Tips to Stay on Budget When Building a New Home By Doug Trahan, President, Acadian Home Builders Association

When you’ve made the decision to build a new home, selecting the right builder is an important part of the process. You want to find a builder who business approach aligns well with your personal preferences. And staying within your budget will be a key part of positive home-building experience.

Being an educated consumer, and asking your home builder the right questions, will help you build the home of your dreams without blowing your budget. Kimberly Mackey, founder of New Homes Solutions Consulting in Tampa, Fla., shares some issues to discuss with your builder to help you stay on budget. Included features and custom options – It’s important to set your expectations in the beginning. A builder’s model home is often designed to highlight how a buyer can personalize the home, but most of the time, what you see in the model is either upgraded or perhaps even a designer option that may or may not be available. It’s important to know the difference between what features are included and what items have been upgraded to avoid being surprised when you go to contract or even during the building process. Also, if you like a custom upgrade but not its higher cost, there is often a less expensive way to achieve the same look. For example, the custom cabinets shown in a model home may be offered in the same color and size with a lower-priced option. And if designer knobs or pulls are added, you can achieve a very similar look for far less. The same is true of granite counters and flooring. It pays to ask the builder’s representative or design center consultant how to achieve the look you want and stay within your budget. Closing cost contributions or incentives – In many areas throughout the United States, a builder’s contract will stipulate that they do not pay any closing costs. That means they also don’t pay the traditional closing costs that are typically paid by the sellers when

purchasing a used or resale home. However, builders will often offer some sort of closing incentive that can be applied toward closing costs or options. The incentive may be tied to the use of preferred lender or title company. Buyers should carefully run the numbers with their real estate professional or lender to see if those incentives make sense for their particular situation. Some buyers may find it better to use an outside lender because of rates and fees.

Other buyers may do better asking to have the builder’s incentive applied toward options they will need to move into the home and have it become immediately livable, like a adding a refrigerator, blinds, or a washer and dryer, which are often not included in new homes. The key is to understand what incentives are available and apply those to your particular situation in the way that best benefits you.

Warranty and regular maintenance – Most consumers understand that when you purchase a new car that is covered by a warranty, the buyer is still responsible for some maintenance and other costs. The same is true when you buy a newly built home. Before you go to settlement on the purchase of your new home, you and your builder will do a walk-through to conduct a final inspection. This walk-through provides an opportunity to spot items which may need to be corrected or adjusted, learn about the way your new home works and ask questions about anything you don’t understand. Often, a builder will use the walk-through to educate buyers about the operation of the home’s components; the buyer’s responsibilities for maintenance and upkeep; and the warranty coverage and procedures. Be sure to read and understand the warranty documents. It is important that you learn about the way your new home works and ask questions about anything you don’t understand.

Our condo association board is in a quandary because we suspect that an owner is conducting some kind of business out of his unit. There’s a lot of coming and going during the day and night. We don’t want to be sued by the owner for making defamatory statements; however, we also don’t want to ignore the safety and well-being of other residents. What should we do?

A: First, you need to answer for yourself

whether an owner can run a business from his condo. Most condominiums have written rules regarding whether or not an owner can operate a business from his unit. Most probably prohibit it, but there are certainly some that allow it, if it is not burdensome or disturbing to other owners. There are some condos whose rules and regulations are silent on the issue. You should carefully read your condo association’s by-laws and perhaps the condominium declaration to determine where you stand. Then, if you’re still bothered by this situation, you should politely ask the owner whether they are operating a business out of his unit. This is a step that gets missed a lot of times. As long as you frame the conversation as a question, you shouldn’t have to worry about a defamation suit.

However, if you accuse the owner of running a business and insinuate that it’s an illegal one, then you could very well be on shaky ground. If after asking the owner, you have reason to suspect that illegal activity is taking place; my advice would be to contact the police and get them involved. They are in a better place than you to gather information and get to the bottom of things.

BE SURE TO CHECK BUILDER’S REFERENCES BEFORE BUYING A NEW CONSTRUCTION HOME

Q:

A little over a year ago, I bought a house from a builder I had never heard of. I was hesitant, but decided to go forward with the purchase. Four months after I closed on the house, I noticed several problems. I called the builder, and a few weeks later, he came out and told me he could fix everything. We wrote out a list of what needed to be fixed, and we both kept a copy of it. About two weeks later, the builder came back and made some of the repairs, but not all of them. Weeks went by, and I didn’t hear anything else from him. He would not return my phone calls, and would not respond to my certified letters either. In fact, the only response I got from him was a one page letter detailing the work he had done. Of course, his letter came just days after the year warranty had expired. The builder obviously did his best to dodge me. Do I have any recourse now that a year has passed since I bought the home?

Unfortunately you should have trusted your instincts and not purchased from a builder you didn’t know anything about. It is always a good idea to ask any builder you are considering working with to provide you with some references. You should look at some of the other homes he has built, and talk to the owners to see what type of problems they have had. You could have also hired and inspector to review the construction of the home during the building process. Fortunately, Louisiana’s New Home Warranty act does not require that the builder complete the repairs within the first year after closing. It simply requires that the purchaser put the builder on notice of the defect, within one year after knowledge of the defect. It sounds like you did that. The list that you made that the seller signed may be sufficient notice to keep you within the warranty period for those items. And, your certified letters should do the trick also. But, keep in mind, the clock is ticking. Depending on what kind of problems you have, you may be subject to a one, two or five year preemptive period. And, you only have thirty days after the one, two or five year period expires to file suit against the builder. If the remaining repairs are substantial, you should consult with an experienced real estate and construction attorney immediately. You should also obtain estimates from other contractors to fix the items that your builder failed to fix. Once you know what it will cost you to make the repairs, you can decide what makes more sense: suing the builder or fixing your house and moving on with your life.
