the question: I know two sisters who each have unlimited power of attorney on their Mom, who has Alzheimer's, and is in an assisted living facility. Her home is presently unoccupied and paid for. She will never live in the home again due to her mental state. Her husband is deceased. One of the sisters thinks it should be sold to build up Mom's nest egg. The other one doesn't think it is wise to sell now. There are no other siblings. Both sisters are married. Do they (the sisters) both have to agree to sell the home, since they have equal power of attorneys on their Mom? Or, can one sister sell the home unilaterally and leave the sister who does not want to sell Mom's home out of the loop legally?

the answer: It depends on what the Power of Attorney actually says about this issue. Whether one designated Power of Attorney can act independently of the other . Even if that is the case, one Power of Attorney ignoring the wishes of the other could lead to the other Power of Attorney suing or otherwise trying to halt the actions of the Power of Attorney desiring to sell the property. Best if they all get in agreement.
