LEASE PERUSAL CHECKLIST

The following points constitute a checklist which is not intended to be an exhaustive list as each case will depend on its own particular circumstances. However, the following points will in most cases be relevant and should be checked. 1.

Location main road or other location; traffic flow; nearness to shops, factories, transport; passing trade, local population (expanding/contracting); parking restrictions in nearby streets; availability of parking areas or other public parking facilities; presence of similar competing businesses (advantage/disadvantage).

Business premises size and layout; physical condition and state of repair; adequate display, storage and working areas; possibility of expansion; parking for management and employees; parking for delivery and despatch of goods; heating, cooling, lighting, air conditioning; electricity (including industrial power if required), gas, telephone, water, sewerage toilet and washing facilities; use of nearby premises which might interfere with the conduct of the type of business, eg. through pollution, smoke, noise, smell, vibration, etc; whether the activities in the proposed business emit or produce smoke, noise, smell, vibration, etc. and whether the proposed premises are suitable, having regard to the required precautions and the nature of adjoining or nearby premises.

Zoning, local government and environmental regulations, shops and factory controls

Apart from obtaining planning consent to the use of the premises, the following is relevant: if any building alterations are necessary, what is required, its cost, the conditions of approval; do the premises comply with the fire, health and safety regulations; the impact on the proposed use of the premises of regulations dealing with pollution, emission of smoke, noise, vibration, and costs of compliance; factory or shop registration, including whether the requirements as to facilities and amenities are or can be satisfied, having regard to the nature of the business and the number of employees. 4.

Future changes

potential or proposed changes in zoning, traffic routes or transport services; whether any major developments are imminent in the locality, eg. new department stores, shopping centres, residential development including further lessees within the same development.
