HOME DIDN’T APPRAISE FOR ASKING PRICE - NOW WHAT?

Q: I RECENTLY SIGNED A PURCHASE AGREEMENT FOR A HOUSE AND THE APPRAISAL CAME BACK $10,000 LESS THAN THE PURCHASE PRICE. WHAT ARE MY OPTIONS?

A: What your options are depends on what’s actually written in your Purchase Agreement. If your Purchase Agreement was contingent upon appraisal, and the property didn’t appraise for the selling price, you can simply walk away from the deal. If you put down a deposit, you should get your deposit back also. If your agreement to purchase the property was not contingent upon appraisal, you probably have a few options. You could ask the seller to lower the selling price, make a larger down payment, find another lender, or walk away from the deal. To start, most home loans are for 80 to 95 percent of the home’s purchase price and most home Purchase Agreements state the deal is contingent upon the buyer obtaining satisfactory financing. This is probably the case in your deal as well. For example, let’s say you contracted to buy the house for $200,000, and planned on putting down a 10% down payment, or $20,000. You would need to obtain financing for $180,000, the remaining 90 percent. This is what’s known by the bank as a loan-to-value ratio (LTV). The higher the ratio, the less flexible lenders become. This is because they have less collateral. Now, if the value of the house is determined by the bank’s appraiser to be only $190,000 (to use your $10,000 figure in this example), and the lender has consented to lend you only a maximum of 90 percent of its appraised value -- $171,000 based on the new appraisal -- you’ve got a $9,000 shortfall on your hands. First, you may be asked to make up the difference by putting $9,000 more into the down payment. If you are dead set on having the house, you might be able to make up that difference over a period of time - simply through appreciation. Of course, this assumes that home values will continue to rise, like they have been doing. If you don’t have the extra $9,000 to put into the down payment, or simply don’t want to pay more than the appraised value, your real estate agent should approach the sellers to see if they’re willing to drop the sales price to the appraised value. Since you already have the appraisal, you have some leverage when negotiating with the seller. Depending on how many offers the sellers have had and how motivated they are to sell the home quickly, they may be willing to lower the sales price to keep the deal alive. If the seller won’t back off the price any, and you still want the home, you may be able to renegotiate with your lender, to obtain more than 90% financing, or you may be able to obtain financing from another lender. Finally, you can probably get out of the contract pretty easily, citing the appraisal differential and your inability to get sufficient financing

Q: IS IT A GOOD IDEA TO GIVE A COPY OF MY WILL TO MY WIFE, THE EXECUTOR OF MY ESTATE? WHAT ABOUT GIVING A COPY TO MY CHILDREN?

A: Whether you decide to provide copies of your will to your wife or children depends in large part on your relationship with them. Some people simply don’t want to share the details of their estate plans with anyone, even the executor of their estate. Many people simply don’t want other people knowing what they are worth and what assets they have. And, by reading your will, your wife and/or children will probably be able to figure out exactly what assets you have. Your wife may already know what you are worth, but your children might not. If you don’t want them to know, it would probably not be a good idea to give them a copy of your will. And, some people like the bequests in their will to be a surprise. If that is the case with you, it would probably be best for your wife and children to wait until after you’ve passed away to learn what you’ve done. Some people, on the other hand, have no problem giving copies of their will to the executor and the beneficiaries named in the will. For some people, there are simply no secrets. And, if you don’t have a lot of bequests, or your family is already well aware of what you have, you may not mind giving copies to your wife and children. Giving your wife a copy of your will also has a few potential benefits. For example, if the original of your will gets lost, or can’t be located after you die, a copy of your will could be probated as long as your wife can prove to the court that you did not revoke it prior to your death. And, if you give you wife a copy of the will for her to read, she will have an idea of what she will be required to do upon your death. If you have an open relationship with your wife and children, and they will be receiving your entire estate, or equal shares, then there’s no reason not to give them copies. ACADIANA HOMEFINDER
