HUNTING LEASE EVICTION

Q: I SHARE A HUNTING LEASE WITH FOUR GUYS. I HAVE A BIG PROBLEM WITH ONE OF THE GUYS; HEALWAYS BRINGS ADDITIONAL GUYS TO THE LEASE WITHOUT PERMISSION, AND HAS EVEN LET FRIENDS THAT I DON’T KNOW HUNT WITHOUT OUT ANYONE ON THE LEASE PRESENT WHICH IS AGAINST OUR RULES. I REALLY WANT HIM OUT, AND MY BROTHER-IN-LAW IN, CAN I REPLACE HIM? HE IS NOT A “LESSEE” ON THE HUNTING LEASE. I AM THE ONLY ONE NAMED ON THE LEASE. A: First of all, you need to include all parties that share the lease on the lease agreement, both for liability issues and issues wherein the lease is breached. For example, if one of those “guests” of your buddy who shares in the lease but is not listed on the lease gets hurt, it’s your tail on the line for damages. With regard to replacing one of the persons sharing the lease, since you referenced a lease that does not include his name, I assume the lease agreement is a written document naming you as the lessee. Since the lease has been reduced to writing, under Louisiana law, oral or other evidence is not usually allowed to disprove a written document. The duck lease

agreement is a contract and will be interpreted by a Louisiana court within the “four corners of the document”, i.e. if the language in the lease agreement is clear (e.g. Landlord and Lessee’s names on the lease) then a court is unlikely to allow other evidence to disprove the lease. Your buddies who share the lease do not have rights under the lease if they are not named; therefore, you do not have to follow any requirements regarding termination of the lease agreement between the parties that may be stated in the lease. You should consider a few things before getting rid of him though because he may have other remedies under the law, i.e. unjust enrichment, if he made improvements to the land with the expectation of hunting, or made payments, etc. I recommend the four of you meet, and re-work the lease agreement to include all four lessees and emphasize the actions that are a violation of the lease agreement. Perhaps if his name is on the lease, he will be more diligent in abiding it. You may consider hiring an attorney to review the lease agreement, or prepare a new lease agreement. Good luck!

Q: FIRST TIME HOMEBUYER HERE. I KNOW THE SIZE OF THE MORTGAGE I CAN HANDLE, BUT AM WORRIED THAT MY LENDER WON’T AGREE. HOW DOES A LENDER DETERMINE HOW MUCH MORTGAGE I CAN AFFORD? A: Lenders examine a few areas in determining the size of mortgage you can handle. Usually, they look at your monthly income, your non-housing expenses (credit card debt, car note, etc), and cash available for a down payment. The most common method lenders use to interpret these variables to estimate your mortgage capacity is the Percentage Method. As a general rule, you shouldn’t spend more than 28% of your income on housing costs. This includes your mortgage, your homeowners’ insurance and your real estate taxes. And, your housing costs plus your long-term debts (car loans, child support payments, minimum credit card payments, student loans, etc.) shouldn’t exceed 36%

of your income. Some lenders have more relaxed ratios, but as a general rule, most lenders apply the above ratios. Lenders may also use the Multiplier Method formula as a general rule of thumb to determine how much mortgage you can afford. Typically, most lenders allow a family to carry a mortgage that is two to three times its gross annual income (income before taxes and expenses are taken out). For example, if your gross average income is $75,000, most lenders would allow you to carry a mortgage of between $150,000 and $225,000. There are several useful sites on the internet that will help you determine what you can afford. But remember, each person’s situation is different. Just because the ratios used by a lender suggest you can afford a $200,000 mortgage, doesn’t necessarily mean you will want to contribute that much of your monthly income towards a mortgage payment. You should do your research, and make sure you are not getting in over your head.
