LENDER DETERMINES HOW MUCH MORTGAGE YOU CAN AFFORD Q: FIRST TIME HOMEBUYER HERE. I KNOW THE SIZE OF THE MORTGAGE I CAN HANDLE, BUT AM WORRIED THAT MY LENDER WON’T AGREE. HOW DOES A LENDER DETERMINE HOW MUCH MORTGAGE I CAN AFFORD? A: Lenders examine a few areas in determining the size of mortgage you can handle. Usually, they look at your monthly income, your non-housing expenses (credit card debt, car note, etc), and cash available for a down payment. The most common method lenders use to interpret these variables to estimate your mortgage capacity is the Percentage Method. As a general rule, you shouldn’t spend more than 28% of your income on housing costs. This includes your mortgage, your homeowners’ insurance and your real estate taxes. And, your housing costs plus your long-term debts (car loans, child support payments, minimum credit card payments, student loans, etc.) shouldn’t exceed 36% of your
income. Some lenders have more relaxed ratios, but as a general rule, most lenders apply the above ratios. Lenders may also use the Multiplier Method formula as a general rule of thumb to determine how much mortgage you can afford. Typically, most lenders allow a family to carry a mortgage that is two to three times its gross annual income (income before taxes and expenses are taken out). For example, if your gross average income is $75,000, most lenders would allow you to carry a mortgage of between $150,000 and $225,000. There are several useful sites on the internet that will help you determine what you can afford. But remember, each person’s situation is different. Just because the ratios used by a lender suggest you can afford a $200,000 mortgage, doesn’t necessarily mean you will want to contribute that much of your monthly income towards a mortgage payment. You should do your research, and make sure you are not getting in over your head.

Q: I’M HAVING A BILLING DISPUTE WITH A PLUMBER, AND HE HAS THREATENED TO PLACE A LIEN ON MY HOME. WHAT IS A LIEN, AND CAN A PLUMBER DO THIS? WHAT DO I DO IF HE DOES? I HAVE A GENUINE PROBLEM WITH THE QUALITY OF WORK HE DID AND THE HOURLY RATE HE HAS CHARGED. A: A lien or privilege as defined in Louisiana law is a claim or charge on property for payment of a debt or performance of an obligation. In this case, the plumber has a privilege on your home to secure payment arising out of work he did on the home. In Louisiana, the claim for the privilege has to be filed within sixty (60) days after the last day on the job, either by completion or abandonment. What constitutes the last day? It’s the final day of actual constructive

work that’s part of the original job. Simply calling a follow-up meeting at your home or finding another project to start (like convincing you to now let him install another toilet), does not restart the clock. So if he completed the plumbing job that it in dispute and has not been paid in full more than 60 days ago, he can no longer assert a privilege or lien on your home. Let’s say the plumber does file a timely lien. How you should respond depends on your situation. If you’re not planning to sell or refinance within the next eight months, you can simply wait to see if the plumber sues to foreclose on his lien. If he doesn’t within twelve (12) months of filing, his lien rights are lost again. If you need to get this matter resolved more quickly, you may have to go to court to get it eliminated or reduced. For that, you’ll need a lawyer.

RAA in the News Local REALTORS® Complete LR Leadership Program The Louisiana REALTORS® Association’s annual leadership development program has four sessions that focus on: leadership development, the Louisiana legislature and advocacy, diversity, service, communication styles, goal-setting and team-building. This program enables participants to better serve their clientele, the REALTOR® organization, and their communities. “It is such an exciting thing to see how many bright and dynamic leaders emerge from this program every year. These professionals are dedicated to the real estate industry, their clients, and are committed to becoming stronger leaders in their communities,” said Norman Morris, CEO.
