FAIR HOUSING ACT PROTECTS PERSONS WITH DISABILITIES Q: I AM RECENTLY WHEEL CHAIR BOUND AND MY LANDLORD INDICATED THAT HE WILL HAVE TO INCREASE MY RENT IN ORDER TO MAKE MY CONDO WHEELCHAIR ACCESSIBLE. CAN HE DO THIS?

A: Federal laws define a person with a disability as “any person who has a physical or mental impairment that substantially limits one or more major life activities; has a record of such impairment; or is regarded as having such an impairment.” Regardless of whether you live in private or public housing, as a person with a disability, you have some basic rights. Federal law requires housing providers to make reasonable accommodations for people with disabilities. As a general rule, a reasonable accommodation is defined as a change in the rules, policies, practices, or services so that a person with a disability will have an equal opportunity to use and enjoy the house/apartment or common space. This does not however mean the housing provider has to undertake an undue financial or administrative burden to accommodate a disabled person. An example of a reasonable accommodation might be the housing provider agreeing to provide a tenant who is mobility impaired with a reserved parking space in front of their apartment, even though the rest of the tenants don’t have reserved parking. Also, federal law requires housing providers to allow people with disabilities to make reasonable modifications to their house or apartment. For example, they might have to allow the disabled person to install a ramp to get into the house, or to install grab bars in the bathroom. Q: WE HIRED A CONTRACTOR TO HELP US MAKE SOME IMPROVEMENTS TO OUR BACK YARD. HE BUILT A PATIO, STAINED THE CONCRETE, AND DID A LOT OF LANDSCAPING. WE WERE PLEASED WITH THE FINAL RESULT, BUT THE CONTRACTOR’S ORIGINAL BID WAS CONSIDERABLY LESS THAN HIS FINAL BILL. ACCORDINGLY, WE REFUSED TO PAY A PORTION OF THE BILL. APPARENTLY, WHEN WE DIDN’T PAY HIM, HE DIDN’T PAY ONE OF THE SUPPLIERS, AND THEY PLACED A LIEN ON OUR HOUSE. WE EVENTUALLY RESOLVED MATTERS WITH HIM, HE PAID THE SUPPLIER, AND THE LIEN HAS BEEN REMOVED. WILL THIS LIEN, EVEN THOUGH IT HAS NOW BEEN REMOVED, HAVE ANY EFFECT ON OUR CREDIT RATING?

A: This type of lien is commonly called a materialman’s lien. Often times, when subcontractors or supplies don’t get promptly paid for work they do on someone’s home, they will file a materialman’s lien. It’s their way of making sure you will eventually pay up. If you don’t, they have a claim on your property.w Of course, homeowners want any materialman’s lien promptly removed once payment has been made. In your case, this seems to have happened. Now, on to your question. All three of the credit-reporting agencies - Experian, Equifax, and TransUnion — sift through public documents for state and federal tax liens. And, as a general rule, a tax lien will have a serious negative impact on a borrower’s credit rating - an impact that can last for years. However, none of the credit-reporting agency looks for materialman’s liens, so these types of liens are not reflected on a person’s credit report. Most of the credit reporting agencies think of a materialman’s lien as an insurance policy that the contractor holds, not necessarily a debt the consumer owes. Accordingly, they are not considered derogatory pieces of information, and should not have a negative impact on your credit score. There is however, one caveat. Several years ago, credit-reporting agencies did look for materialman’s liens. Therefore, it is possible an old one could still turn up on your credit report. This is why it’s a good idea for anyone who had one of these liens in the past to check their reports. The credit-reporting agencies all provide free copies of your report — and it’s important to review all three because they’re not the same. Details on how to get the reports are on each of the credit reporting agencies’ Web sites.
