By Mac Gibson, President Acadian Home Builders Association Because of Acadiana’s outstanding economy and resilient housing industry, some national builders have moved into our area to capitalize on our good fortune. These companies often use national suppliers and bring labor from other states, making it easy for them to offer low home prices. While efficiency and price might make the big box builders appealing, quality and workmanship usually suffers. Recent local news stories have featured many unhappy homeowners who made the mistake of dealing with a national builder. If you are considering building – or buying a newly built home – going with a local company, a member of the Acadian Home Builders Association, could save you a lot of heartache. The Acadian Home Builders Association has a long history and outstanding reputation in the community. Our annual events – The Home, Garden & Lifestyle Show, Parade of Homes and Home for the Holidays – are attended by thousands each year and allow us to continue our mission of promoting professionalism and ethical business practices in the home building industry while providing quality housing that creates value for the homeowner and the community. The current membership of AHBA includes 742 companies, 234 of which are residential builders. The rest are businesses which support the housing industry, everything from carpenters to cabinet makers, roofers, flooring suppliers, mortgage lenders, real estate sales professionals and more. Here to Stay When you are looking to build or buy a new home, it is important to ensure the services you require are performed by an expert who is familiar with the special building needs of Louisiana—hurricanes, high humidity, etc.—and here to stay long after the project is finished. All builder members of AHBA have businesses based in Acadiana, ensuring they can be easily reached years down the road if you have a question about your home. Once the housing market

begins to pick up in other areas of the country, some of the national builders may lose interest in Acadiana and close up shop. Licensed, Educated, Insured AHBA builders are licensed by the Louisiana State Licensing Board for Contractors, and as such, they have passed a test certifying that they are knowledgeable about all the elements of building a home. Each year, builders must earn six hours of continuing education credits to maintain their understanding of the industry as well as their license. They do so by attending classes on building issues and techniques which are offered to them by AHBA and other Louisiana home builder associations. Builder members of AHBA are also required to carry workman’s compensation insurance as well as general liability, which protect you if any unfortunate incident should happen on your project. Quality Is Built In Building with local companies who construct only a few houses per year ensures higher quality, attention to detail, and more personal service. Smaller volume builders have time to personally visit each job site on a regular basis and ensure installations are done correctly and to the home buyer’s specifications. They are also readily available to their clients, answering questions in a prompt fashion and developing close, lasting relationships. WHY WOULD ONE WANT “RESERVE” MINERAL RIGHTS?

TO

Q: WHAT IS A MINERAL RESERVATION? I’M SELLING SOME LAND I RECENTLY INHERITED, AND A FRIEND OF MINE MENTIONED THAT I SHOULD RESERVE THE MINERAL RIGHTS. A: Basically, when someone sells their land, they sell all of their rights, title and interest in the land, which includes the rights in any minerals that could be extracted from that land. However, one may retain or “reserve” his rights in those minerals, among other things, in the sale of the land from which they are derived, and this is known as a “mineral reservation”. In this case, whoever owns the mineral rights, not necessarily the landowner, would be entitled to any profits from the sale or lease of those minerals or those mineral rights. In this case, an oil company may have paid your cousins for entering into a lease for the extraction of those minerals.

It is worth mentioning, as well, that even if someone sells his land with a mineral reservation, he will not necessarily own those rights forever until he decides to sell them. CHOOSING A CLOSING ATTORNEY Q: MY WIFE AND I RECENTLY SIGNED A PURCHASE AGREEMENT TO BUY OUR FIRST HOME. WHEN WE WERE DISCUSSING WITH OUR LENDER WHAT WE NEEDED TO DO PRIOR TO CLOSING, SHE ASKED US WHICH ATTORNEY WE PLANNED ON USING TO DO OUR CLOSING. CAN ANY LICENSED ATTORNEY WE CHOOSE DO OUR CLOSING OR ARE WE LIMITED TO ONE OF THE ATTORNEYS RECOMMENDED BY OUR LENDER?

A: As the buyer, you do have the right to choose a closing attorney. Most lenders, however, require that you choose from a list of attorneys they have approved. This is because many attorneys today are specialized, and it is important that the attorney you hire to represent you in the purchase of your home is familiar with the current real estate practices in this area. It is very important that you hire a closing attorney that is well versed in real estate transactions, and that has sufficient experience to tackle any problems that may arise. A personal injury attorney or a corporate attorney, while they may be very good at what they do, may have no idea how to cure a title defect, or they may not even recognize that one exists. This could mean big problems for you down the road. Typically, an attorney’s role in a real estate transaction includes the actual preparation of the cash sale, preparation of other necessary closing documents, a title examination, and explanation of the closing documents at the actual closing. The closing attorney usually presides over the closing and supervises the post closing details. A closing attorney also works closely with your lender and realtor to ensure that the transaction goes smoothly. A particularly important part of the closing attorney’s job is to ensure that the seller has good marketable title to sell you the property at issue. The closing attorney is responsible for examining the public records to determine the condition of the Seller’s title to the property. The closing attorney’s examination should disclose: a. whether the Seller is in fact the legal owner of the property; b. the presence of any unpaid mortgage(s), judgments or other liens which must be satisfied before clear title can be conveyed to you; c. the existence of any restrictions, easements or right of ways affecting the property which may limit your rights even though you will own the property; and d. the status of property taxes. If the closing attorney discovers title defects, they work with the parties to resolve or cure them prior to the closing. Title insurance further guarantees that you are acquiring clear title to the property. Lenders generally require that a title insurance policy be provided to protect against title problems.

They must ensure that the mortgage and the cash sale are properly recorded, and that the lender receives all the necessary documents for their file. Additionally, if the seller had a mortgage on the property, they must make sure that the seller’s mortgage is properly cancelled. To prevent unexpected costs or fees, you and your wife should discuss the details of the transaction, the services to be provided, and the costs and fees for which you will be responsible, prior to the closing. Moody III College of Business Administration and Tuten Title & Escrow, LLC met Thursday, September 17, 2015 for a check signing recognizing the new Tuten Title & Escrow, LLC Endowed Scholarship for the B.I. Moody III College of Business Administration.
