New Downpayment Program Expands Homeownership Opportunities By Mac Gibson, President Acadian Home Builders Association
Now is a great time to buy with interest rates remaining low and many great homes on the market in Acadiana. However, many potential buyers may feel that qualifying for a mortgage and saving for a downpayment are impeding their path to homeownership.
There are many reasons for this trend. The recession caused many adult children to return home after college, either because they weren’t able to get jobs that would cover rent, or they wanted to save up to buy homes of their own.
The good news is that while lenders are looking more closely at borrowers today than in recent years, there are options for purchasing your home without a 20% downpayment. In fact, creditworthy borrowers with moderate to low incomes will be able to purchase a home with a downpayment as low as 3% through Fannie Mae’s new HomeReady mortgage program.
Multigenerational households also form so that grandparents can help take care of their grandchildren, and as they age, their children can care for them. This type of arrangement can ease financial burdens as well, with several generations contributing to the mortgage payment without having to incur the expenses of childcare, retirement housing or professional caregiving environments.

Fannie Mae’s research indicates that these types of extended households tend to have incomes that are as stable or more stable than other households at similar income levels, positioning them well for homeownership.

HomeReady will expand and replace Fannie Mae’s current affordable lending program, MyCommunityMortgage, to include both first-time and repeat home buyers. By increasing access to affordable mortgages, more borrowers should be able to purchase homes. In an effort to increase the types of households that qualify for the mortgage program, more flexible sources of funds can be used for the downpayment and closing costs. For example, income from a nonborrower household member can be considered to determine an appropriate debt-to-income ratio for the loan. This should help multigenerational and extended households qualify for these mortgages. Multigenerational households or family households consisting of three or more generations have become increasingly popular in recent years. According to the most recent Census, approximately 4.4 million American homes had three generations or more living under one roof in 2010, a 15 percent increase from two years earlier.
The new mortgage program also allows income from non-occupant borrowers, such as parents, and rental payments, such as an on property apartment, to supplement the borrower’s qualifying income. Borrowers will be required to complete an online education course about the buying process and the responsibilities of homeownership. In addition, the program will offer homeowners support through the life of the loan to help ensure sustainable homeownership. Q: I HAVE BEEN IN MY HOUSE FOR SEVERAL YEARS NOW, AND WOULD LIKE TO ADD ON A ROOM AND UPDATE MY KITCHEN AND ONE OF THE BATHROOMS. I HAVE SEEN SEVERAL ADVERTISEMENTS FOR HOME EQUITY LOANS AND LINES OF CREDIT. WHAT IS THE DIFFERENCE BETWEEN THE TWO? IS ONE BETTER THAN THE OTHER?
Q: MY FATHER AND STEPMOTHER PURCHASED A HOME TOGETHER BEFORE THEY DIED. MY FATHER PASSED AWAY BEFORE MY STEPMOTHER DID, AND HE DID NOT LEAVE A WILL. AS HIS ONLY SON, I AM THE ONLY HEIR. A FEW YEARS AFTER MY FATHER PASSED AWAY, MY STEPMOTHER REMARRIED. A FEW YEARS LATER, SHE DIED – ALSO WITHOUT A WILL. SHE DOESN’T HAVE ANY CHILDREN, BUT SHE DOES HAVE THREE NEPHEWS. A: The traditional second mortgage loan (a home equity loan) provides you with a fixed amount of money that you must pay back over a set period of time. The payment schedule normally calls for equal payments over a period of several years. If you know that you need a certain amount for a specific purpose, a traditional second mortgage loan may be the way to go. If you aren’t sure exactly how much the project you are undertaking is going to cost, or you are going to spread your improvements out over a period of time, a line of credit might better suit your needs.

In deciding which type of loan is best for you, be sure to consider the Annual Percentage Rate (APR) and the other charges associated with the loan. The APR for a traditional mortgage loan is not figured the same way as the APR for a home equity line of credit. The APR for a traditional mortgage takes into account the interest rate charged, plus points and other finance charges. The APR for a home equity line of credit is normally based solely on the periodic interest rate, and generally does not include points or other finance charges. Borrowers of home equity loans and lines of credit are also sometimes required to pay closing costs, which often include loan points, an application fee, a loan origination fee, a title search, an appraisal free, a credit check, as well as notary and/or legal fees. As you might expect, these fees vary from lender to lender and can add up quickly. Depending on the closing costs, you might find that a loan or line of credit with a higher interest rate, but lower fees is the way to go. Also, keep in mind that some lenders charge a maintenance fee of $75-$100 to keep your line of credit open.

Be careful of lenders trying to lure you with a low introductory rate. Often times, the introductory rates only last for a short period of time then skyrocket after the introductory period expires. Be sure to ask what the rate figures to be over the life of the loan. It should be based on the prime rate and, as with any home equity loan, should not exceed it by more than about three percentage points.
A: Since you did not mention a prenuptial agreement between your father and stepmother, I assume the house was community property. That being said, when your father died without a will, according to Louisiana testate law, his one-half interest in the community home passed to you, subject to your stepmother’s usufruct – the right to live in the home until her death. When your stepmother died without a will, her one-half interest in the home passed to her “heirs” as determined by Louisiana law. Unfortunately, you did not give me enough information to tell you who would inherit her estate under Louisiana law. Nevertheless, the house is no longer subject to a usufruct and you now own a full one-half of the home. Before you can do anything however, you will need hire an attorney to probate your father’s succession. You would be co-owners in indivision with whoever your stepmother’s heirs are. If you and the other co-owner(s) cannot agree on how to use the house, or you want to sell it and the other co-owner(s) don’t, you have the right to demand a judicial partition. The court can order a partition by licitation (sheriff’s sale) or by private sale. Once this has been done and costs had been paid, the proceeds would be distributed to the co-owners in proportion to their shares.
Finally, be sure to read the fine print to make sure the loan doesn’t include a penalty for pre-payment. Prepayment penalties can be significant, and are certainly something you want to avoid. If you have questions about the terms of the loan, ask your lender. A reputable lender will gladly answer your questions and provide you with the information you need to make an informed decision.
