hen buying or a selling a home, the MLS listing is typically one of the first, and often most impactful, opportunities to showcase property. Whether viewed by the REALTOR or prospective homebuyer during a property search, the listing discloses a variety of essential informa-

tion from location to square footage to price, all factors that can attract and deter a prospect. Aside from the essential criteria, the MLS listing can be a driving factor in whether a home buyer is interested in a property. This has led many agents to get creative with their listings, specifically regarding the descriptions and photography, to enhance a property’s charm and appeal. Additionally, many real estate companies and REALTORS alike create professional websites to market their services, areas of expertise and accolades. Like the MLS listings, these websites utilize content and imagery to better portray their brand and offerings to potential clients. While often unintentional, many MLS listings and professional websites are in violation of copyright infringement laws because of the photographs used. According to the U.S. Copyright office, “copyright is a form of protection grounded in the U.S. Constitution and granted by law for original works of authorship fixed in a tangible medium of expression ... including literary, dramatic, musical, and artistic works.” Penalties for copyright violations can be steep. “Even if the copyright owner cannot show they have been damaged, the federal law pro-

vides a penalty range from $200 to $150,000 for each work infringed, plus court costs and attorney’s fees,” says Joe Babb, General Counsel for the Austin Board of REALTORS and their MLS, ACTRIS. “Under some circumstances, though typically unusual in the real estate community, the infringer can even go to jail.”

Copyright Challenges But what mistakes are the real estate community making when choosing and using photographs online? As described earlier, the issues typically arise within an MLS listing and professional website. MLS Listing Liabilities There are a few ways to produce photographs for a listing, such as through an MLS employee, REALTOR, homeowner, or third-party photography. Often, to ensure a high-quality product, a third-party photographer is hired; however, even in lieu of a contract, copyright laws may still be broken. “The rights some REALTORS obtain from photographers are often insufficient for them to comply with their MLS rules,” Babb says. According to the MLS rules, to be compli-

ant, the REALTOR must “warrant,” or promise, to the MLS that they own or have obtained all rights to the images and content within the listing. Additionally, they must grant the MLS the right to use the listing content “for any purpose consistent with the facilitation of the sale, lease and valuation of real property.” “Where REALTORS slip up is in the license from the photographer,” Babb says. “Often, it is only valid through the marketing period of the property, which means they are in violation of the MLS rules and their warranty to the MLS because the listing content must also be available after the sale, for use in the valuation of other properties.” When valuing comparable properties, REALTORS utilize data, including photographs, from previously sold properties. Because of this, the MLS repository serves as an important valuation tool. “Even if the license is no longer valid based on the contractual agreement from the photographer, the MLS doesn’t know and is relying on the warranty from the REALTOR that their rights are sufficient to comply with the

The importance of CodeNEXT CodeNEXT, the rewrite of Austin’s Land Development Code (LDC) is a hot topic in Austin. That’s because it has the potential to change what can and can’t be built on a given property, affecting your business and clients. Most projections show the Austin region continuing its historic pattern of strong growth and CodeNEXT presents a critical opportunity to be proactive in managing the effects of that growth. ABoR is reviewing the current proposal with an eye toward whether it lives up to this opportunity and delivers a transparent, simplified code that property

owners can understand. For the first time in 30 years, this is our opportunity to put Austin on the right track to managing growth responsibly. exus. It’s a word we’ve all heard before, but do we really know what it means? Merriam-Webster defines nexus as (1) a connection or link (2) a connected group or series and (3) center or focus. For the past seven years, the WCREALTORS board of directors has been working on making the Williamson County Association of REALTORS the nexus of education and the voice of real estate for Williamson County; it is so important to the board of directors that it is the first task in our strategic plan. “WCREALTORS will be the nexus of real estate education and be the ‘Voice of Real Estate.'” As many of you know, the Association has joined forces with the Four Rivers Association of REALTORS and the Temple-Belton Board of REALTORS® in the first true Regional MLS in Central Texas. Since the inception of this partnership in August of 2016, the MLS has grown leaps and bounds! In July we will begin to see the addition of the entire Fort Hood MLS system into the CTXMLS. Shortly after Fort Hood comes on

board, we will see the addition of the entire Victoria Area MLS system! Once the data from the newest shareholders have been loaded into Matrix, the member count will be over 4,000 members and will service over 15 counties. In addition, CTXMLS is one of the first MLSs to work with CoreLogic to utilize Trestle, a groundbreaking IDX management tool! Once this service launches in August, it will allow subscribers to request a feed through an approved IDX vendor and a brokerage can request a direct feed as desired. Over the past couple of weeks, I’ve received a lot of questions about CTXMLS but the most interesting question centers around a large misconception that the other Associations are still running their old MLSs. The Four Rivers MLS and Temple-Belton MLS completely went away and ALL their historical data has been converted into CTXMLS. When the Fort Hood Area Association of REALTORS® joins this summer, the same will happen with them! We truly have 4+ MLSs in just one system. From the first day we went live, we encour-

That’s a wrap: HBA 2017 Parade of Homes™ goes out with a bang

he Home Builders Association (HBA) of Greater Austin just wrapped up its 2017 Parade of Homes™ in The Peninsula at Rough Hollow in Lakeway. This year’s Parade was absolutely spectacular with each home boasting panoramic views of Lake Travis and the surrounding Hill Country. Open from May 12th through the 29th, thousands of visitors poured in to take a look at five multi-million dollar homes fully furnished and on display. Whose photo is it anyway? Copyright laws and your business

aybe some of you have experienced a story like this: A few years ago a REALTOR sold a house in just a few days. Two days after closing, the buyer’s REALTOR called to say the buyer was very upset to see that the home they just bought still had pictures on the internet. Of course, they demanded the listing REALTOR take the pictures down immediately. They didn’t want others to know what their house looked like. They felt it was an invasion of their privacy. The listing REALTOR explained they had already taken their posts down but in the world of Internet, once other websites pick up your listing they think they own the photos. This has been a problem for us. All our seller clients want us to syndicate their properties to get the utmost visibility. Unfortunately, there is always a different side to every action. This story has probably happened to all of us in some form or fashion. So here is the real question, who owns the photos and how do they hold the reins on how they are published? In November, Chloe Hecht, NAR Associate Counsel, gave us some

insights on this issue. “It is crucial to know what rights you own in photographs and how those rights permit you to use the photographs. Talk real estate policy to your U.S. Senator and Representative

was part of the 150-plus member advocates of the Asian Real Estate Association of America who went to Washington, D.C. for the 2017 AREAA Policy Summit last month. There were three policy points that we delivered that can boost homeownership for the Asian American and Pacific Islanders (AAPI) community. 1) Removal of the 1 percent rule for deferred student loans. The 1 percent rule is taking 1 percent of a student loan and factoring it in as monthly payment in the debt-to-income ratio calculation. With a significant percentage of AAPIs pursuing undergraduate and higher education, and incurring student loans, eliminating the 1 percent rule for those whose loans have been deferred would allow them to start early in their wealth building without forgiving the loan. 2) Adopting alternative credit scoring as a predictor of one’s ability to repay a loan. First generation immigrants, specially AAPIs, are culturally debt-averse so traditional FICO scores are an inaccurate or incomplete measure. Delinquency in periodic payment items such as rent, utilities, medical payments and insurance typically negatively affects the credit score. Should not the same

items, when paid regularly and on time, be considered to reflect positive ability to repay a loan? 3) Language access reform supports the effort to increase language access in real estate transaction documents. First generation immigrants, including AAPIs, who don’t speak English sign on the dotted line without understanding document specifics. FNMA and FRMC has a proposed redesigned URLA (1003) that includes the addition of a preferred language data field. In reality, these policies will benefit all immigrant and non-immigrant communities, not just the AAPI. So we all need to pull together on this. What do you need to do, you may ask? For No. 1 and No. 3, have your U.S. Senator and Congressman tell HUD, FRMC, FNMA and the FHA about these! For No. 2, tell your U.S. Congressman to support bringing these two bills on to the floor - HR 123 was introduced by Rep. Possibly pulled through a web search or from another webpage, it’s illegal under copyright laws to use third-party photographs without the appropriate permissions. In recent years, many businesses across a variety of industries have been receiving demand letters from photo licensing businesses and photographers, such as iStock or Getty Images, requesting that their images be removed, and in some cases request compensation, due to copyright violations. The companies who created the photographs own them, and even though they can be obtained online, they cannot be used without payment and agreement. Additionally, it’s important to recognize that the website owner is always liable for the violation, regardless if a third-party web developer assisted in the creation and production of the website.

How to avoid Copyright complications There are three ways to ensure copyright compliance to protect your business. 1. Understand the MLS Requirements If you are using a third-party or outsourced photographer for MLS listings, it’s imperative to review the contracts to ensure they meet the requirements of the copyright law and MLS rules. “I advise that REALTORS should obtain the full rights and ownership over the photographs, or at least an exclusive license that

covers all MLS purposes, not just the marketing period, in a written agreement with the photographer,” Babb says. 2. Audit the website Review the website in question and identify all images. If you cannot confirm where the photographs came from and that you have the appropriate permissions to use them, you should remove them from the website, either until you obtain documentation or replace them with compliant images. To ensure you are using approved, legal images, take pictures you used or hire a photographer (with a contract) to take the photos for you. If you use a third-party website, pay the licensing fee to use the photo legally. 3. Limit Liability with the DMCA To help protect a business or individual from lawsuits related copyright infringement, the Digital Millennium Copyright Act (DMCA) provides "safe harbor" provisions against the accidental or inadvertent publishing of copyrighted materials online. “Any display of a copyrighted photo, without obtaining the proper rights from the photographer, is a copyright violation, but we believe the DMCA gives you an ‘out’ to avoid the penalties if you comply with its provisions and take down infringing photos upon request,” says Babb. Ultimately, using or publishing photographs online, either on a website or MLS listing, should be closely monitored by REALTORS. Whether you, a vendor or colleague was responsible for the actual upload of a copyrighted image, any and all parties can be liable. Before your next posting, make sure you’re in compliance with copyright regulations and ensure all previous materials aren’t in violation to avoid future demand letters, fines and even jail time. RL

Real Estate News & Notes Supreme Lending opens new office Supreme Lending is excited to announce the opening of its new office space, now located at 3520 Executive Center Drive, Suite 200, Austin, Texas 78731. Earlier this year, the McClellan Region Headquarters of Supreme Lending Austin moved into its new 11,600-square-foot office space, conveniently located on the Southbound access road of Mopac and Spicewood Springs. To show its commitment to furthering its commitment to education, Santa Rita Ranch donated $20,000 to the Georgetown and Liberty Hill independent school districts as part of its annual Santa Rita Ranch Days celebration. The development donated $10,000 to each school district last year as well for a total of $40,000 to date through its education fund. Santa Rita Ranch developers and builders have pledged $1,000 for each home sold in Santa Rita Ranch toward the community’s education fund. By the time the ranch is completed, this fund will have contributed a total of $6 million to Georgetown and Liberty Hill ISDs. Developer Ed Horne said providing residents access to a quality education is tantamount and one of the pillars of Santa Rita Ranch. “Learn from the land is Ranch Code No. 1 here in Santa Rita Ranch, and we want to give children growing up here every chance we can to learn,” he said. “We also want to go above and

beyond what our taxes provide and hope our donations give the school districts the opportunity to further their educational approaches and offerings.” Mariner Real Estate is developing the 3,100acre master-planned community, located north of Austin in Liberty Hill, with a distinctive Hill Country style. Horne said residents are drawn to the community for its location, family-oriented vibe and the variety of available homes.
