BUYING YOUR DREAM HOME
Once you are sure to have found the right property, it is important to act fast and to put all the right actions in motion, in order to secure your new home , especially in the current market..
When you are ready to make an offer on your desired property, which is often presented in the form of a Letter of Intent, you should send it in writing to your agent, stating your general terms and conditions.
PROPERTY OWNERSHIP STRUCTURE
There are different ownership structures and the process towards final acquisition will follow a different path according to each type of structure.
The most common options are:
• Buying the property in the name of the prospective buyer(s).
• Buying the property in the name of a company, national or international.
Each option will lead to a different route in terms of securing the ownership of your chosen property.
PROPERTY ACQUISITION AND TAXES
There are some costs related to buying property in Portugal that you need to budget for. Generally, these acquisition costs can be offset against future capital gains tax liabilities, providing they are properly documented, so it is fundamental to keep and file records carefully. When you buy a property in your own name, Notarial and Registration fees are fixed fees (approximately 2,000), whereas Purchase Transfer Tax (IMT) and Stamp Duty are based on the price of the property.
Stamp Duty is charged at a fixed rate of 0,8%, whereas Purchase Transfer Tax for properties (villas, plots, etc.) varies according to a sliding scale, between 1% and 8%. In the Quinta do Lago market, the norm is usually 6%, due to the prices of the properties. These taxes are payable once and upon purchase.
Remember that you will need to consider the Legal Fees of your lawyer. Though these can differ from lawyer to lawyer, they usually represent around 1% to 2% of the transaction value. Aside from the Transfer Tax, there
is an Annual Property Tax (IMI), payable annually in either 2 or 3 instalments. For some properties above a certain value, there can be an additional property annual tax called AIMI. Both taxes are calculated upon the Property Rateable Value (VPT – Valor Patrimonial Tributário) of the real estate property and its rate is determined by the local Municipality each year. The applicable rate ranges between 0,3% and 0,8%. The Municipality of Loulé (which rules Quinta do Lago and other resorts nearby) has historically been on the lower end of the spectrum, at 0.3% in recent years.

CORPORATE OWNERSHIP
In general, a Share Purchase Agreement is drafted, agreed and signed by the lawyers. It sets out all the terms and conditions for the transaction to occur, including deposits, deadlines and penalties. A Due Diligence is usually carried out by the Buyers’ Lawyer on all the documentation linked to the deal, prior to the signature of the Share Purchase Agreement.
A date for Completion of the Transaction is agreed and a final document is signed, accomplishing the final transaction. Your lawyer will be able to provide you with all the necessary support to better understand each Ownership structure, and will have specific and detailed information about each scenario.
INDIVIDUAL OWNERSHIP
After the offer is accepted and agreed, both parties (buyer and vendor) instruct their lawyers to start working on the legal and administrative procedures leading to the transfer of property. To secure a property, it is common that a “Promissory Contract of Purchase and Sale” (CPCV) is drafted and agreed between lawyers. Generally, some of the points contained in this document have already been previously agreed by both parties during the negotiation process.
In general, this CPCV contract should address subjects such as:
1. Purchase price and payment terms (a deposit between 10% and 25% is considered common).
2. Timeline for the transaction to be complete (usually 30 to 90 days).
3. Specific conditions, for example, a contract may be subject to the buyer obtaining the necessary financing for the transaction, satisfactory due diligence on the paperwork, satisfactory Structural Survey report, among other.
4. Consequences for potential breach of contract. General consequences can be agreed on, but generally include, if caused by the buyer, the right for the vendor to retain the initial deposit; or, if caused by the vendor, the obligation to return the double the value of the initial deposit to the buyer.
This promissory contract usually already outlines the main clauses for the final deed, which becomes the legal title of transfer of the property and needs to be signed at an official Notary’s Office.
GOLDEN RESIDENCE PERMIT (GOLDEN VISA)
For investors from outside the European Union, securing a property in Portugal may represent an invaluable advantage for your business, yourself and your family —a residence permit in Portugal will allow
you free access and right of travel within the EU and Schengen space. An advantage for foreign investors, the Golden Visa can also be granted to your family members, under the right to family reunification.

Please note that since 2022 only Wyndham Grand Algarve and RESERVA apartments (developments with touristic license) allow for Golden Visa applications within the resort.
The Golden Visa program works under the following conditions:
• z Estate acquisition of at least €500,000. Please note as of 2022, only developments with a touristic licence are eligible for golden visa applications within the resort. This is the case with Wyndham Grand Algarve and RESERVA;
• Co-ownership of the real estate, with each co-owner investing at least €500,000;
• It is possible to apply for the Golden Visa having only signed a Promissory Contract of purchase, providing that a deposit of a minimum of €500,000 is performed. Nonetheless, at renewal stage (i.e. after 1 year), the purchase of the property must have been completed with a Final Deed;
• It is possible to have a bank loan for acquiring the property under the Golden Visa regime, providing it is a mortgage on an excess value of the required minimum €500,000;
• Renting or letting the property for commercial, agricultural and tourism purposes is also allowed.
• It is also possible to purchase real estate for services, such as shops or offices, or through the acquisition of participation units in investments funds or venture capital, with a minimum investment of at least €500,000.
NON-HABITUAL RESIDENTS
The Non-Habitual Resident status is aimed at retirees, High Net Worth individuals, and High Added Value Professionals looking to optimize their taxes in a global context. In order to benefit from the NHR status, the applicant must fulfil the preconditions to be deemed a tax resident in Portugal. Conditions include an obligation to be physically present in the country for more than 183 days in any given period of 12 months, and to have a home available in Portugal in such conditions that it may be assumed as the applicant’s a primary residency.
Under this regime, pensions may be subject to a 10% reduced tax rate and professionals performing High Added Value activities may be exempt on foreign sourced salaries or subject to a 20% reduced flat tax rate on Portuguese sourced salaries.
