GOOD DEAL OR GOOD SCAM

Q: I FOUND A REALLY GOOD DEAL ON A FISHING BOAT AND TRAILER. THE OWNER CANNOT FIND THE TITLE TO EITHER. CAN I LEGALLY BUY A BOAT AND TRAILER WITHOUT TITLE AND REGISTRATION? A: Maybe the reason the boat and trailer are such a good deal is the lack of title and registration. First of all, without title and registration, you have no way of knowing whether the boat and trailer are stolen or the subject of a lien. In Louisiana, all boats with motors, including electric trolling motors, operating on state waters must be registered and numbered. Without the certificate of registration, the boat cannot be transferred to your name. Registration certificate, like a vehicle registration certificate, is to remain on the boat at all times.

Fortunately, you have options if the seller isn’t trying to run a scam. There are a number of documents available on the state Wildlife and Fisheries website with instructions on how to obtain a duplicate registration certificate and an Affidavit for Transfer of Decedent’s Boat. You should request the seller obtain duplicate registration certificate for the boat, and execute the Affidavit. If the sale is not a scam, your seller should have no problem obtaining the appropriate documents. If the seller refuses, you should not go through with the sale. By Louisiana law, a trailer is required to be titled and registered with the Department of Motor Vehicles, and your seller should be able to request a duplicate copy through the DMV which can be requested on the website.

Q: I AM A RECENT RETIREE WITH NO DEBT, AND MY INCOME CONSISTS OF RENT FROM TWO COMMERCIAL RENTAL PROPERTIES, ONE RESIDENTIAL RENTAL AND MY SOCIAL SECURITY. I HAVE RECENTLY BEEN APPROACHED BY MY TENANTS WHO ARE INTERESTED IN PURCHASING THE COMMERCIAL PROPERTY, BUT I AM NOT SURE I WANT TO LOSE THE MONTHLY INCOME. WHAT CAN YOU ADVISE ABOUT OWNERFINANCING? A: Owner financing is a loan provided by you (the seller/owner) of a property or business to the buyer. Usually, the buyer will make a down payment to the seller, and then make installment payments over a specified time, at an agreedupon interest rate until the loan is repaid. For you, as the seller, this in an investment in which the return is guaranteed. And for the buyer, is can be beneficial because they may not be able to obtain a loan from the bank. Generally, the security for the loan is the property being sold. In the event that the buyer defaults on the loan, the property is repossessed or foreclosed on. There are definitely benefits of owner-financing versus and outright sale of the property. You will spread out your tax burden. If you are making a profit, selling by taking payments can allow you WWW.THEADVERTISER.COM

to spread out the pain of the sale from a federal income tax perspective over the years. You can charge interest, which lets you make money in addition to your initial sales profit. Of course, there are disadvantages in ownerfinancing as well. You don’t get your money up front, so if you owed money on your property you can’t pay off the mortgage. However, you indicated that you are debt-free, so I assume the property is free and clear of a mortgage. It is always a good idea to get a sizeable down payment on the property. The buyer should be able to put down 30% or more to minimize your risk, and you have the money for the costs of foreclosure or repossession. Another disadvantage is you are creating a long term relationship with the buyer, which may not be a concern for you since you have a previous landlord-tenant relationship. And finally, there is a risk the buyer will stop paying and default which will require you to go through a costly foreclosure procedure and repossess the property. You have history with the proposed buyer, and owner-financing could be a sound business decision for someone in your position. You should consult an attorney to draft the appropriate paperwork and protect your interests. Good luck and enjoy your retirement!
