Keep Your Fireplace Clean and Safe By Mark Gallagher, President Acadian Home Builders Association Picture yourself hosting a gathering at your home during the holidays. The mental image most likely includes some delicious food, festive music and a roaring fire in the fireplace, right? Building a fire creates a cozy atmosphere and adds an element of elegance. But whether yours is a wood-burning or gasburning fireplace, each requires maintenance to ensure it is safe to use. So before you light a match, consider the following: Gas Fireplaces A gas fireplace provides the comfort and style of a wood-burning unit, but they are more efficient and require far less maintenance. “Low-maintenance” does not mean “no-maintenance,” however, so it is best to have your gas fireplace inspected and adjusted by a professional on an annual basis. Vented gas fireplaces expel exhaust gases (mainly water vapor and carbon dioxide) outside your home without a chimney. If your gas fireplace is vented, the flue or vent should be closed when the fireplace is not in use. And regardless of whether yours is a vented or ventless fireplace, it nt should never produce a gas odor (different from a burning smell). The smell off gas could indicate a problem. Immediately turn off the gas and report the problem to the gas company. Wood-Burning Fireplaces Hiring a professiona al st chimney sweep at leas once every one to five e w years (depending on how he often you use it) is th best way to ensure it is saffe

to use. If you are in a newer home with a fresh air vent to supply the fireplace with combustion air, open it and the damper before you light your fire. Then remember to close both when you are not using the fireplace so warm air does not escape in the winter and cool air will not escape in the summer. Building and Extinguishing Fires A wood-burning fireplace should be equipped with andirons (or a grate) and a well-fitted screen. Fires should always be built on the andirons or grate — not directly on the fireplace floor. Seasoned hardwood is the best fuel. Do not burn pine logs in your fireplace, as they contain a tar that can accumulate in the chimney and become a fire hazard. You should never leave a fire unattended for an extended period of time, and always ensure the fire is put out when you are finished enjoying it. To properly extinguish a fire in a wood-burning fireplace, begin by using your fireplace poker or shovel to spread out the wood and embers into a flattened mound. After the flames die out, cover the cooling wood and embers with a few scoops of ash. Once the fire i completely extinguished, you can is sprinkle a thin layer of baking soda over the wood to ensure n embers are burning. no

BENEFITS OF HOME INSPECTION Q: I RECENTLY BOUGHT A HOUSE IN LAFAYETTE, AND A COUPLE OF WEEKS AFTER THE CLOSING, I DISCOVERED SOME WATER DAMAGE AND MOLD BEHIND ONE OF THE BATHROOM WALLS. THE PROPERTY DISCLOSURE FORM COMPLETED BY THE SELLER INDICATED THAT HE HAD NO KNOWLEDGE OF THESE PROBLEMS, AND I DID NOT HAVE AN INSPECTION DONE PRIOR TO PURCHASING THE HOME. CAN I GET THE SELLER TO PAY FOR REPAIRING THESE ISSUES?

A: Based on the situation you describe, it seems highly unlikely that you will be able to obtain compensation from the seller for the problems with your home. Though there is no guarantee that an inspection would have revealed the water and mold problems in your home, it would have been wise to have an inspection done prior to purchasing the home. Had an inspector discovered the problems you describe, the cost of repairs could have been negotiated with the seller prior to purchase. Had the seller been unwilling to make reasonable allowances for the necessary repairs, or if the cost of repairs exceeded a certain amount, the purchase agreement would likely have allowed you to simply walk away from the deal. Since the standard property disclosure form used in Louisiana, which was presumably the same form completed by the seller of your home, does not require the seller to have specific knowledge of every aspect of the home he is selling, it is permissible for a seller to truthfully indicate that he has no knowledge of whether or not certain conditions or defects exist in the home. Though you could attempt to pursue the seller in court, you will likely have a difficult time proving that he knew or should have known that the water and mold issues existed, based on your description of these problems. If you fail to prove that the seller knew or should have known of the water and mold problems, such that he did nothing wrong in completing the disclosure, then he will not likely be found liable to you. On the other hand, if the problems were readily apparent, at least some responsibility for detecting these problems will be placed upon you.

CASH PURCHASE REDUCES CLOSING COSTS Q: I RECENTLY INHERITED APPROXIMATELY $200,000.00 FROM A RELATIVE WHO PASSED AWAY, AND I WOULD LIKE TO USE THIS MONEY TO PURCHASE A HOME. WILL I SAVE MONEY BY PAYING CASH, INSTEAD OF BORROWING MONEY TO PAY FOR THE HOME? A: Since the seller would receive a lump sum of cash even if you borrowed money to pay for the house, it is unlikely that you will get a reduction on the price of a home due to the fact that you are paying cash. However, some sellers may find the prospect of your buying their home for cash attractive, since the sale will not be contingent on your ability to obtain financing to pay for the home. You should, however, realize considerable savings in closing costs by paying for your home in cash. Since many of the closing costs incurred with the purchase of a home are associated with obtaining a loan, such as lender fees, application fees and processing fees, you should be able to save a considerable amount of money by paying cash for your home. As always, I recommend that you find a competent real estate agent, with whom you are comfortable, to help guide you through the home buying process. Not only will this make the process easier, but it may save you from making a mistake which could be quite costly. .

Also, since the home you purchased was presumably not a new construction, the sale document for the home likely contained a provision that the home was sold to you “AS IS�, meaning that you were purchasing the home in its present condition and with any defects it may have had.
