the question: We are selling our late father’s house. He passed and left his house to his three children in the will. The Realtor is telling me that each of our spouses will have to sign the listing agreement, contract and the deed. Why, since our spouses were not left the property?
the answer: The Realtor is correct. Even though your spouses were not specifically devised the property in your dad’s will, they are married to you and thus have certain rights under North Carolina Law. When your dad passed and left the property to his children, the will served as an instrument to vest title in the three of you. Under Real Property Law in North Carolina a spouse has an interest in the property of the other spouses by statute. So those statutory rights are the reason the spouses will be required to join in the process. Consult a Real Estate Attorney to help you determine what course you need to take.
