Last year our October issue was devoted to accolades for heroic Houstonians and tips about recovery from Hurricane Harvey. During that time Texas experienced 27 trillion gallons of rain and Houston alone had more than 50 inches - so much so that the National Weather Service had to update the colors on its weather chart to properly account for it. By some accounts, the weight of the water temporarily sank our city by almost an inch. Even though 13 million people throughout Texas were affected by the hurricane, the commercial real estate market barely registered a downward blip on the screen and the market has continued to be strong throughout this past year.
This month we focused on hot spots in Texas which include Waller County & the San Antonio region. Waller County is touting itself as the new West Houston and based on all the new development in the area, I’m betting it’s true. In San Antonio, DHRP’s Mike Hoover and John Cannon as well as Brent Koontz with Koontz Development, are very busy with developments along the I35/Loop 1604 & I35/New Braunfels corridors. Last month on September 11th & 12th, REDNews joined forces with Real Estate Summits to host the inaugural Women in Real Estate Summits in Houston and Dallas. Both events were tremendously well received by the primarily female attendees. HOT SPOT: Waller County Houston’s New West Side

Driving on I-10 about 35 miles west of Downtown Houston, it’s a blink-andyou-might-miss-it moment. A larger-than-life Igloo Cooler sits in the distance, marking the entrance to the company’s massive plant. It’s a very visual cue that you’ve reached West Ten Business Park.
“It was one of the first premier business parks in that area,” says Brett Walker, executive vice president of Parkside Capital, which developed the project. Looking at it now, most developers wouldn’t bat an eye at picking up 500 acres with frontage along I-10, U.S. 90 and Katy’s Cane Island Parkway. It was a different story in 2008 when Parkside bought the acreage. Brett Walker, Executive Vice President, Parkside Capital
“Some people would say we were crazy,” Walker laughs. “But in hindsight, we were ahead of the game.” West 10’s location created some initial concerns for its new owners. The entire property was located in Katy, though a portion of it was in Fort Bend County and the rest was in Waller County. That meant it would have to work with a number of different agencies, including the City of Katy, Fort Bend County and Waller County Economic Development Partnership.
“All the agencies we worked with really worked together to make this happen. The amount of cooperation has been very encouraging,” says Walker. “Waller County EDP comes to the table with the end user in mind. Their interest is in creating long-term value and generating a good employment base for the county.” Three years in, the company made its first sales to Igloo and Medline. Since then, companies such as Vahle, Oakmont Industrial Group and Pepperl+Fuchs have moved in. Parkside has sold most of the tracts in the past few years, but it still has about 12 acres left.

Stretching Development Corporation more than 515 square miles on the west side of Houston, major highways such as I-10, SH 6 U.S. 90 and U.S. 290 all run through it. As construction has wrapped up on the latter, interest in the area has increased, according to John Isom, director of the City of Waller Economic Development Corporation.
“If companies located here need to ship anything or travel anywhere, they can easily head any direction they want to,” Isom adds. Its accessibility has helped make Waller County a destination for companies and homeowners, who are each looking for space to grow away from the city’s tight quarters. In 2000, the county boasted a population of just more than 32,000. That number has since topped 40,000 and is expected to grow exponentially in the years go come.
DA IK IN “I think we’re going to continue to see that kind of residential growth because of the jobs coming here,” says Isom. A prime example of that is the $417 million manufacturing hub that Daikin Industries opened in 2017. The 4.1 million square foot facility for the Japanese heating and cooling maker, is built on a 491-acre parcel located on U.S. 290, just east of Waller. The company started with 1,000 employees, but expects to have about 7,000 by 2020. Keith Edwards, Senior Vice President, Caldwell Companies
“It’s a driver for residential development,” says Keith Edwards, senior vice president of brokerage services for Caldwell Companies, which represented the seller in the Daikin deal. “I think the 290 corridor is going to be totally developed within the next decade.” The firm is backing that up, having just recently closed on 58 acres along the freeway for commercial development. Other companies that have built their North American headquarters in Waller County include Burckhardt Compression, Goya Foods and MAN Energy Solutions, formerly MAN Diesel & Turbo, which located at the new The Uplands Business Park at Twinwood, a new 600-acre industrial development located just south of I-10.
“... a new phase of growth …” That’s why developers, such as Wolff Companies, have taken notice. Now in its fifth decade, the company has been a leader in developing master-planned, mixed-use business communities in the Houston area. “We have remained focused on the Houston market – and more specifically, properties along major freeways in West

Houston – since our inception,” explains Carolyn Wolff Dorros, the company’s executive vice president. “We study these corridors constantly. It is one slice of the business where we have developed expertise.” Examples of that range from Brookhollow, a 160-acre project on the then yet-to-be completed West Loop at U.S. 290, to projects such as Park 10, Ten Oaks and Central Park on I-10 and Beltway and Westway Park on the Sam Carolyn Wolff Dorros, Houston Tollway. It will use 251 acres to build a business park catering to uses ranging from light industrial and distribution to office and retail. Wolff sold the remaining 270 acres to Long Lake Ltd. to develop a master-planned residential community featuring approximately 1,000 homes.
Long Lake, which delivered nearly 1,000 homes in 2018, is one of the most active home builders in the Houston market. The company chose Beacon Hill as the site for its newest development to capitalize on its success in the Villages of Cypress Lakes. The 2,500home development located on U.S. 290 inside Grand Parkway will be sold out within the next 18 months. According to Wolff Dorros, Long Lake, which builds under a variety of brand names, will begin design work immediately and aims to deliver its first lots by January 2020 with completed homes to follow shortly thereafter. Though Wolff has only just started the process of working with Waller County EDP and the City of Waller EDC, Wolff Dorros says “we are very much looking forward to the relationship. Every one of the individuals with whom we’ve worked to date has been extraordinarily helpful in this process.”

Development “I think you’ll find Waller County as insightful and active as any in the country to add the right jobs and add the right development. “ Nickles’ company has helped add more than 260 jobs in Waller County since it built a heavy industrial park. In addition to the 200 provided by anchor Alegacy Equipment, Cordyne Electrical Manufacturing & Distribution and Grizzly Services have contributed an additional 60. “These are fantastic, skilled, high-paying, full-benefit jobs in manufacturing, heavy fabrication, assembly, and the like,” boasts Nickles. “Those are jobs that weren’t here when we bought the cornfield in 2013.” Finding that cornfield was easy for him. “We live in the area, so we looked for and found the piece of property we wanted in this region,” Nickles says. The company has turned the 90-acre parcel into a home for several different crane-served buildings. Right now, about 275,000 square feet are under roof, leaving another 40 or so acres for development. “We’ve built everything here to be extra heavy duty. As the anchor tenant, Alegacy Equipment requires everything we do inbound and outbound is from that oversize and overweight load perspective. So, very heavy, extra-large everything,” explains Nickles. “We built this entire development for like-kind businesses.”

That means infrastructure like extra-wide roads with extra-concrete thicknesses and extra crane tonnage. “With the combination of U.S. 290 being finally almost finished and SH 99 going in, it puts us in a perfect position to recruit and have employees from all around town, virtually, all around the Houston metro,” Nickles adds. “That really provides the ability for this area to build out into the next major corridor of Houston.” Hydie McAlister, Partner, RCR Rail Co.

The thing about Waller County is freeways aren’t the only transportation option. Rail is also a major player for corporations looking to move their product, specifically the Union Pacific Class Sharon Beach, 1 railroad that runs through Partner, Hempstead. That’s what RCR Rail Co. caught the eye of RCR Rail Co., an offshoot of McAlister Assets launched by Hydie McAlister and her business partner Sharon Beach. The company purchased 120 acres north of Hempstead with plans to build a rail-served logistics park.

It doesn’t approve projects without being something that they want in their network.” The partners emphasize their park will be high-end and industrial grade, benefiting the city. That’s especially important, says McAlister, since it’s being built at the entrance of Hempstead. “The clients we’re talking to are national- and international-grade firms that want to consolidate here,” she says. “We want it to compliment Houston and Continued on Page 12 >

we want to work with Waller County EDP and the city of Hempstead to make that happen.” The project is a labor of love for McAlister, who lives just five miles from the property and watched the area lose hundreds of jobs when Lawrence Marshall closed its dealership back in 2009. “After that, the industry in the Hempstead area just went really dormant,” she says. “I personally was interested in bringing a high-end industrial park and high-employer businesses back to Hempstead.” “Failure is not an option, and in turn, we’re invested in the area as far as being in Houston for a very long time,” echoes Beach. “It’s personal to give back to the community, as well as bringing industry to the growth of Houston.” Crews are currently clearing the property, which should be finished in the next 30 days or so. Construction and installation are expected to get underway in Q1 2019 with operations starting in Q2 2019. Eventually, McAlister says, she’d even like the project to include a museum honoring Hempstead’s rail history. It’s a conversation she’s had with Vince Yokom, executive director of the Waller County EDP, with whom RCR Rail Co. worked to get its railserved industrial development started. “It’s been a great relationship,” says McAlister. 12

“... a lot of good projects …” Though they range in offerings, many of the corporations in Waller County have that in common; they all speak highly of Yokom and the EDP. “We’re attracting top-tier companies and we’re getting a lot of North American headquarters,” says Yokom. “There are a lot of good projects here. We’ve always focused our energy on projects that we feel are a good match. We don’t just jump in there with anybody.” Instead, the EDP approaches every project on a case-bycase basis. Every business, he explains, is coming to Waller County with a unique set of circumstances and it’s important for the EDP to be able to develop a similarly unique response. “We don’t say, ‘Hey, we gave so-and-so a deal. We’re going to need to do this kind of the same deal,’” says Yokom. “That will never happen.”
While the EDP’s ultimate goal is to bring in new business, it’s also trying to determine what works best in what part of the sprawling county. It’s using its available incentives to encourage more directed development.
“For example, there are a lot of distribution centers going in along I-10. When you consider the overall impact of putting another 2,000 trucks on the road in that area right now, that isn’t the best long-range plan,” Yokom says. “We might offer incentives for a distribution center that wants to go along U.S. 290 instead since we don’t have as many there.” The EDP also works to expedite the timeline for project approvals, especially for those that fall inside a city’s limit. It implements what it calls a parallel abatement process, beginning its approvals at the same time as the city does, thereby cutting the waiting period in half. Yokom also points to the organization’s fast and consistent review process for prospects. “We try to respect their timelines as best possible. Obviously, we have our own process we have to do, but we try to be as respectful as possible,” he says. “I think that comes out in a lot of the negotiations.” Already kept incredibly busy by companies interested in making Waller County home, Yokom says he’s preparing for it to get even busier in the years to come. “We’re not only Houston’s new west side, we’re Katy’s new west side, and we aren’t going to stop growing. We work directly with the City of Katy on projects in Waller County to ensure projects go smoothly in the overlapping areas,” he says.

The first annual Women in Real Estate Summit, co-sponsored by REDNews and Real Estate Summits, focused on the women who have persevered in the industry - the pioneers - as well as those who are following in their footsteps. During the fourhour presentation at the Clubs of Prestonwood in Dallas, attendees were treated to inspiring stories and advice concerning getting into, and making a success of, a career in commercial real estate.

KEY TAKEAWAYS Getting into the business. Many of the panelists came to their commercial real estate careers by accident. Some had considered journalism as a career, while others were involved with finance and administrative work (secretaries and receptionists). Many ended up in commercial real estate because of sympathetic mentors or listening and learning. The general consensus was that commission and flexibility were the most appealing about the industry. “The first year I went commission only was not easy,” commented Bradford’s Leigh Richter. “But we managed.” On the flexibility front, Kyla Sadau with Scott & Reid pointed out that “You have a lot of freedom, and different positions, across commercial real estate.”
Early attitudes. The pioneers shared stories about their experiences in the male-dominated industry. Another issue involved the fact that women were their own 14

worst enemies. “Some of the most disparaging comments I got were from other women,” said Cushman & Wakefield’s Lambert. Added Liz Trocchio Smith from Trocchio Advantage: “We are our own worst enemies. Women helping women is what the industry should be about.”
Finding mentors/coaches. The consistent message throughout the conference was the necessity of mentors and coaches. All the panelists benefitted from formal and informal mentoring from those with experience in the CRE and other industries, with AEI Consultants’ Rachel Yockey commenting: “I benefitted from a lot of mentors who didn’t know they were my mentors.” A main problem involved finding women mentors, especially in commercial real estate. Some were fortunate enough to learn from men, such as Roger Staubach. And Liz Trocchio Smith indicated that the 1980s-1990s television show “Murphy Brown”
taught her a great deal about women in business. The importance of team players. Another focus was the importance of being part of a team. Ka Cotter, with Blinksale, indicated that “team sports in high school is the best foundation you can have.” Added Diane Butler with Butler Advisors: “In athletics, especially golf, you have to have the team spirit, and the team mind, to be successful.” Along those lines, finding a supportive life partner is also important, especially when trying to raise a family.
Keep on learning. Most of the panelists hammered home the point that continual learning, both formal and informal are hugely important. Cushman & Wakefield’s Maureen Kelly Cooper stressed the importance of “learning on the job, and gaining as much understanding as you can.” On the other hand, it’s not important to know everything. learning how to say “I don’t know.” “When someone asks you something and you don’t know, the tendency is to make something up, and that can spiral south.”
Giving back. Another main point throughout the morning involved the importance of giving back, both through professional and non-profit organization. CREW Network, for example, supports many non-profit organizations, while promoting leadership skills and involvement. “Becoming involved in a non-profit organization is a humbling experience,” observed Susan Arledge with esrp. “You can become responsible for assembling volunteers for a specific purpose.” Adolfson &
Peterson’s Megan DeLeon pointed out that becoming involved is more than “signing up and showing your brand.“ It’s also offering encouragement and really pushing to be involved to accept leadership decisions.”
Another problem? Getting out of your way. “People get in their own way, and that’s not gender-specific,” said Crescent Real Estate’s Julie Young.
Learning from mistakes.
While much of the focus involved pioneers, up-and-comers weighed in as well, with some good advice to those who had been in the industry for a while. Winstead’s Lauran Hoffmann suggested not to “underestimate or undervalue social media,” while Megan DeLeon with Adolfson & Peterson pointed out that, as the mother of small children, “scheduling can be difficult in my life. We need to recognize that a typical day is not just eight or nine hours.” Commerce Bank’s
Advancement in careers depends on lessons learned, with some of the focus on confidence. Cushman & Wakefield’s Maureen Kelly Cooper observed that taking initiative is important. “I see men all the time touting how great they are, but don’t see women doing that,” she commented. “Letting people know about your accomplishments adds credibility and makes an impression.”

Alexandra Washington Lane noted that constant feedback is welcome, while also pointing out that working remotely is a positive when it comes to work-life balance.
Getting the word out. The panelists also stressed the importance of encouraging more women to enter into commercial real estate. Suggestions included beginning at the high school level, which is something that CREW is involved with. It would also help if real estate information was marketed to colleges and universities, especially to those studying math and science. Commented Kyla Sadau: “I don’t thing the fact that you wear a bra should change your options.”

• Be ready to break a rule but be ready to support why you did it; sometimes it is better to ask forgiveness than to ask permission.
• Don’t be afraid to reach out to someone who is more experienced than you if you have need of specific information or advice; the worst that can happen is that you will be turned down, but you probably will get the advice and make a new friend.

During the summer months, it can feel like parts of Central Texas may spontaneously combust under the glare of the sun. Calling it hot doesn’t do it justice. Similarly, it’s difficult to adequately describe the industrial market along the I-35 corridor.

“In 33 years with DH Realty Partners, I have never seen the market like this, not even in 2007, when the market was booming,” says CEO Michael Hoover. “The conditions of the real estate market today are spurred by the supply and demand of more space. What Amazon is doing has changed everything.”
The online giant hasn’t just impacted the way retailers operate and what they look for when it comes to brick-and-mortar locations. It’s also shifted demand to the industrial side of things as more retail transactions from Amazon and the many companies following suit to survive - call for distribution centers. “That’s what is driving these enormous warehouse developments,” Hoover says. “Amazon needs places as hubs. We’re talking about 200,000, 400,000, even up to 1 million square feet.” As a result, the team at DHRP has a hard time even keeping industrial product on hand, according to President John Cannon. He points out the lure of San Antonio, in particular, is its incredible mobility options. It’s the intersection of I-10 and I-35, providing freeway access from California to Florida up to Minnesota. As a result, the city serves as a focal point for a variety of industries because the location streamlines product distribution throughout the state and country, as well as our neighbors to the north and south.

That means prices are at a premium, evidenced by a DHRP transaction earlier this year. Daily Bread, a Christian nonprofit that helps feed San Antonians in need, reached out to DHRP to sell its headquarters, a 170,000 square foot warehouse along Rittiman Road in northeast San Antonio. The organization had purchased the property for $2.5 million back in 2012. In January DHRP listed the property for $6 million and the property sold in 2018. “We knew exactly what to do, how to price and where to market that warehouse for its highest and best use,” Hoover says.

“So San Antonio is benefiting from NAFTA and it’s benefiting from the growth of Amazon. It’s benefiting from the growth of trucking and rail,” says Hoover. “The city is a hub for distribution to all these different areas south of Dallas, through West Texas and east toward Houston.” According to a quarterly report from the Real Estate Center at Texas A&M University, the industrial vacancy rate in Q1 2018 decreased to 5.4 percent, a drop of “40 basis 20
points year- over-year,” and net absorption rose to 270,831 square feet in that time frame. More than 3 million square feet of industrial product is under construction, but until it delivers, the market is tight and competitive.
A lease-back provision gave Daily Bread 90 days to find a new headquarters, which it did with DHRP’s help. The group purchased a 55,000-square-foot warehouse on Belgium Street.
Further evidence of the Central Texas industrial market’s strength can be found within DHRP itself. Founded in 1965, the San Antonio shareholder-based company, which is the largest locally owned commercial real estate firm in the city, had seven brokers in its office as recently as 2015. That number is now up to 21 with two of the brokers operating out of the company’s new North Austin offices. Additionally, more than a third of the brokerage staff primarily deals in investment purchases and sales. It’s an opportunity, Cannon says, to take DHRP’s expertise and mirror that in a new market.

“We’ve tripled the size of our house, and obviously we couldn’t have done that if the market wasn’t strong,” Cannon says. “We’re living the dream right now. We’re privately based. We’re not connected to any of the big guys and we are poised to continue our growth in 2019 through 2020 and beyond.
“... this area is in play ...” Likewise, Bart Koontz, president and CEO of Koontz Corporation, calls the San Antonio industrial market “especially vibrant” right now. “The size of our typical user has grown as well as the size of the San Antonio market in general,” he says, adding that he expects that growth to continue. “Our market is large enough to continue to entice regional suppliers that service our MSA and users such as Amazon, Dollar General, TJ Maxx, etc., to make investments in our market to supply the area.” Koontz Corporation got its start in 1997 as Koontz McCombs, Ltd., a partnership between Bart Koontz and B.J. “Red” McCombs. The development company’s first delivered project was the 100,000-squarefoot One Twin Oaks. In the Bart Koontz years since, it’s developed more President & CEO, Koontz Corporation than 7 million square feet of commercial properties ranging from office to retail, industrial to multi-family. Having watched the Central Texas market for so many years, Koontz suggests San Antonio is likely a new focal point for developers because the Austin industrial market may be too overheated. “That is reflective in the current construction boom and the upward increase of land and building costs and therefore ultimately increased rental rates,” says Koontz. “Those high prices are educating users that San Antonio’s location for regional distribution is excellent by way of I-35 and I-10 and that our cost structures are less than our neighbor to the north. Therefore San Antonio appears to be in good fundamental shape for the foreseeable future in regards to product delivery, absorption, new building starts and attractive rental rates.”
The company has its eye on hot spots within the market, honing in on the emerging industrial area along I-10 East at Foster Road. HEB recently announced it had purchased 871 acres off Foster for a major distribution center.
This isn’t Koontz Corporation’s first foray into New Braunfels. Since 2005, the company has developed a multi-use business park, several tracts of commercial land and two major multi- family projects there.
“That cements the idea that this area is in play for larger users servicing this market,” Koontz says. That is where the company is building Foster Ridge Distribution Center,
“We are very bullish on New Braunfels for a variety of reasons, which include tremendous population growth (Comal County is No. 2 in growth in the U.S.), the location adjacent to I-35 between Austin and San Antonio, has affordable housing and a low cost of living, great schools, excellent quality of life and job growth,” says Koontz. “We have also recently made an additional land purchase in the last 30 days to increase our holdings in the market.”

He adds that many companies are starting to realize that a regional presence in New Braunfels between Austin and San Antonio can service both the Austin and San Antonio markets from a single-source location. located on the East side of San Antonio at I-10 and Foster Road. When complete, the projects will consist of a cross dock 327,600 square foot class A distribution facility. The building amenities include a 32-foot clear height, 50’x52’ column spacing, 60-foot speed bay, trailer parking, 130-foot truck courts, as well as an ESFR fire protection system. Koontz plans for the building to be delivered in Q1 2019.
“... unprecedented demand ...” Another project underway for Koontz is Parkview Plaza, a 58,000-square-foot single-story Class A office building in New Braunfels. “The project is located in a beautifully landscaped master-planned business park called Sundance Park. The building has just recently been completed and is currently in lease up mode working on several transactions,” says Koontz, adding that the property enjoys a 6-to-1,000 parking ratio and has additional land for a second phase of an equally sized building.
“These same companies are seeking a less expensive alternative to pricey rents and spiraling housing costs in the Austin market by selecting the value alternative that the I-35 corridor has to offer,” says Koontz. In the years to come as the region continues to generate unprecedented demand for commercial development in every type of property, Koontz believes the office market will become more defined between San Antonio and Austin, comparing it to what happened between Dallas and Fort Worth years ago. “As more residential housing continues to materialize at a blistering pace in this region so will the concept of live, work and play. There will continue to be a need for office product to support this demand,” Koontz says. “It is still a little early to predict any strategic massing of office space which could appear say in development nodes created by future mass transit stations or more defined town center developments.” Continued on Page 24 > OCTOBER 2018

Data from the Real Estate Center’s Q1 2018 office report backs that up. The vacancy rate ticked up to 9.8 percent. Despite those numbers, Cannon says Class A is doing well, particularly in the TX-1604 corridor from U.S. 281 to TX-151. “What we’re seeing is that Class A office space around
the city is commanding and getting $28 a square foot, NNN,” he says. “There doesn’t seem to be any shortage of tenants for these Class A projects at that rent level.” The company is currently working to purchase land for a 60,000-square-foot office park.

Building Permits: Navigating Bureaucracy to Move your Project Along BY OMAR IZFAR, ATTORNEY, WILSON CRIBBS+GOREN
are adopted by publicly elected city councils that have legislative authority. Plan reviewers and building officials do not have the legal right to amend the building codes, and giving their mistakes the force of law is effectively doing just that. However, in most cases, you have the right to notice and a hearing before your permit is effectively revoked, even if it was issued in error.
A variety of building permits are typically required for new construction and renovation of buildings. Building permits are issued as a matter of right if the plans and specifications submitted by an applicant for a permit comply with a city’s or county’s building codes. Almost every local government in America has some form of building codes adopted from a nationally promulgated form. National code writers will release a new version of a code every few years. A city will formally adopt a version of the code and often also adopt local amendments to the code that contain specific provisions that regulate development in a manner specific to that city. For example, the City of Houston has adopted the 2012 International Building Code with local amendments while the City of Pearland has adopted the 2015 International Building Code with local amendments. What that means for you is that building codes are, at least, slightly different almost everywhere you look. Sometimes submitted plans do not comply with the adopted building codes and the plans are rejected. While that can be incredibly frustrating and expensive, it is much better than having plans approved and permits issued in error, then revoked. Alternatively, plans and specifications may comply with local building codes, but are rejected anyway, often requiring special intervention on behalf of the applicant to show the city or county that they are wrong.
Wait, revoked? Can the government do that? If plans are approved that do not comply with the local building codes, they are subject to being revoked. Sometimes construction is already underway when a permit is revoked, leading to costly delays where construction crews have been hired and now have to be sent home. Local governments typically do have the authority to do this, with some important limitations. As amazing as this may sound, it does make some sense. Building codes 28

Often, what’s much worse than a revoked permit is the local government’s ability to put your project in limbo, which can happen a few different ways. The plan reviewer or building official can subject your submitted plans to endless scrutiny by attempting to find fault and order revisions, even if those faults and revisions are not supported by local building codes. Another path to limbo involves the approval of plans, the issuance of
cation for a building permit. For example, the City of Houston has a Building Standards Commission, a General Appeals Board, a hearing official, a City Council, all of which play a role in various stages of administrative appeals. An applicant is usually required to go through as many of these as can be applied to the application before filing suit in court. However, local governments can sometimes refrain from making the kind of final determinations that are administratively appealable by keeping applications in limbo, forcing you to resort to simply filing suit.

Some tips for navigating the building permit process: 1. Have a meeting before submitting plans. Try to enlist the help of the local building official in anticipating problems and issues before they arise so that your plans and specifications can incorporate those concerns. 2. Employ a consultant for a project that may be tricky or involve some uncertainty. Architects, civil engineers, and building code experts all understand different aspects of the regulations affecting approval of building permit applications.
a certificate of occupancy indicating final inspections are complete, and then added scrutiny by the local government concerning the application of the certificate of occupancy to a particular use. In especially egregious cases, this added scrutiny is a pretext for governmental opposition to a project and defeats the purpose of having a predictable and uniformly applied set of laws. Some aspects of reviewing building permit applications involve a degree of discretion on behalf of the government as well. A good building code consultant is often well worth the expense to navigate these areas and structure an application to prevent these types of delays.
Can I appeal? Can I sue? Typically, there are a few layers of administrative appeals from adverse decisions of the building official, depending on what kind of issues exist with the appli-

Most applications are reviewed by several different plan reviewers who focus on different aspects of the building code. The entire set of plans sometimes has to physically move from one desk to the next. It is very helpful to know which reviewers have signed off on certain aspects of your plans so that you can isolate the problems. 5. Don’t let your permits expire. Typically, permits are good for six months, but this can be different from jurisdiction to jurisdiction. Do work, have it inspected. Let the government know you are pursuing your project.
