Make a Big Impact: Holiday Shop at Small Businesses By William LeBlanc, President, Acadian Home Builders Association
The holiday season conjures up images of Black Friday shopping or purchasing gifts online. But shoppers this year who want to purchase gifts while supporting the local community are encouraged to support local businesses during Shop Small Saturday on Nov. 30. Small and locally-owned businesses across the country are participating in Shop Small Saturday, typically held the weekend after Thanksgiving, to support their communities. Patronizing a homegrown shop, book store or other retailer makes a sizable contribution locally. According to a 2018 Small Business Economic Impact Study, for every dollar spent at a small business in the United States, approximately 67 cents stays in the local community. According to the Small Businesses Administration, in 2018 (the latest figures available), small businesses nationwide created 1.9 million net new jobs. Overall, there are more than 30 million small business in the United States, which employ nearly half (47 percent) of the country’s private workforce. There is no question that small businesses help communities thrive across the country. If you’ve passed by a local shop several times but never had an opportunity to visit, Shop Small Saturday is the best time to check it out. Small businesses in our area often carry locally made, one-of-a-kind gifts or items you may not be able to find anywhere else. If you work up an appetite shopping all day Saturday, restaurants or coffee shops benefit the local economy as well. Our community’s local home builders and remodelers are also small businesses who make an important contribution to our local economy. BOUNDARY DISPUTES ARE SOMETIMES TRICKY SITUATIONS Q: I RECENTLY HAD MY LAND SURVEYED AND MY NEIGHBOR REFUSES TO CONCEDE THAT THE PROPERTY LINE IS WHERE THE SURVEYOR SAYS IT IS. WHAT DO I DO? A: First you should review the legal description contained in your sale and any other surveys to confirm the boundary is where the most recent survey sets the boundaries. You could ask the surveyor to place stakes on the corners of your property to clearly outline the boundaries. And, since your neighbor’s cash sale is part of the public record, you should get a copy of it and give it to your surveyor. The surveyor can then make sure that the boundary described in the neighbor’s cash sale matches the boundary described in your cash sale. If the descriptions match, your neighbor’s argument against your claim to the boundary is most likely a losing one. However, if, you and your neighbor had an understanding as to the location of the boundary between your properties, and this understanding existed between the prior property owners, you might be in trouble. There is a concept in real estate law called adverse possession that gives land that has over time, been openly used by another the rights to that property. You might want to visit the tax assessor’s office to look at the map of the tax parcels in your area. If the tax parcel matches your property’s legal description, you can claim that you have been paying taxes on the land in question, further weakening your neighbor’s claim of adverse possession. All of these issues taken together will give you a better picture of where the property lines are and whether the neighbor has any claim to the ten feet. Good luck.

A: Since you and your ex-boyfriend bought the land together, you are co-owners in indivision under the law. As a co-owner, you cannot sell the property without his permission. That said, unless you and your ex can both agree to sell the property, you will have to hire a lawyer to file a lawsuit against you. And since it is essentially impossible to divide a house in a fair manner, the court will order that the property be sold and the proceeds split between the two of you. As a co-owner, he has the same rights as you do when it comes to occupying and entering the property. If you mutually agree to sell the property, the title company will likely deliver the funds to you and your ex-boyfriend in the amounts you both specify. You cannot unilaterally decide how much to deduct from his share of the proceeds. Remember, each of you owns a portion of the land, and his signature will be needed when the property is sold. Basically, this means that the two of you will need to agree how much of the sales price belongs to you and how much belongs to him. You will need to factor in all the payments you’ve made over the years as well as the estimated value of his clearing and maintaining the property, and then arrive at a percentage or dollar amount of the net proceeds that belongs to each of you. As an alternative, you might consider offering to buy him out. Assuming the two of you can agree on a fair price for h half and that you have good enough credit to obtain a loan in your name alone, you can work a deal where he conveys his half of the property to you for a specified price.
