Bathrooms Top Kitchens as Most Popular Remodeling Projects

The kitchen is king when it comes to making an impact on a home’s identity. Few other spaces in a home can even come close to the significance of the kitchen—making it truly the “heart of the home.” But having a beautiful bathroom is just as, if not more important for many home owners. In fact, according to a recent survey by the National Association of Home Builders (NAHB), bathrooms overtook kitchens as the most popular remodeling project.

Earlier this year, NAHB released the survey results, which rank the most common remodeling projects from the previous year. While many of the top projects have remained consistently popular over the years, kitchens and bathrooms continue to jockey for the top spot. “Small-scale renovations are slowly becoming just as popular as large-scale projects, as seen with bathroom remodeling becoming more common than kitchens,” said 2018 NAHB Remodelers Chair Joanne Theunissen, CPG, CGR, a remodeler from Mt. Pleasant, Mich. “Home owners are finding cost-effective and shortertimeframe upgrades not only add comfort to their homes, but they also add value.” Topping the List

Going ‘Green’ is Key

Among the remodelers who participated in the survey regarding the projects they completed within the last year:

While remodeling is commonly associated with kitchens and baths, demand for green upgrades continues to swell as home owners seek to save on utility costs, improve air quality and increase the value of their homes.

Rounding out the top 10 list of common remodeling jobs were: building decks, repairing property damage, finishing basements, performing general handyman services, and replacing or repairing roofs.

An additional survey by NAHB Remodelers showed that high-performing, low-emissivity (Low-E) windows are the most common green-building product installed by residential remodelers. Programmable thermostats and high-efficiency HVAC systems also ranked highly among the most common green products used.

Q: I RECENTLY PURCHASED A HOUSE. AT THE CLOSING, THE ATTORNEY SAID THAT THEY WOULD TAKE CARE OF RECORDING EVERYTHING AT THE COURTHOUSE, INCLUDING TITLE. WHAT IS THE PURPOSE OF RECORDING TITLE? A: When you purchase immovable property, you receive a written document (called a “cash sale”) that transfers the ownership (title) of the property from the seller to you as the purchaser. The cash sale gives you formal title in exchange for a specified amount of money (the purchase price). The conveyance of immovable property is not complete until all parties to the transaction sign the cash sale. The cash sale should also be recorded at the courthouse in the parish where the property is located. The purpose of recording the cash sale is to give “notice to the world” that you now have an ownership interest in that particular piece of property.

Recording title also tracks the chronological chain of title for the property. This means that anyone who wants to know who owns a piece of real property can check the records of the parish courthouse for the parish where the property is located. Before you purchased your house, the closing attorney or an abstractor ran title on the property to make sure that the seller was the true owner of the property. He/she also checked to make sure there weren’t any title defects in prior conveyances and transfers and transfers of the property. As purchaser of property, you need to be sure that each time the property was transferred in the past, the seller had clear title to the property and the previous purchasers obtained clear title. If someone in the past got less than “the whole bundle of sticks” you will not get clear title. This is why title is checked and things need to be recorded.

WHAT SHOULD YOU DO WITH PROPERTY LEFT BEHIND BY TENANT Q: I OWN A RENT HOUSE IN LAFAYETTE. THE TENANT MOVED OUT IN NOVEMBER, BUT PAID RENT FOR THE ENTIRE MONTH. HE LEFT BEHIND SEVERAL LARGE OBJECTS AND OTHER MISCELLANEOUS THINGS IN THE OUTSIDE STORAGE AREAS. I HAVE CONTACTED HIM SEVERAL TIMES VIA TEXT AND MAIL, REQUESTING THAT HE REMOVE THESE ITEMS, BUT HAVE YET TO GET ANYTHING REMOVED DESPITE HIS RESPONSES THAT HE WOULD REMOVE THE ITEMS. HOW LONG MUST I WAIT BEFORE I CAN DISPOSE OF THESE ITEMS? A: Whether a tenant moves out voluntarily or after an eviction, the landlord will likely find himself cleaning up and repairing the premises, but having to deal with items left behind by the tenant. Some of these are easily discernable as trash and can be disposed of, but the tricky part is when the property left behind seems to be of some value. Louisiana law provides some guidance with regard to Lessor’s privilege on items left behind when the tenant owes rent or damages that aren’t’ covered by the security deposit. However, the law is less clear when it comes to items of value that have been seemingly abandoned by the tenant. The first thing you should do is review the lease for any provision that may address abandoned property and disposal thereof. If the lease is silent on the issue and you’re fairly certain the property has been abandoned, then

you should take the following steps for your own legal protection: •Take an inventory of the property (photographs or a list) •Store any property that may have value •Give written notice to the former tenant, pursuant to the notice provisions in the lease agreement detailing how and where he can pick up the property with a set deadline. •State that failure to claim the property by the deadline will result in the disposal of the property. After these steps have been implemented, and the deadline is passed you can dispose of the property without having to worry about liability on your part. You have already place the former tenant on notice. If you have not taken an inventory, you should go ahead and do that. I recommend one last correspondence to the former tenant with a deadline to pick up the property. If he fails to comply, then the property can be declared abandoned and disposed of accordingly. You should also consider revising the lease agreement for the next tenant that includes a provision on dealing with property left behind after the lease agreement terminates. If you are uncertain about how to move forward, we suggest that you get professional advice from an attorney who handles landlord-tenant issues. Good Luck!
