BUILDER’S MISTAKE SHOULDN’T BECOME YOUR EXPENSE Q: I SIGNED A CONTRACT WITH A LOCAL BUILDER HERE IN LAFAYETTE. I ALSO SIGNED TWO CHANGES ORDERS, THE LAST OF WHICH WAS FOR UPGRADES, INCLUDING GRANITE COUNTERTOPS AND HIGH END APPLIANCES. WE THEN PROCEEDED TO BUILD. A LITTLE OVER THREE MONTHS LATER, THE BUILDER CONTACTED ME AND SAID HE HAD MADE AN ERROR IN PRICING THE COUNTERTOPS AND APPLIANCES AND NOW HE WANTS ME TO PAY AN ADDITIONAL $8,500. HE IS THREATENING TO TAKE ME TO COURT IF I DON’T PAY THE DIFFERENCE. WHAT SHOULD I DO? A: To start, you need to hire an experienced real estate attorney to represent you. Based upon the facts as stated in your question, it would seem that you would not be obligated to pay any additional money to the builder. Essentially, it appears that the builder is trying to get out of a contract he no longer finds appealing. If the builder takes you to court, he would likely allege that the error in the contract was a mutual mistake, and that the contract needs to be rewritten to reflect the true intent of the parties. To be successful, he would have to prove the two

of you agreed on a price for the countertops and appliances and then somehow, a different figure was inserted into the written contract by mistake. Based on how you described things, it doesn’t’ sound like that is the way things happened. Instead, it sounds like you agreed on a price, signed an agreement setting forth that price and the upgrades to be made, and later, the builder realized he had made a mistake and should have charged you more. If that’s what really happened, then you would likely prevail in court. Unfortunately, you now find yourself in a predicament – the house is halfway complete, and the builder is demanding more money. Challenging the builder during the construction phase is a recipe for all sorts of additional problems. For example, he may get mad and do inferior work, or he may even take shortcuts, leaving you with far bigger problems on down the line. On the other hand, you don’t want to fold and pay the $8,500 either. After all, the two of you signed the change order based upon a stated price, and you shouldn’t be forced to pay an additional $8,500 just because your builder wants to charge more after the fact. Good luck.

Q: MY HUSBAND AND I RECENTLY SIGNED A RESIDENTIAL LISTING AGREEMENT TO SELL OUR HOME HERE IN LAFAYETTE BECAUSE WE WERE HOPING TO BUILD A NEW HOME. HOWEVER, AFTER SOME ADDITIONAL CONSIDERATION AND RESEARCH, WE HAVE DECIDED WE WOULD PROBABLY BE BETTER OFF KEEPING OUR HOME AND REMODELING. CAN THE AGENT STILL SELL OUR HOME EVEN IF WE HAVE CHANGED OUR MIND? WHAT DOES IRREVOCABLE MEAN? A: There is no need for you and your husband to panic. You and your husband have the right to withdraw from the listing agreement. The listing agent can’t sell your house against your wishes. The first thing you and your husband should do is talk to your agent. Let him or her know what is going on, and that you and your husband have decided not to sell your house at this time. Then,

you and your husband can “withdraw” the listing. The Listing Agreement is effective for a certain amount of time and the effective period should be stated in your Listing Agreement. Keep in mind that from now until the listing expires, you and your husband will not be able to list your home with anyone else without being liable to your current listing agent for damages. Irrevocable right to sell or exclusive right to sell means that the agent you entered into the Agreement with has the sole right to sell your home; therefore, if you withdraw from the listing agreement and take your house of the market you cannot then enter into another agreement with a different realtor without some consequences. Communication with your agent is key in this situation. Just explain your reasons for withdrawing from the listing agreement, and make sure that your agent understands that he or she has not done anything wrong. Good luck!
