Q: AS A SMALL BUSINESS OWNER, WHAT DO I NEED TO KNOW ABOUT THE FAMILY MEDICAL LEAVE ACT? A: The Family Medical Leave Act (FMLA) is one of many that you should familiarize yourself with, because many of the federal employment laws do not consider the excuse of ignorance of the law as a defense to any violation of a provision of the law. The cost of compliance is high, but fortunately it is possible to minimize this cost by understanding what FMLA requires of the employer. The FMLA favors employees and requires employers to protect the jobs of eligible employees who take time off for medical reasons as provided in the act. Among others, it applies to companies which have 50 employees or more for at least 20 weeks in the current or previous calendar year. Therefore, the FMLA will apply to your business by the end of the year if you employ 50 to 60 people as projected. Be mindful of the 20 week provision in the act, especially if your small business has a fluctuating work force. If the issue comes up, you may need to review your records to determine whether the company met the 50 minimum for each week, and if you did employ 50 or more do a quick tall
to determine whether or not your company was above or below 20 weeks and this will determine whether your company is bound by FMLA. The FMLA covers both full and parttime employees, extending to temporary workers, and the employees working within 75 miles of the employer. To be eligible employees must have worked 1250 hours, not including any unpaid time off taken by the employee. The employee is guaranteed 12 weeks of job protected, unpaid time off in 12 months. As the small business owner, you have a few choices is deciding how to track the 12 months by using a 12 month calendar year; use any fixed 12 month time frame (i.e. fiscal year); count 12 months starting from when employee is first eligible for FMLA; or count backwards from when the employee began using FMLA. As you can tell one article cannot provide all of the information you need to know regarding the FMLA, not to mention other federal laws that apply with regard to employees and people in the workforce. Also, special provisions have been added to the FMLA due to Covid-19. Please remember, lack of knowledge is not a defense and will not hold up in court. Therefore, I strongly recommend you consult with an attorney to advise you on the applicability of FMLA and other federal and state laws as your company grows.

Q: AM I REQUIRED TO MOVE MY CAR OUT OF THE WAY IF AN A WRECK, OR WAIT TO MOVE UNTIL THE POLICE ARRIVE TO INVESTIGATE? A: It is against the law in Louisiana to leave the scene of an accident. You have a legal duty to remain at, or immediately return to, the scene of any motor vehicle accident you are involved in directly or indirectly. Failure to do this can result in a serious criminal charge. Louisiana has a “Move It, Move It, Move It---Steer it Clear” campaign that makes it the driver’s responsibility to remove vehicles from the roadway to the nearest soft shoulder. After an accident, pull your vehicle into an area that won’t cause additional disruption for other drivers, and turn off the ignition. Have someone warn approaching drivers of the
accident,if necessary, to prevent further damage and traffic congestion. There are some other things you should do at the scene of an accident, for example: • Get the names, address, phone number, vehicle permit number and insurance information from the other driver(s) involved; • Get the names, address, and phone numbers of any witnesses; • Write down anything anybody says about how the accident happened; • Tell the police officer if you think another driver is under the influence of alcohol or drugs. When you get home, you should call your insurance agent immediately. Also, take photographs of any damage to your car. If the accident was at all serious, you should also contact a lawyer. If you experience any pain or other symptoms, see your doctor.

Rising Lumber Prices Threaten Housing Affordability
Despite the toll the pandemic has taken on many industries, housing has been a bright spot for the U.S. economy, particularly for il h home sales, l US h b ildi iincreased d single-family home construction. New single-family a measure off U.S. home building, 13.9 percent in July representing a 13-year high. However, lumber prices have also reached record highs, jeopardizing housing affordability across the country. Without federal government intervention, the nationâ&#x20AC;&#x2122;s economic recovery is at risk and the American Dream for many families will be out of reach. Lumber prices have increased more than 170 percent since mid-April, adding $16,000 to the price of an average single-family home. A shortage of supply is driving the price surge. When stay-at-home orders and social distancing measures were enacted by state and local governments most lumber mills closed. Mill operators projected that housing would be adversely affected by the crisis and anticipated a large drop in demand. However, better-than-expected housing demand and home building activity, along with projects being done by the DIY segment, has left home builders experiencing shortages of lumber. Not only is housing affordability at risk, the housing industryâ&#x20AC;&#x2122;s potential to help lead the economy forward is limited as long as lumber remains expensive and scarce. And the ramifications for job growth are significant. Building 1,000 average single-family homes creates 2,900 full-time jobs and generates $110.96 million in taxes and fees for all levels of government to support police, firefighters and schools. Actions at the federal level can be taken to ensure a lasting and stable supply of lumber is available for the residential construction industry to continue to build homes and enrich communities. The National Association of Home Builders (NAHB) has reached out to the Administration and Congress to urge domestic lumber producers to ramp up production to ease shortages and work with Canada on a new softwood lumber agreement that would end tariffs averaging more than 20 percent on Canadian lumber shipments into the U.S. NAHB also has asked the U.S. Lumber Coalition to boost production and has offered to work with them to address shortages in the lumber supply chain caused in part by the pandemic.
