While efficiency and price might make the big box builders appealing, quality and workmanship usually suffers. Recent local news stories have featured many unhappy homeowners who made the mistake of dealing with a national builder. If you are considering building – or buying a newly built home – going with a local company, a member of the Acadian Home Builders Association, could save you a lot of heartache. The Acadian Home Builders Association has a long history and outstanding reputation in the community. Licensed, Educated, Insured AHBA builders are licensed by the Louisiana State Licensing Board for Contractors, and as such, they have passed a test certifying that they are knowledgeable about all the elements of building a home. Each year, builders must earn six hours of continuing education credits to maintain their understanding of the industry as well as their license. They do so by attending classes on building issues and techniques which are offered to them by AHBA and other Louisiana home builder associations. Builder members of AHBA are also required to carry workman’s compensation insurance as well as general liability, which protect you if any unfortunate incident should happen on your project. Quality Is Built In Building with local companies who construct only a few houses per year ensures higher quality, attention to detail, and more personal service. Smaller volume builders have time to personally visit each job site on a regular basis and ensure installations are done correctly and to the home buyer’s specifications. They are also readily available to their clients, answering questions in a prompt fashion and developing close, lasting relationships. WHY WOULD ONE WANT “RESERVE” MINERAL RIGHTS?
TO
Q: WHAT IS A MINERAL RESERVATION? I’M SELLING SOME LAND I RECENTLY INHERITED, AND A FRIEND OF MINE MENTIONED THAT I SHOULD RESERVE THE MINERAL RIGHTS. A: Basically, when someone sells their land, they sell all of their rights, title and interest in the land, which includes the rights in any minerals that could be extracted from that land. However, one may retain or “reserve” his rights in those minerals, among other things, in the sale of the land from which they are derived, and this is known as a “mineral reservation”. In this case, whoever owns the mineral rights, not necessarily the landowner, would be entitled to any profits from the sale or lease of those minerals or those mineral rights. In this case, an oil company may have paid your cousins for entering into a lease for the extraction of those minerals.

It is worth mentioning, as well, that even if someone sells his land with a mineral reservation, he will not necessarily own those rights forever until he decides to sell them. In fact, in some cases after the passage of 10 years, any rights in minerals that he may have reserved at the time he sold the land can revert to the current landowner. If you are considering leasing the mineral sin your land and/or want to find out more about your mineral rights, in general, I suggest you consult a real estate attorney who will be able to determine your rights in the land you own now and any land you have owned in the past, and you can find out more about any options available to you with regard to your mineral rights.
CHOOSING A CLOSING ATTORNEY Q: MY WIFE AND I RECENTLY SIGNED A PURCHASE AGREEMENT TO BUY OUR FIRST HOME. WHEN WE WERE DISCUSSING WITH OUR LENDER WHAT WE NEEDED TO DO PRIOR TO CLOSING, SHE ASKED US WHICH ATTORNEY WE PLANNED ON USING TO DO OUR CLOSING. CAN ANY LICENSED ATTORNEY WE CHOOSE DO OUR CLOSING OR ARE WE LIMITED TO ONE OF THE ATTORNEYS RECOMMENDED BY OUR LENDER?
A: As the buyer, you do have the right to choose a closing attorney. Most lenders, however, require that you choose from a list of attorneys they have approved. This is because many attorneys today are specialized, and it is important that the attorney you hire to represent you in the purchase of your home is familiar with the current real estate practices in this area. It is very important that you hire a closing attorney that is well versed in real estate transactions, and that has sufficient experience to tackle any problems that may arise. A personal injury attorney or a corporate attorney, while they may be very good at what they do, may have no idea how to cure a title defect, or they may not even recognize that one exists. This could mean big problems for you down the road. Typically, an attorney’s role in a real estate transaction includes the actual preparation of the cash sale, preparation of other necessary closing documents, a title examination, and explanation of the closing documents at the actual closing. The closing attorney usually presides over the closing and supervises the post closing details. A closing attorney also works closely with your lender and realtor to ensure that the transaction goes smoothly. A particularly important part of the closing attorney’s job is to ensure that the seller has good marketable title to sell you the property at issue. The closing attorney is responsible for examining the public records to determine the condition of the Seller’s title to the property. The closing attorney’s examination should disclose: a. whether the Seller is in fact the legal owner of the property; b. the presence of any unpaid mortgage(s), judgments or other liens which must be satisfied before clear title can be conveyed to you; c. the existence of any restrictions, easements or right of ways affecting the property which may limit your rights even though you will own the property; and d. the status of property taxes. If the closing attorney discovers title defects, they work with the parties to resolve or cure them prior to the closing. Title insurance further guarantees that you are acquiring clear title to the property. Lenders generally require that a title insurance policy be provided to protect against title problems.

Moody III College of Business Administration.
