the answer: In that you are not married you can choose between Tenants in Common and Joint Tenants with Right of Survivorship. Tenants in Common is where the two of you have an equal and undivided ownership interest in the property. If one of you should pass away the deceased party’s interest in the property would pass through their estate to their heirs. Joint Tenants with Right of Survivorship is where the two of you have an equal and undivided ownership interest in the property, but if one of you should pass away the survivor of the two then becomes the immediate owner of the entire property. This process is instant and passes outside the estate process and requires no further action by the surviving party.
