Prepare for Fall Now to Save Money Later By Mac Gibson, President Acadian Home Builders Association

Recently, we’ve enjoyed some nice weather here in Acadiana. The slightly cooler – or “less hot” –

temperatures should remind us that fall will be here before we know it. Now is the time to focus on a few simple home maintenance projects to prepare for cooler weather. Many of these are low- or no-cost DIY projects that can also help you save money on your energy bills, and most importantly, protect your home investment. Here are a few projects to check off your to-do list in the next couple of months: Mind the Gaps In cooler months, heated air can escape from gaps that develop where building materials meet. Inspect the areas where building materials may have pulled apart and caulk or seal any gaps that have formed. Check places where exterior siding meets windows and doors, around roof and foundation lines, around chimneys and where pipes protrude through walls or roofs.

Give Your Gutters Some Love Gutters and downspouts are easy traps for leaves and pine needles, and squirrels often use them to store food. Be sure to clean gutters thoroughly, and pay special attention to elbows and bends in the downspouts. Keep hangers fastened securely and plug any holes and cracks. Touch up any sections showing signs of rust with rustproof paint.

Insulate Escape Routes Heat rises, which means heat from your home can escape through any vulnerable areas of the roof. The most efficient way to stop that heat loss is by installing ceiling and roof insulation with an R-value of R30 to R60. The R-value refers to the ability of any material to resist the passage of heat. For example, a fiberglass bat or blanket 9 ½ to 10 inches thick has an R-value of approximately 30. You can raise that number to 38 simply by adding two or three more inches of fiberglass.

Inspect Your Heating Unit Consider replacing an older or inefficient heating unit with one which has a high efficiency rating. If your system is already efficient, be sure to inspect and clean it regularly. Be sure that filters are clean and that you change them monthly. A timer model thermostat that can turn the heat down while you sleep or when no one is at home can also help you save money. Performing routine home maintenance is essential and well worth the time and effort to keep energy bills low, protect your investment, keep your family safe and prolong the life of your home.

Weather Strip Your Windows Ensure that your windows and doors will effectively keep warm air in and cooler air out. Look for any cracks around glass, sashes and window frames. If you live in a home built in the last 15 years or so, you likely have double or triple-paned windows and low-emissivity (Low-E) glass. MAJORITY VOTE MAY NOT BE REQUIRED TO AMEND YOUR HOMEOWNER’S ASSOCIATION RULES Q: MY HOMEOWNER’S ASSOCIATION BOARD RECENTLY DECIDED THAT IT WANTED TO MAKE SOME CHANGES TO THE ORIGINAL CHARTER. SPECIFICALLY, THE HOA WANTS TO PROHIBIT THE OWNERS FROM RENTING THEIR HOMES. THERE ARE 40 HOMEOWNERS IN THE HOA, AND ABOUT 22 SHOWED UP FOR THE SPECIAL MEETING AT WHICH TIME THE RULES WERE PASSED. SINCE THERE WAS NOT A MAJORITY OF OWNERS, IS THIS ACTION LEGAL?

A: Well, it depends on whether your original HOA charter or rules addressed the procedure for the establishment, amendment, termination of such building restrictions which would require a majority vote. However, under the Louisiana Homeowner’s Association Act, a majority of owners would not be required for such an amendment. In the absence of a provision in your HOA’s rules, the Louisiana Homeowner’s Association Action applies. Per the LHAA, building restrictions may be established by agreement of three-fourths of the lot owners; existing building restrictions may be made more onerous or increased by agreement of two-thirds of the lot owners; and existing building restrictions may be made less onerous, reduced or terminated by agreement of more than one-half of the lot owners. The law requires more than one-half of the lot owners to agree on terminating an existing building restriction; therefore, assuming that all 22 lot owners who attended the special meeting voted in favor of the termination, then there violation of the LHAA.

Again, the applicability of the rules provided for in the Louisiana Homeowner’s Association Act only applies if the rules of your neighborhood’s HOA are silent on the issue. You should first check the rules contained in your charter mentioned above. It is unlikely that more stringent rules would be imposed than what the law allows, and very likely that the rules for your HOA are the same as the rules stated in the LHAA.

STARTING A NEW POLITICAL PARTY MAY BE TEMPTING, BUT NOT EASY Q: I HAVE THIS CRAZY NEIGHBOR WHO IS ALWAYS COMPLAINING ABOUT POLITICS AND THE CURRENT STATE OF OUR GOVERNMENT. THE OTHER NIGHT, HE WALKED OVER TO TELL ME THAT HE IS STARTING HIS OWN POLITICAL PARTY AND IS GOING TO RUN FOR CITY COUNCIL UNDER HIS NEWLY ORGANIZED POLITICAL PARTY. THE GUY IS OFF HIS ROCKER RIGHT? CAN HE REALLY JUST START HIS OWN POLITICAL PARTY? A: While there is nothing prohibiting your neighbor from starting his own political party, having it recognized by the State of Louisiana and running for office as a member of said party is an entirely different story. Pursuant to Louisiana law, a political party shall be recognized by the state if, ninety days prior to the opening of the qualifying period for any election, at least one thousand registered voters in the state are registered as being affiliated with such political party; the political party has filed a notarized registration statement with the Secretary of State and the political party has paid a registration fee of $1,000 to the Secretary of State. The registration statement shall not be accepted by the Secretary of State if: the name of the party is identical or deceptively similar to the name of any other existing political party; the name of the party is deliberately misleading or fraudulent in any respect; or an emblem submitted by the party is deceptively similar to an emblem or trademark of any other existing party. In sum, your neighbor needs 1,000 registered voters already affiliated with the party, $1,000, and an original name and emblem. Qualifying opens for statewide elections on September 8, 2015, and closes at 4:30 pm on September 10. While it is too late to request recognition of a new political party by the State, it certainly isn’t too late for him to qualify and run for City Council.
