INDIANS BUYING IN USA • Buyers from India purchased US properties estimated at USD 5.8 billion in total value, which is approximately 6 per cent of total international sales. • Los Angeles, Las Vegas, Chicago, Dallas, and New York are the five markets of greatest interest to potential Indian buyers • The dollar volume of residential purchases by residents and non-residents is estimated at USD 92 billion for the 12 months ended March 2014, a 35 per cent growth from the previous year • Indians mostly purchased single family detached homes, but about six per cent bought for commercial/rental use • 30+ incoming and outgoing referrals to USA, UK and Dubai offices • $ 7 million deal closure through referrals
BUYING REAL ESTATE PROCESS FOR NRI’s • NRI’s have no restrictions on buying any number of commercial and residential properties • A simple PIO certification that gives proof of their Indian Origin allows NRIs to invest in India real estate • Indian Banks generally facilitate property loans covering up to 70% of the transaction price subject to credit evaluation • If you decide to let out your property on rent you will be required to pay tax on the rental income according to the income tax provision of Resident Indians

Section 54 - This section stipulates that if NRI sells a residential property after three years from the date of purchase and reinvest the proceeds into another residential property within two years from the date of sale, the profit generated is exempt to the extent of the cost of new property
•Permission is available to NRIs and PIOs to repatriate the sale proceeds of property inherited from an Indian resident, subject to certain conditions
•If the NRI sells the property before three years have elapsed since the date of purchase, the NRI will be subject to a short term capital gains tax of 30 percent which will be deducted as TDS
•Amount per financial year (April-March) should not exceed USD 1 million, and should be done through authorized dealers (Banks)

OWNERSHIP PROCESS FOR FOREIGN NATIONAL • A foreign national resident outside India cannot buy immovable property in India • However, foreign nationals who are resident in India can purchase immovable property in India without any special approval from the RBI • A foreign national would must be residing in India for more than 182 days during the preceding financial year • A continued presence of foreign national in India in the current financial year must be for the purpose of taking up employment, carrying on business or vocation in India
