Q: MY FATHER’S WILL, WHICH WAS ALMOST 10 YEARS OLD, LEFT REAL ESTATE, CASH AND OTHER PROPERTY TO SEVERAL FAMILY MEMBERS, INCLUDING MYSELF, HOWEVER, THERE AREN’T ENOUGH LIQUID ASSETS TO FULFILL ALL OF HIS CASH BEQUESTS, AND SOME OF THE PROPERTY REFERRED TO IN HIS WILL WAS SOLD A FEW YEARS AGO. ALSO, SOME OF THE STOCK SHARES REFERRED TO IN HIS WILL WERE SOLD LAST YEAR TO HELP PAY FOR HIS MEDICAL EXPENSES. HOW DO WE FIGURE OUT WHO GETS WHAT? A: There is a chance that you father’s will states what is to happen in the event assets don’t exist or there isn’t enough money to satisfy all of his cash bequests. Many attorneys now include this type of language near the end of each will they prepare, however, the attorney that drafted your father’s will may not have done so ten years ago. If your father’s will doesn’t clearly state what is to happen in this type of situation, you have to look at the specific provisions of Louisiana probate law. First, before any distributions can be made, the executor of your father’s estate must first pay all of your father’s debts and all of the expenses of administering his estate. This is because most lawyers and accountants won’t
work for free. With regards to the property that your father sold before his death, those gifts are null and void. The same is true for the stock shares that were sold to pay for his medical care. In Louisiana, one can only give away what they die possessed of. So, if a person disposes of property before they die, they can’t dispose of it again in their will. There are specific statutory provisions in Louisiana that outline how your father’s bequests are to be made in the event there is not enough to go around. However, without reading your father’s will and reviewing a complete list of the assets of your father’s estate, it is impossible for me to completely answer your question. The attorney that is probating your father’s will should be able to explain which bequests can be honored, and which ones cannot be satisfied. Normally, specifically mentioned real estate bequests are taken care of first. Once all of the administration expenses have been paid and all of the real estate bequests have been satisfied, the remaining cash bequests will probably have to be reduced proportionately. Please note that this answer is a simplification of Louisiana law and there may be exceptions that apply in your situation. After reviewing your father’s will and examining the assets and debts of his estate, an experienced probate attorney should be able to help you sort things out.

Q: I RECENTLY WENT TO MY BANK TO APPLY FOR AN UNSECURED LOAN AND WAS TOLD I DIDN’T QUALIFY, PRIMARILY BECAUSE FICO SCORE WAS TOO LOW. WHAT EXACTLY IS A FICO SCORE, AND HOW IS IT DETERMINED? IS THERE ANYTHING I CAN DO TO RAISE MY LOW SCORE? A: A FICO score is a credit score developed by Fair Isaac & Co. Credit scoring is one of the primary methods lenders use to determine the likelihood that a borrower will pay their bills. Essentially, a credit score attempts to summarize a borrowers credit history into a single number. Credit scores are calculated by using scoring models and mathematical tables that assign points for different pieces of information which best predict future credit performance. Credit scores analyze a borrower’s credit history by taking into consideration a number of factors, including: • Then number and frequency of late payments; • The amount of time credit has been established; • The amount of credit used versus the amount of credit available;

The Length of time at present residence; • Employment history; and • Negative credit information such as bankruptcies, charge-offs, collections, etc. It is difficult to quickly increase your score, however, there are a number of things you can do to increase your score over a period of time. To start, pay your bills on time. Late payments and collections can have a serious impact on your score. If possible, don’t apply for credit frequently. Having a large number of inquiries on your credit report can sometimes worsen your score. Also, if you have large balances on your credit cards, or have reached the limit one or more of your credit cards, this can have a negative impact on your credit score negatively. If possible, try to pay these balances down. Finally, if you have limited credit, you might want to try to obtain additional credit. Not having sufficient credit can also negatively impact your score.
