Wills Estate planning seeks to answer the question—“what happens to my property when I die?” Wills and trusts are often used to help answer this question. A will directs how a person's property is to be distributed after death. A trust is a form of property ownership that provides for the management, maintenance and preservation of property by a “trustee.” In some cases revocable trusts are used as a will substitute, providing for the transfer/disposition of one’s assets.
What is a Will? A will is a legal instrument by which the person making (executing) the will (called the "testator") directs how and to whom his/her property is to pass upon death. A will is said to be “ambulatory.” That is, it only takes effect upon the death of the testator. Consequently, the testator can change or revoke his/her will any time prior to death. • While laws may differ from state to state, there are four requirements that are generally recognized as essential to a valid will. • The testator must have had testamentary intent when the will was executed (signed); • The testator must have had the requisite testamentary capacity when the will was executed (signed); • The execution (signing) of the will must have been free of fraud, duress, undue influence and mistake; • The will must have been executed (signed) in conformity with state law requirements—this is often referred to as “due execution.”
How is a Will Made? A will is a legal instrument and therefore usually prepared by an attorney. The attorney will meet with the client, discuss the client’s intentions, answer the client's questions, and then prepare a will that reflects the client's wishes. The will is then reviewed with the client to make sure it reflects the client's wishes. Once finalized, the will is then "executed" by the client. This means that the client signs the will in accordance with all legal requirements— the most common of which is signing the will in front of two or more witnesses.

Ron Michael Meneo A lawyer for over 20 years, Ron has represented clients in many different and diverse areas including will contests, estate matters, securities law, employment issues, business disputes and transactions, probate matters, and tax disputes. A tireless advocate, Ron prides himself on his diligence, thoroughness and practical approach to resolving disputes. He recently represented nine heirs who successfully challenged the will of an infirm, elderly relative. Although the contest was contentious and involved not only other relatives who defended the will, but also their attorney who prepared the elderly relative’s will, the matter was successfully resolved through mediation within nine months. Ron also serves on a national team of lawyers charged with the responsibility of representing plaintiffs nationwide who allege injury as a result of ingesting certain pharmaceutical products containing a common ingredient. This multi-district federal litigation (MDL) involves over 1,000 plaintiffs and no fewer than five major pharmaceutical companies. Ron is a graduate of Fairfield University (BA), Western New England School of Law (JD cum laude) and Boston University School of Law (LLM). He is licensed to practice in the states of Connecticut, Massachusetts and New York and authorized to practice before the U.S. Court of Claims and the U.S. Tax Court. For over 20 years, he was an adjunct professor in business law and taxation at Southern Connecticut State University and a member of a municipal Board of Assessment Appeals. He also serves as a member of the Legal Committee for USA Triathlon, the national governing body for the sports of triathlon, duathlon and other multisports.
