Protect Your Home from Crime By Mac Gibson, President

Owning a home is the most valuable long-term investment most Americans ever make, and it is much more than a material possession. Home ownership builds a sense of stability, pride, accomplishment and peace of mind. So, protecting that home—and the loved ones that live in it—is a top priority for every family. Even if you live in a relatively safe neighborhood, it is important to take steps to protect your home. It never hurts to be prepared. Here are some tips from the National Crime Prevention Council (ncpc.org) to keep your home and your family safe from crime. Inside your home: •Install key locks, pins or other secure locks on every window and sliding glass door. Also secure sliding doors with secondary blocking devices such as a stick or broom handle. •Use anti-lift devices to prevent windows and glass doors from being lifted out. •Use high quality Grade-1 or -2 locks with a bolt that extends at least one inch into the door frame to resist prying open or forceful entry. •Use automatic timers to switch indoor lights on and off if you’re going to be away overnight, creating the illusion that someone is home. •If you have an alarm system, don’t write your passcode on or near the alarm keypad. Be consistent about setting the alarm every time you leave home, even if just for a few minutes. •Keep a home inventory of valuables including serial numbers, pictures and sales receipts, and keep a copy of the inventory in a safe place somewhere other than your home. If you are the victim of theft, this will help you get a fair settlement from your insurance company and replace your items promptly.

Outside your home •Keep your yard, porch, garage doors, pathways and entrances well-lit at night, either with permanent lighting or motion-detecting lights that turn on when someone comes within a certain distance. •Trim plants and shrubs that could serve as hiding places for criminals away from windows and doors. •Cut back tree limbs that could provide a way for thieves to climb into second-story or higher windows. •Display alarm company signs and decals on the windows and lawn. •Don’t hide a key outside your home. Leave a key with a trusted family member, friend or neighbor instead. •If you’re going to be away, stop your mail and newspaper delivery, or ask a neighbor to pick them up for you. •Ask a neighbor to park their car in your driveway while you’re away. •Lock gate latches, garage doors and sheds with high-security, laminated padlocks. •For items that need to be left out in the open, such as grills and bicycles, use a tarp to hide them from view and securely lock them to a stationary point such as a railing or post.

POLLING PLACES ARE CAMPAIGN FREE ZONES Q: MY NEIGHBOR AND I GETTING ALONG PRETTY WELL UNTIL AN ELECTION YEAR ROLLS AROUND. HIS DOOR IS RED AND MINE IS BLUE IF YOU GET MY DRIFT. THE THING IS WE LIVE ACROSS THE STREET FROM ONE OF THE LOCAL HIGH SCHOOLS WHERE VOTING WILL TAKE PLACE NEXT WEEKEND. HE HAS A BUNCH OF SIGNS IN HIS YARD, AND TOLD ME HE PLANS ON STANDING ON THE CORNER IN FRONT OF THE HIGH SCHOOL ON ELECTION DAY WITH A MEGAPHONE TO PERSUADE PEOPLE TO VOTE HIS WAY! CAN HE DO THIS? A: Your neighbors signs might be okay, but he cannot stand in front of the polling location with a megaphone electioneering. The right to vote is a right that is essential to the effective operation of a democratic government. To that end, the legislature passed a law protect the voters, a 600 foot campaign free zone from the entrance of any polling place from the hours of 6:00 a.m. until 9:00 p.m. on Election Day. There is an exception to this law for campaign signs on private property. The law arises out of a past, longstanding history of election problems, such as multiple voting, votes being recorded for persons who did not vote, votes being recorded for deceased people, voting by non-residents, vote buying, and voter intimidation, the legislature finds that the state has a compelling interest in securing a person’s right to vote in an environment which is free from intimidation, harassment, confusion, obstruction, and undue influence. As long as your neighbor’s signs are on private property and remain there he does not have to remove them on Election Day. He is prohibited from electioneering in the campaign free zone on Election Day and can face a fine and possible jail time if he violates the law.

FALSE AND MISLEADING POLITICAL ADS Q. THIS IS AN EDITOR’S NOTE ADDRESSING MULTIPLE QUESTIONS WE HAVE RECEIVED REGARDING THE APPARENT FALSE AND MISLEADING ELECTIONS RELATIVE TO THE UPCOMING ELECTION NEXT SATURDAY, OCTOBER 24, 2015. OUR READERS WANT TO KNOW THE LEGALITY OF RUNNING THESE FALSE AND MISLEADING ADS ABOUT CANDIDATES, AND WHAT CAN BE DONE ABOUT IT. CAN A CANDIDATE SUE FOR DEFAMATION? A. Candidates are not held to the same commercial standard applied to advertising as say, a commercial company selling fried chicken. Their statements and advertising are considered “political speech” which is protected by the First Amendment. Furthermore, a political candidate is a public figures who does not have the same expectation of privacy as a private person does and therefore proving defamation of character as a result of an attack ad is much more difficult as a public figure must prove actual malice by the publisher rather than just a falsity of the statement. Legally, with the First Amendment protection provided for political speech and the more difficult burden in proving defamation of candidate, suing for an attack ad is just not practical. The damage has been done, as the suit wouldn’t be brought until after the election. What about removing the Ads? Even if a broadcaster (TV, Radio, etc) knows a candidate’s ad is false or misleading it cannot refuse to air it or edit the ad. Under Federal Communications Commission rules, TV stations are not allowed to alter the content of political ads unless it violates a station’s policy. Since the broadcasters can’t censor a political candidate’s ad, the broadcaster is not liable for the content of a candidate’s ad. So no matter what the candidate may say – the broadcaster runs the ad as is. However, ads from third parties (PACs, SuperPACs, right to life groups and other advocacy organizations) are different. The “no censorship” provisions of the political rules don’t apply, so broadcasters are free to accept or reject third party ads based on the content of the ads. So, you may be successful in having a broadcaster pull a false and misleading ad if you can show enough evidence to the broadcaster of the ad’s falsity coupled with the risk of liability. The bottom line is attack ads work in winning elections. Studies have shown that voters believe attack ads, despite the act that the information is false and misleading.
