check to see what wireless emergency alerts are offered by your state or local public safety officials and sign up to receive the latest news. Devise a shelter plan. Depending on the emergency, you may be required to evacuate or seek shelter in another location. Or, you may be advised to stay at home and shelter-inplace. Review the recommended shelter plans for the type of disasters that are likely to affect your area. For example, with a tornado warning, you should seek shelter in a basement or an interior room on the lowest level away from corners, windows, doors and outside walls.

Create an evacuation plan. If necessary, you’ll need to know an evacuation plan. You may have a few days to prepare for an evacuation or you may need to leave your home immediately. That’s why it’s important to assemble supplies ahead of time, both a “go-bag” you can carry if you need to you evacuate on foot or public transportation and supplies for traveling by longer distances if you have a personal vehicle.

A disaster can strike without warning, and the best way to protect your family is to be prepared. These tips, along with additional information available on www. ready.gov, are a good start to make sure your family is safe and comfortable following an emergency situation. Q: ABOUT A YEAR AGO, MY FIANCÉ AND I PURCHASED A LOT IN A SUBDIVISION. BOTH OF OUR NAMES ARE ON THE CASH SALE, BUT I DID NOT PAY ANY MONEY AT THE TIME. WE HAVE SINCE ENDED OUR RELATIONSHIP, AND SHE IS TRYING TO REMOVE MY NAME FROM THE CASH SALE. CAN SHE DO THIS? DO I NEED AN ATTORNEY? A: In order for your fiancé to remove your name from the deed, you must sign a deed conveying your interest in the property to her. If however, you are unwilling to transfer your interest to her, your name will remain on the title until one of your files to partition the property, or until one of you gives in and agrees to sell your interest to the other person. If you are willing to transfer your interest to her, one of you will need to hire an attorney to prepare a cash sale or donation. I would not suggest trying to prepare one of these on your own. Hopefully, the situation is no so bad that your fiancé would try to forge your signature on the deed, which of course is illegal. She will then have to trick a notary into notarizing your signature without you being present, which is also illegal. And hopefully, you didn’t previously sign a

power of attorney, giving your fiancé the legal authority to sign your name and manage your affairs. If you did, and this document authorizes him to sell or donate your immovable property, you should have an attorney prepare a revocation and you should file the revocation in the parish where the power of attorney was originally filed and in Lafayette Parish, if that is where the property is located. If you don’t want to co-own the lot with her anymore, the simplest solution may be for you to approach her and offer to sell her your interest for a certain amount of money. She may be willing to pay you a few thousand dollars, rather than risk having to give you half of the sales proceeds when you both later sell the property. If you decide to go this route, any experienced real estate lawyer should be able to prepare documents necessary to affect the transfer of your ownership interest to your fiancé. If you are not interested in transferring your interest to her, you probably don’t need an attorney right now. However, if you learn that your name has been forged, or if either of you approaches the other about a possible transfer of the property, then you should hire an attorney.

NEIGHBORHOOD CAT REEKING HAVOC ON FLOWERBEDS Q: THERE IS A CAT IN OUR NEIGHBORHOOD THAT FREELY ROAMS AROUND, NIGHT AND DAY. SHE OFTEN USES OUR FLOWERBED AS HER PERSONAL LITTER BOX. I KNOW THERE ARE LEASH LAWS AND POOPER-SCOOPER LAWS FOR DOGS IN LAFAYETTE, BUT DOES THIS LAW ALSO APPLY TO CATS. IF SO, HOW CAN I GET IN ENFORCED? A: It is unlawful for owners to permit their animals (regardless of whether that animal is a cat or dog) to damage someone else’s property. But, since cats are loath to follow orders, you might want to try talking to the cat’s owners. If the cat’s owners are uncooperative, you can file a

complaint with animal control, depending on the circumstances; your complaint may result in a fine or just a warning. There are also some things you can do to deter your neighbor’s furry friend from roaming in your yard, and using your flowerbed as a litter box. Check with a local veterinarian or pet store for some safe suggestions. If the cat is wild, or you don’t know who her owner is, animal control will probably loan you a humane, no-kill trap. If you were successful in nabbing the cat, she would go to a shelter. Under no circumstances, however, can you harm her. If you do, you could end up being arrested and explaining your actions to a judge.
