PROTECTION FROM IDENTITY THEFT

Q: I WAS RECENTLY WAS THE VICTIM OF IDENTITY THEFT. I HAVE FINALLY CLEARED EVERYTHING UP, BUT IT WAS TRAUMATIC. EVERY CREDITOR ASSUMED I WAS LYING, AND IT TOOK FOREVER TO RESOLVE EVERYTHING. AREN’T THERE LAWS TO PROTECT THE VICTIM IN THIS TYPE OF SITUATION? A: Yes, there are both state and federal laws designed to protect you. Some of these serve as deterrents to would-be thieves and others directly protect the victim in this type of situation. The federal law that makes identity theft illegal is known as the Identity and Assumption Deterrence Act of 1998. A conviction under this law typically carries a maximum 15-year sentence and a fine In addition, schemes to commit identity theft may also violate other state and federal laws, such as credit card fraud, computer fraud, mail and wire fraud, financial institution fraud, or Social Security fraud. Each of these federal offenses is a felony with additional penalties and jail terms, some of which are up to 30 years. Louisiana law also makes it a felony to steal another person’s identity, and the person who commits the offense of identity theft can be imprisoned, fined, and/or ordered to reimburse the victim from some of his/her expenses. Some of the laws that directly protect the consumer include the Fair Credit Reporting Act, which helps you make corrections to your credit report, and the Fair Credit Billing Act, which helps you resolve billing errors on credit card accounts. And there’s also the Electronic Fund Transfer Act, which applies to debit and credit cards and other electronic funds transfers. The Federal Trade Commission (FTC) has also developed a new form called the ID Theft Affidavit, which is designed to help people like you restore your name and credit. The ID Theft Affidavit is used to report information to various businesses, and it simplifies the process of disputing charges with companies where a new account was opened in your name. This form is available at the FTC’s Web site, www.consumer.gov/idtheft. The FTC also has a toll-free Identity Theft Hotline at 877-IDTHEFT (877-438-4338) that you can call if you have been the victim

of identity theft. Counselors are available to help answer your questions and to help you resolve the problems you are facing. Identify theft is becoming increasingly common, but there are a few steps you can take to make sure it doesn’t happen to you again. For example, be careful when giving out personal information, especially your Social Security number. Also, don’t give out information over the phone, via the Internet, or via the mail unless you initiate the contact, or unless you are absolutely sure you are dealing with a reputable company and authorized representative of that company. SHOULD I BUY DOWN MY INTEREST RATE WITH POINTS? Q: HOW MUCH LEEWAY DO I HAVE IN CONTROLLING HOW MUCH I PAY FOR A MORTGAGE? I RECENTLY INHERITED A RATHER LARGE SUM OF MONEY FROM MY GRANDMOTHER AND WOULD LIKE TO USE IT FOR A DOWN PAYMENT ON A NEW HOUSE. CAN I BUY A LOWER INTEREST RATE AND LESS IN FEES WITH THIS MONEY? IF SO, IS THIS A SMART THING TO DO? A: Basically you have two choices. You can either pay less in interest or less in fees, but not both. In the mortgage-lending industry a borrower often has the option of paying points. Points are fees; a point equals one percent (1%) of the loan amount. The more your loan is, the more a point is going to cost you. For example, one point on a $200,000 mortgage is $2,000.

The advantage of paying a point or points at the time of closing is that it allows you to get a lower interest rate over the life of your loan. The drawback is that points must be paid at the time of closing. Keep in mind too, that there are fees in addition to points. For example, a borrower might pay 4.25% with one point, or 4.5% with no points. (Rates change daily, so these are only examples.) It’s all a matter of what’s right for you. A basic rule of thumb is that if you are planning on keeping the house or mortgage for more than seven years, it makes sense to buy the interest rate down. In other words, pay more in fees because you will eventually recoup this cost through lower mortgage-interest costs. If you don’t want to pay more in fees to get a significantly lower rate, you can choose a higher interest rate.

Countdown to a perfectly clean guest-ready home no matter how much — or little — time you have. It feels great to have a clean, organized, well-functioning home when you’ve got guests coming. Especially around the holidays. It’s like your gift to you. Here’s how to get that satisfying feeling — no matter how much time you have. Just choose your starting point on this checklist: • Declutter again. • Vacuum and dust guest rooms. If they’re low-traffic, the cleanliness should hold with just a quick wipe-down right before they arrive. • Wipe down walls. • Wipe down kitchen and dining room chairs and tables, including the legs. You’d be surprised how grimy they get. • Deep clean the entryway — and make room for your guests’ stuff.

Think big picture. Get anything that requires a pro or installation out of the way now. No one wants calamity to strike when guests are pulling into the driveway. • Get your HVAC maintained if it’s overdue. • If you have a self-cleaning oven, clean it now. An oven is most likely to break down during the cleaning cycle, so don’t save this task for last. • Replace any appliance on its last legs. You don’t want your hot water to go out or fridge on the fritz with a houseful of guests. • Steam-clean upholstery. (Or hire a pro. It’s a big job) • Hire a handyman for those repairs you’ve been putting off. • Check outdoor lighting. Replace old bulbs and call an electrician to address any bigger issues.

They’re germ magnets. • Clean the front door. • Deep clean the bathroom your guests will use and close it off if possible. • Wash guest towels and linens.

Your guests’ bags are packed. Time for final touches. • Do a final declutter - by now it shouldn’t take more than five minutes. • Give one final wipe-down to toilets, tubs, and bathroom sinks. • And another final wipe-down in the kitchen. • Do all the floors: mop, vacuum, sweep, etc. • Make guest beds and set out clean towels. • Plug in nightlights in guest baths. • Put out guest toiletries so they’re easy to find. • Add a coffee or tea station in the guest room or kitchen. • Get your favorite smell going, whether it’s a scented candle, spices in water on the stove, or essential oils. • Use rubber gloves to wipe off pet hair and dust from furniture. It works. • Do the full red carpet: Sweep or shovel porch, steps, and outdoor walkways.
