Conveyancing Update The Conveyancing (sale of land) Regulation 2010 commenced on 1 September 2010. Key points to note for agents, vendors and purchasers: Swimming pools warning – as a result of numerous backyard drownings in recent years, all contracts must now contain a swimming pool warning (even properties without a backyard pool, vacant land, multi story commercial etc). Strata encumbrances - the regulation now makes it clear that contracts relating to the sale of a strata or community title must attach documents creating or purporting to create easements and other like encumbrances over not only the strata lot being sold but also the strata common property or community title association property. Coastal Protection – from 1 January 2011 the regulation was amended to include a prescribed warranty that the land is not subject to an annual charge for the provision of coastal protection services. In addition to the above, a parliamentary enquiry reviewed the role of “quality reports” in conveyancing with the recommendations released in December 2010 as follows: 1.
Before offering residential property for sale by auction a Vendor must attach to the Contract for Sale: • a pest inspection report; and • a building inspection report. 2. The mandatory pest and building inspection reports must be prepared: • by a person having adequate professional indemnity insurance; • following a prescribed report model based on Australian standards; • by a person not related to the Vendor, the Vendor’s real estate agent or the Vendor’s solicitor. 3. All such reports to be supplied with the Contract (and not older than 90 days) 4. That the Purchaser: • reimburse the Vendor for the cost of reports on settlement; • will be entitled to rely on the reports, and have the same rights of recourse against the report writer as if the purchaser had commissioned them.
