ith all this snow, area residents might as well get out and find ways to enjoy it. The annual Gun Lake Winterfest offers plenty of options for family fun Feb. 14, 15 and 16. The iconic Polar Dip is a Winterfest favorite that organizers say some people even put on their “bucket lists” to do at least once in their lifetimes. It’s never too early to start thinking of summer and warmer waters, so the annual swimsuit fashion show adds a summer twist to Winterfest events. Back by popular demand this year is the Battle of the Beards contest, the 1980s dance party, comedy show and music trivia contest. There will be plenty of games for kids of all ages and even a .05K beer run to officially open the beer tent Saturday. Restaurants and businesses in the area will offer many specials all weekend. The annual Gun Lake Winterfest will take place next weekend (Feb. 14, 15, and 16) at various locations around the lake with the center of activities, many ar repeats from last year, many are new events including a Vintage Snowmobile Show, ice skating and a bonfire. Dozens of activities will make for a fun weekend and one thing is for sure, there will be no lack of cold or snow for this year’s winterfest. The YMCA of Barry County will hold their annual Ice Tee Golf Scramble next Saturday (Feb. 15) as a part of the Gun Lake Winterfest on the ice in front of Bay Pointe on Gun Lake. Entry is $50 per team, deadline is Feb. 14, check-in is 9 a.m., tee time is 10 a.m. You may register at 269-945-4574 or www.ymcaofbc.org. This is a fundraiser to support scholarships for YMCA Summer Camp. 4. The Village Players of Middleville will perform their Dinner Theatre Production of “The Murder Mystery at the Murder Mystery” (their 20th program) at the MiddleVilla the next two weekends. The doors open at 6 p.m., dinner at 7 p.m. followed by the play on Friday (Feb. 14 and 21) and on Saturday (Feb. 5 and 22). Funds raised are used to support two scholarships yearly at TK High School and many other community groups. Tickets are $30 each and can be reserved at 269-795-3640. 5. The Hastings Cinema 4 Theatre in downtown Hastings is again sponsoring another Academy Award Contest during which you get to pick out and predict the correct winners in each category. The first place winner gets 26 VIP passes, 2nd place gets 12 passes usable for any movie presentation at the theater (3-D movies have a $2.20 surcharge). The Pierce Cedar Creek Institute will sponsor a “Great Backyard Bird Count Hike” next Saturday from 9 until 11:30 a.m. Attendees will learn how to participate in the count and then will time out on the trails identifying birds. The Hastings Public Library Toddler Story Time (Tuesday 10:30 a.m.) and Pre-School Story Time (Friday 10:30 a.m.) will use songs, music, stories, dance and crafts to study “Cows” this week. The Movie memories features this Thursday evening (4:308 p.m.) is “Captain Courageous.” These programs, as are all library programs, are open and free to all. 8. The Hastings Elks Lodge on Woodlawn Avenue will sponsor a Valentine’s Ball next Saturday evening (Saturday, Feb. 15) to raise funds to help sponsor the Manna’s Market Building Restoration Fundraiesr. Music by “Yon Bucher” and “Party in a Box.” Light refreshments and a cash bar. Suggested donation is $25 per couple, the festivities begin at 7 p.m. 9. The 2014 schedule of Legislative Breakfasts is to be replaced this year by a Quarterly Legislative Brunch that will run from noon until 1 p.m. on Friday, Feb. 14, June 13, Sept. 12, and Dec. 12. The first brunch is this Friday at the Walldorff Brewpub and Bistro, 3rd floor. The couple may be younger with the main motivation for seeing an attorney being to "take care of the kids." Commonly, a married couple's estate plan follows more or less the same route: when the first spouse dies, all assets go to the surviving spouse. When the second spouse dies, assets are passed to some combination of beneficiaries, oftentimes children. This type of planning may fit the needs of the couple for years, even decades. If one spouse has health issues, however, an old estate plan can cause more harm than good. I often see couples where one spouse has been diagnosed with debilitating diseases (i.e. dementia, Parkinsonâ&#x20AC;&#x2122;s or Alzheimerâ&#x20AC;&#x2122;s). The diagnosis of one of these types of illnesses can turn the goals of old estate plan upside down. After a diagnosis, we often see the "healthy spouse" become the main caregiver, housekeeper, and bookkeeper of the couple. If the "healthy spouse" unexpectedly passes away first, is it still a good idea to leave all assets to the surviving "ill spouse?" Will the surviving spouse be able to live at home without the assistance of the now deceased spouse, or will long term care in a facility most likely be needed? Can the surviving spouse manage assets, or is an agent needed to protect and preserve assets? For these couples and their families, good "community spouse planning" is a must. The old estate plan that left all assets to the surviving spouse needs to be updated. Here is an example: a husband and wife come into my office following a dementia diagnosis for the husband. At this time, the husband can live at home with the aid and assistance of his wife. He needs supervision, help with bathing, eating and medications, and cannot manage the checkbook. The husband and wife have a living revocable trust that leaves all assets to the surviving spouse. www.longstreetelderlaw.com

On the second spouse's death, all assets go to their three children. The estate plan no longer reflects the needs of this couple. If the wife unexpectedly dies, the husband obtains ownership and control over all assets. This may be a very bad result. Because of the husband's health, he probably cannot manage the assets safely. Moreover, without the care of the wife, the husband will most likely need long term care in a facility. Owning all of the assets will not be advantageous to the husband. A good community spouse plan envisions protecting the coupleâ&#x20AC;&#x2122;s assets at the time of the death of the healthy spouse. This can mean creating a special testamentary trust that would allow a child or other trustee to protect and manage the assets for the surviving ill spouse. It could also mean bypassing the ill spouse completely, leaving all assets to the children, presuming the children will use whatever assets are necessary for the surviving ill spouse's care and comfort. Many couples have an estate plan. However, a diagnosis of a debilitating illness for one spouse should trigger a review of the old estate plan. More often than not, the estate plan will need to be amended to reflect the new realities of the couple's situation, as well as their hopes and desires for the use of the estate.
