Five Burning Questions About Fireplace Safety Fireplaces provide a generous amount of warmth and add a special ambiance to your home. Before you relax and enjoy your fireplace during the fall and winter months, here are key answers to common questions about how to safely enjoy this unique home feature. How do I know if my fireplace needs repairs? Before the first spark is ignited in your fireplace this winter, make sure your chimney is structurally sound. If bricks or joints are chipped or if your chimney is titling, it may be time for some repairs. Visible cracks and holes are other signs that your chimney needs attention. What is a chimney cap and do I need one? A gaping hole on the top of your roof can invite trouble. Tree branches, leaves, twigs, birds nest and critters of all types can enter your home or create a blockage. Luckily, there is a simple solution to keep pests and unwanted materials from nestling in your chimney: a chimney cap. This device is strongly recommended because it partially closes the opening of your chimney to prevent harmful debris buildup. Does my fireplace need to be cleaned? Yes, a chimney sweeper can ensure your fireplace is in the ideal condition to be used and thoroughly inspect your unit for any tarlike build-up known as creosote. A build-up of

creosote can catch fire that can spread to the attic and other parts of your home. You may want to ask the chimney sweep for additional advice on cleaning and maintenance for future use. Can I keep my holiday décor on or near my fireplace? Experts recommend keeping furniture at least 36 inches away from the fireplace to avoid a spark igniting object in your home. If you have stocking or other holiday decorations hanging from your mantle, it’s best to remove them when your fireplace is in use as a precaution. How and when do I clean my fireplace after I use it? Once the fire has flamed out, only remove the ashes up to three days after use. Fireplace coals are extremely hot and still have the potential to start a fire. Live coals can remain in the ashes so avoid using a vacuum during clean up. Once you’ve swept up the ashes, store them in a metal container away from wood floors or combustible materials.

Q: MY WIFE AND I SIGNED A PURCHASE AGREEMENT ON OUR FIRST HOME. WE ARE SO EXCITED, AS WE HAVE BEEN ON THE MARKET FOR A NEW HOME FOR OVER A YEAR! HOWEVER, A FEW DAYS AGO WE RECEIVED THE INSPECTION REPORT AND MUCH TO OUR DISMAY THERE ARE OVER $3,500.00 IN NECESSARY REPAIRS. WE HAVE ALLOCATED A REPAIR ALLOWANCE OF $1,000.00. WE ARE RECONSIDERING THE PURCHASE OF THE HOUSE; CAN WE GET OUT OF THE PURCHASE AGREEMENT?

A: You are certainly not the first couple nor will you be the last that is faced with a disappointing inspection report! Take a deep breath, and let’s consider your options. Whether or not you can “get out” of your purchase agreement, depends on the language in the agreement. The typical purchase agreement used by local Realtors contains a provision which addresses the Buyer’s right to contract for inspection of the property; and the legal effects of the inspection. For example, a common provision used in purchase agreements provides, with respect to inspections, that the Buyer acknowledges that the sale price of the property was negotiated based upon the property’s apparent current condition; and the seller is not obligated to make repairs to the property unless otherwise stated in the agreement. The Buyer shall have an inspection and due diligence period of a certain number of days, commencing on the date of acceptance of the purchase agreement, wherein the Buyer may, at his expense, have any inspection made. In the event the Buyer is not satisfied with the condition of the property or the results of his due diligence investigation, the Buyer may terminate the Agreement or may indicate the problems and desire remedies and the Seller has 72 hours to respond as to the Seller’s willingness to repair. If the Seller refuses to remedy any or all of the deficiencies, then the Buyer has 72 hours to either accept the Seller’s response or terminate the

Purchase Agreement. So you see, you have some options before deciding to terminate the agreement. You mentioned that you allocated a repair allowance of $1,000.00. Is that an amount negotiated with the Seller or just an amount you and your wife set aside for repairs? What type of repairs are we talking about? Assuming the repair allowance is something negotiated with the Seller, then you should probably try and re-negotiate that amount. If it was just an amount set aside by you and your wife, then you should negotiate with the Seller regarding repairs he may be willing to make in response to the inspection report. Before you throw in the towel, be sure and review your purchase agreement carefully to determine your rights and duties for inspection and due diligence, paying close attention to the time period you have within which to notify the Seller of issues with the house. If your purchase agreement contains a provision like the inspection provision referenced above, and the Seller refuses to pay the threethousand dollar repair amount (or re-negotiate the repair amount), you are probably within your rights to have the purchase agreement declared null and void and your deposit returned in full. Obviously, if your purchase agreement contains a different inspection provision, your rights will depend on the terms of that provision.

HOLIDAYS & FAMILY Q: NOT A LEGAL QUESTION, YET, BUT IF I CAN’T GET THROUGH THE HOLIDAYS WITH MY IN-LAWS, I MIGHT BE WRITING FOR DIVORCE ADVICE! ANY TIPS?

A: The holidays are supposed to be a time of peace, joy and good will to all, right? Unfortunately, real life isn’t the Hallmark Channel and the holidays are often fraught with stress over family drama and dysfunction. You can try and prepare yourself for survival so that your marriage stays in tact over the next month! Here are some tips: Don’t expect a miraculous change in people just because it’s the holidays. Don’t expect people to be any different than who they are, whether it’s the judgmental mother in law or the drunk uncle. Going into the holiday expecting people will be different this time around is setting yourself up for disappointment. Rather, have realistic expectations and prepare yourself. Have a positive attitude and put the “fun” in dysfunctional. If there is a lot of unstructured time,

trouble can brew. Try having “jobs” for your family members, or fun games to play. Encourage positive talk like favorite holiday memories or stating what everyone is grateful for this year. Boundaries. Some people have them, and some people just don’t. Try not to personalize hurtful behavior, remember hurt people hurt people. Don’t take the bait and rise above by reminding yourself that you do love some of these people and more often than not their bad behavior has nothing to do with you. If you can’t resist, then take a break. Excuse yourself for some fresh air or hide out in the bathroom for a bit. Try to find the joyful moments and hold on to those and remember you can only control what you can control. Good luck and Happy Thanksgiving!
