Q: I HAVE BEEN STORING BOXES OF OLD BILLS, TAX RETURNS, BANK STATEMENTS AND OTHER PERSONAL RECORDS FOR SEVERAL YEARS NOW. HOW LONG DO I NEED TO KEEP ALL THESE RECORDS? CAN I THROW SOME OF THEM AWAY? A: To be on the safe side, you should keep copies of all records relating to your income tax returns for as long as they may be relevant to the Internal Revenue Service in determining how much tax you owe. Generally, the IRS has three years to assess additional tax upon an individual or company. However, if more than 25 percent of your gross income is omitted from a return, the IRS has up to six years to assess additional tax. And, if you fail to file a
return, if you file a false or fraudulent return, or if you intentionally attempt to evade paying taxes, there is not time limit on how far the IRS can go back. That said, the minimum amount of time you should keep most of your records is six years. You measure the amount of time you must keep records from the due date of your return or the date the return was filed, if later. Failure to maintain proper records can result in civil and criminal penalties. And, you should never throw away copies of your actual tax returns. You should also keep contracts, leases, corporate minutes, stock certificates, corporate and partnership records, all related correspondence, and supporting financial records indefinitely.

Q: I AM TRYING TO BUY A HOUSE, AND JUST FOUND OUT THERE IS A JUDGMENT AGAINST ME FROM AN OLD CREDIT CARD DEBT FROM YEARS AGO. I HAD HONESTLY FORGOTTEN ALL ABOUT IT! OOPS! WHAT DO I DO? A: A creditor likely obtained a judgment in its favor, adverse to you on the debt owed on the credit card. To ensure payment of the debt, the judgment was recorded in the mortgage records which fived the creditor the right to be paid from the proceeds of the sale of your property. This is called a judgment lien. In Louisiana, the judgment lien attaches to the debtor’s real estate (immovable property) such as a condo, house, land, or an interest
in property. To satisfy the judgment and cancel the lien, the amount of the judgment must be paid. You did mention that the judgment was an old credit card debt from many years ago. Under Louisiana law, the judgment lien only affects your property for 10 years. Therefore, if it has been ten years or more since the judgment was recorded, you may request cancellation of the judgment without paying the debt. This can be done by written request to the Recorder of Mortgages through the Clerk of Court in the Parish where the mortgage was recorded. Many clerk’s offices have a form that can be completed to obtain cancellation of the judgment. The form for Lafayette Parish can be found on www.lpclerk.com.

A Closer Look at Water Conservation in Your Home
Home owners use a considerable amount of water throughout the day from hand washing to yard maintenance. According to the Environmental Protection Agency (EPA), the average American family uses more than 300 gallons of water per day at home. Reducing water consumption is top of mind for many home buyers. According to a recent survey from the National Association of Home Builders, water-conserving fixtures — such as high-efficiency toilets, faucets and shower heads — were rated as essential or desirable home features by more than half of the respondents. The following are a few water-saving ideas for your home inside and out.

Eliminate Leaks. An easy way to save water is to make sure you have no identifiable water leaks. Ten percent of homes have leaks that waste 90 gallons or more per day. Common leaks inside your home are found in toilets or faucets. Irrigation systems or garden hoses can be sources of leaks outside your home. They are similar in cost to traditional gas water heaters but are 30% more efficient, according to the U.S. Department of Energy. High-efficiency Toilets. Older, inefficient toilets use as much as 6 gallons per flush (gpf) and are considered a major source of wasted water in many homes. All new toilets since 1992 must be 1.6 gpf or lower. High-efficiency toilets are 1.28 gpf or lower and those with the EPA’s WaterSense label have also been performance-tested and are worth considering if you replace your toilet. More information about the EPA’s WaterSense program is available online epa.gov/watersense. Faucets. The latest water faucet technologies for your kitchen or bathroom are designed to shut off the water automatically immediately after use. Turning off the tap while brushing your teeth can save as much as 3,000 gallons of water per year. If replacing your fixture isn’t an option, consider installing an aerator to reduce water use. An aerator is an inexpensive faucet accessory that can be easily retrofitted to a conventional faucet. Shower Heads. Showering accounts for nearly 17 percent of residential indoor water use. A common misconception about low-flow shower heads is that the water will come out as a steady trickle. In fact, modern low-flow shower heads deliver consistent water pressure allowing a person to wash and rinse without any issues while also conserving water.
