Q: WHAT DO YOU THINK ABOUT FIX THE LAFAYETTE PARISH CONSOLIDATED GOVERNMENT CHARTER ON THE DECEMBER 8TH BALLOT? A: First of all, it’s important to understand what the amendment to the home rule charter will and won’t do. The amendment will create separate city and parish councils. At present, the Council consists of members who don’t live in the City and who have substantial constituencies outside of the City. If the amendment passes, the City will have its autonomy restored, and the Parish will be represented by its own independent Parish Council. The Parish Council will focus on Parish issues. The amended will clarify what is needed to change LUS. Under the proposed amendments, the Lafayette City Council will be the governing authority of LUS. This amendment is appropriate because under the current City-Parish Council, representatives who do not live in the City have the ability to decide LUS rates. Also, any proposal related to the management of a substantial part of LUS would have to be approved by a vote of the people in the City at an election called by the City Council. Right now, as we are all aware, the City-Parish Council has the authority to decide on issues related to the management of LUS without a vote of the people.

The proposed amendment will not make any changes to LUS. It will only clarify who governs LUS under a split council and require a separate city-wide vote to make any ownership or management changes. The proposed amendment will not reset term limits. This was a concern raised when the proposal was initially considered by the City-Parish Council. These concerns were acknowledged and the proposal was amended so that the current Council members’ terms will remain in effect. The proposed amendments will not raise taxes. There is zero effect on taxed with these charter amendments. But consider this, under the current system, Council members who live outside of the City have a vote on how to spend City tax dollars, and they can vote to call for a new tax election. If you believe that an elected official should not decide how to spend your tax dollars unless they pay the same taxes as you, then you should consider voting in favor of the charter amendments. Creating a City Council and Parish Council lets you hold your elected officials responsible for the tax-related decision they make in a way that you cannot do now. I whole heartedly endorse and ask everyone to vote for fixing the charter. Spread the word— tell your family and friends! Go Vote!

Q: I REMARRIED LATER IN LIFE AND HIS KIDS HAVE BEEN LESS THAN WELCOMING. I AM CONCERNED ABOUT WHAT HAPPENS TO ME IF MY HUSBAND PREDECEASES ME AND THERE IS NO WILL. CAN HIS CHILDREN FORCE ME OUT THE HOME I SHARE WITH THEIR FATHER UPON HIS DEATH? A: It depends. Louisiana is a community property state, which means everything obtained and earned during the marriage is community and each spouse owns ½ of the property. Exceptions to the general rule are if you and your husband entered into a separate property agreement. If the house was purchased during the marriage with community funds, it is community property, and you are entitled to ½ of the house. To protect and provide security to surviving spouse, Louisiana law provides a “usufruct of the surviving spouse” in which you have the right to use your spouses’ ½ of the community

property until your death or remarriage. The children of your spouse will likely be the naked owners of the property. As the naked owners, they do have rights in the property, but kicking you out is not one of them. Of course, if the house is not community and your husband dies without a will then issues arise. The children will inherit the separate property. Usufruct of a surviving spouse does not apply to separate property, and they can evict you in this scenario. You should discuss your concerns with your spouse and he should strongly consider preparing a will. With the preparation of a will, you and your husband can each designate exactly how the separate and community property should be dispersed upon your death. I would also recommend working on the relationship between your husband and his children. Families are complicated, but life is so short! Good Luck!
