Get Your Home Winter Ready By Doug Trahan, President Acadian Home Builders Association No matter what the weatherman says, you never know for sure what winter in Louisiana will be like. Some years we only get a few weeks of cold temperatures, and others bring sleet and freezing rain. No matter what, you want your home to be prepared for whatever Mother Nature brings. Winterizing your home is one of the most important duties of homeownership. Neglecting to do so can not only lead to more costly utilities and potentially significant repair bills, it can make your home less comfortable for you and your family. Here are some tips from the Federal Emergency Management Agency (FEMA) to help extend the life of your home and keep your family cozy during the cold winter months. • Insulate walls and attics, caulk and weather-strip doors. If it’s time to replace your windows, install double-glazed, energy efficient ones. • Clear debris from gutters so that they don’t fill with water that could freeze, adding weight that could damage the fascia board and cause leaks. • Trim tree branches that could potentially fall on all your home during a storm. Hiring a professional is strongly advised, especially if anyy branches are near power lines. • Have your heating equipmenntt and chimney professionallyy cleaned and inspected everyy year. • Insulate pipes with foam wrap or newspaper to help prevent freezing. Be sure you and

any other adults in the home know how to shut off the main water valve in case your pipes do freeze and burst. During the winter, it’s not uncommon for some people to rely on additional or alternate heating sources. With some devices – especially those not intended to be used inside the home – there is an increased risk of fire, electric shock or carbon monoxide poisoning if the necessary safety precautions are not taken. General guidelines include: • Keep fire extinguishers throughout the home, and teach all family members how to use them. • Never use a generator, grill, camp stove or other gasoline, propane, natural gas or charcoal-burning device anywhere inside your home, including the garage. • Space heaters should only be placed on a level surface and away from heavy foot traffic when in use, especially if pets or small children are nearby. It’s best to have space heaters that automatically turn off when a room reaches the desired temperature or in the event it is tipped over. GENERAL COUNSEL SHOULD I RENT OR OWN? Q: MY WIFE AND I ARE BOTH 29 YEARS OLD, AND WE HAVE LIVED IN APARTMENTS SINCE WE EACH STARTED COLLEGE. WE BOTH HAVE GOOD PAYING JOBS, AND WE ARE STARTING TO THINK ABOUT PURCHASING A HOME. I HAVE ALWAYS HEARD THAT OWNING IS A BETTER FINANCIAL MOVE THAN RENTING. IS THAT TRUE? ARE THERE ANY REASONS WHY WE SHOULD STICK TO RENTING? A: The answer to this question really depends on your current rental payments and the size and location of the home you and your wife are considering. Most people have heard at one time or another that home ownership makes more sense than renting, because you can take a tax deduction for your mortgage interest payments while simultaneously building equity in your home. Although this is certainly true, your analysis should not stop there. Rather, you should also consider the additional costs of home ownership. For example, assume that you and your wife are presently paying $8 a month in rent. If you kept renting for five more years at the same rate, you would pay a total of $48, . Of course, when you moved out, you would not have anything to show for those payments.

However, if you bought a house with a $12 , mortgage at an interest rate of 7%, your monthly payment for principal and interest would be approximately $798, or just about the same as your $8 rental payments. Furthermore, after five years in your new home, you would have accumulated only $7, 43 in equity, and you almost assuredly would have spent more than that for property taxes and homeowners insurance. Of course, this is just an example. Depending on the cost of your new home and the size of the mortgage you would need to obtain, you might find that purchasing provides a greater financial upside than the scenario given above. Therefore, you would be wise to retain the services of a real estate professional to help you maximize options within your price range, and to also retain an accountant or other financial adviser to instruct you on the tax ramifications of a potential home purchase. An additional factor to consider is the fluctuation in housing prices in the area where you are looking to buy. Buying a house in a declining real estate market leaves you susceptible to heavy losses should you need to relocate and sell your home in the near future. Conversely, buying a home in a market where prices are rising steadily puts you in position for a handsome gain on a sale should you need to relocate within a short period of time. Your local real estate agent should be able to answer your question about the Astate of the market@ in your area.

Although there are many great apartments out there, some people gain a strong emotional and mental satisfaction from having a place they can call their own. If you are one of those people, and the price is right, home ownership may be for you.

CAN WE GET OUR OF OUR LEASE EARLY? Q: MY HUSBAND AND I RECENTLY RENTED A CONDO AND SIGNED A SIX-MONTH LEASE. WE HAD A GENTLEMAN’S AGREEMENT WITH THE REAL-ESTATE AGENT WHO WAS ACTING AS RENTAL AGENT THAT WE COULD LEAVE BEFORE THE SIX-MONTH TIME PERIOD WAS UP WITH NO PENALTIES. SHE KNEW THAT THERE WAS A POSSIBILITY MY HUSBAND MIGHT GET TRANSFERRED TO HOUSTON AND WE THAT MIGHT WANT TO LEAVE AFTER THREE MONTHS. JUST AS WE SUSPECTED, MY HUSBAND HAS BEEN TRANSFERRED. THE AGENT IS NOW TELLING US THE CONDOMINIUM ASSOCIATION HAS A MINIMUM SIX-MONTH RENTAL RULE AND THE OWNER WON’T ACCEPT THE GENTLEMAN’S AGREEMENT. DO WE HAVE TO PAY THE FULL SIX MONTHS OR CAN WE WALK AWAY CLEAR AFTER THREE MONTHS? A: Unfortunately, it sounds like you are stuck with the terms of the lease. If you and the owner had signed an amendment to the lease allowing you and your husband an early out, you would be ok. Otherwise, a real estate agent doesn’t have any authority to make exceptions because she does not own the condo. Depending on your particular situation, you might have a case against the real-estate agent for misrepresentation. However, if it boils down to your word against hers, with no proof to back you up, it probably would not be worth the money to pursue it. Even if you and your husband do move out before the six-month term is up, the owner of the condo has a duty to try to rent the condo to another tenant. Even if he is able to rent the condo to another tenant, you could still be charged with the costs he incurs in finding the new tenant. You will also be liable for the rent until the unit is occupied again. Before renting a condo or town home, you should always ask to see a copy of the homeowners association rules. There may be specific provisions that govern the length of rental agreements and outline a tenant’s obligations. If you do this, you’ll know up front what to expect once you move in.
