Make Resolutions that Will Last Beyond the New Year By Doug Trahan, President Acadian Home Builders Association Every New Year, do you make the same old resolutions? Go to the gym. Quit smoking. Be more organized. Then, like many people, do you abandon these goals within a month or two? Here are some resolutions you can make — and keep — that will benefit not only you, but also your family, your community and your world. Improve Your Home’s Safety There are lots of little things you can do around the house to give yourself big peace of mind that your family is protected from all-too-common household accidents. For example, to avoid electrical shocks, place covers over all outlets and tie up or unplug cords so they don’t dangle temptingly in front of toddlers or pets. Home electrical problems account for 67,8 fires during a typical year, according to the U.S. Fire Administration. Inspect appliance cords and immediately replace any that are worn, old or damaged. Keep clothes, curtains and other potentially combustible items at least three feet from all heaters. Make sure electrical appliances are used and stored away from wet floors and counters. Your home’s windows need to be accessible in case your family has to use them as an escape route. Make sure they are not nailed or painted shut, and if they have guards, security bars, grilles or grates, test the release mechanism make sure it works. On the other hand, windows can pose a falling hazard. Make sure screens are secure, and keep furniture — or w anything children can climb — away from window ledges. Save Money by Going Green Prices for fuel oil, propane anndd electricity are always on the rise, so s even the smallest improvements couldd help your family’s budget. Replacingg incandescent light bulbs with compactt fluorescents can save you up to threequarters of the electricity previously used by incandescent bulbs.
Make sure you change your furnace filter regularly. A dirty filter will make the furnace work harder to regulate the temperature and will cost you money. Put an insulating blanket on your water heater. The U.S. Department of Energy says that adding insulation to your heater can reduce standby heat losses by 25%-45%, and save 4%-9% in water heating costs. The blankets cost anywhere from $15 to $5 and are easy to install. Invest in a programmable thermostat and set it to lower the heat automatically when your home is empty during the workday, and at night when everyone is asleep. Programmable thermostats can save about $18 per year in energy costs, according to Energy Star, a joint program of the U.S. Environmental Protection Agency and the U.S. Department of Energy. Conserve water, and reduce your water bill, by making simple changes such as running dishwashers and clothes washers only when they are full and taking short showers instead of baths and turning off the water when you are shampooing or soaping. De-Clutter and Help Others Donating your unused items to charity could be a lifesaver for homeless or needy families. If it’s in good condition, your out-of-style or outgrown clothing could keep a family warm during the cold weather months. Many local charities also accept donations of household items that are in working order. That lamp, toaster or set of dishes gathering dust in the garage could help furnish a home for a needy family. When you redecorate or remodel, don’t put out-of-style-but-usable home furnishings such as light f fixtures, bathroom vanities, and even doorknobs in the garbage. Habitat for Humanity ReStores and other organizations will pick up and re-sell them at a fraction of the cost of new, and the proceeds help build Habitat homes.

GENERAL COUNSEL DRAINAGE ISSUES UNDER LOUISIANA LAW Q: MY HOUSE IS SITUATED UPHILL FROM MY NEIGHBOR’S, SUCH THAT WATER HAS ALWAYS NATURALLY RUN DOWNHILL ACROSS MY PROPERTY AND INTO MY NEIGHBOR’S YARD. HOWEVER, MY NEIGHBOR RECENTLY CONSTRUCTED AN EMBANKMENT OR LEVEE, WHICH HAS CAUSED WATER TO BACK UP INTO MY YARD. IS HE ALLOWED TO DO THIS? A: No, your neighbor is not allowed to do this under Louisiana law. Our Civil Code directly addresses this situation, and when referring to drainage issues such as these, characterizes your property, which is located “uphill”, as being in a category known as a “dominant estate”. Your neighbor’s property, located “downhill” from yours, falls into a category known as a “servient estate”.

The owner of the servient estate is obligated to allow water which naturally flows from the dominant estate to run onto his property, and may not do anything to prevent or alter this natural flow. Therefore, your neighbor’s construction of a levee, which disrupts the natural flow of water onto his property, and causes an accumulation of water on your property, is not allowed under Louisiana law. It is important to note that the provisions cited above also prohibit the owner of the dominant estate from doing anything which would make the flow of water more burdensome to the servient estate owner. Therefore, if you have done anything to increase or change the natural flow of water onto your neighbor’s land, your actions would also be prohibited under Louisiana law. I suggest that you speak to your neighbor and politely request that he remove his levee, because it has caused water to accumulate on your property. If he is willing to remove the levee and allow the natural flow of water to resume, it appears that your problem is solved, assuming that no permanent damage has been done to your property as a result of the levee. If your neighbor is unwilling to cooperate with your request, you should explain to him that you believe what he has done is improper under Louisiana law. If he still refuses to cooperate, you may need to obtain the services of an attorney to assist you. However, if it is possible to resolve this situation amicably, I urge you to do so, since life will be much more pleasant for you and your neighbor if you can avoid a nasty conflict or legal battle. Please keep in mind that your neighbor may not realize that his construction project has cause a problem for you, or that what he has done is against the law. I hope that once he is made aware of these facts, he will agree to resolve the problem amicably.
BASIC OPERATION OF ESCROW ACCOUNTS Q: I AM PREPARING TO BUY A HOME AND UNDERSTAND THAT CERTAIN COSTS, SUCH AS INSURANCE AND PROPERTY TAXES, WILL BE HANDLED THROUGH AN ESCROW ACCOUNT. CAN YOU BRIEFLY EXPLAIN HOW THIS WILL WORK? A: It is very common for lenders to require homeowners to contribute funds for certain expenses, such as homeowner’s insurance and property taxes, into an escrow account. Typically, the yearly amount of the given expense is divided by twelve, such that the monthly portion of the total annual expense is paid by the buyer in addition to his or her monthly mortgage payment. For example, if the annual homeowner’s insurance premium is $12 . , the homeowner will typically contribute $1 . per month into escrow, by making this $1 . payment each month along with his or her ordinary mortgage payment. When the yearly insurance premium comes due, it will be paid out of the escrow account. The system described above has benefits for both lenders and homeowners. For lenders, it insures that necessary expenses associated with property for which they have loaned money will be paid, thus helping to protect their interest in that property. For homeowners, the escrow system typically simplifies the payment of expenses associated with ownership of a home, by establishing a system where the homeowner is essentially required to budget throughout the year for the payment of these expenses. Finally, it is important to remember that though the escrow system is typically efficient and accurate, it is not always possible to calculate precisely what a given expense will be for the year, such that the homeowner may have to come up with extra funds to cover an expense which is greater than what was anticipated when the escrow payments were established.
