It’s interesting to note that in 2017 we were discussing what effect $58/bb oil and interest rate increases would have on Texas commercial real estate. In 2018 and 2019 oil hovered around $60 - 65/bb, the stock market broke 25,000 and began its roller coaster ride to new heights; through it all, our industry has maintained steady growth and normal business activity. Is your insurance claim running out of time? The hidden deadlines your insurance company doesn’t want you to know about BY BRANDI SMITH

There are few market forces that can shut down a commercial operation the way Mother Nature’s forces can. Hail, wind, fire and floods can all significantly impact business operations and, while insurance is supposed to be a tool to help you manage risks with those unexpected interruptions, it can often introduce new challenges. “There’s a lot of risk in owning commercial real estate. Property owners' buildings are always at risk and it’s just not right when insurance companies don’t pay fairly and promptly,” says public insurance adjuster Scott Friedson, CEO of Insurance Claim Recovery Support (ICRS).

“When policyholders retain us, we virtually step into their shoes and act as their exclusive claim advocate.” Best of all, there is no fee for his services it there’s no recovery. That, however, has never happened. “One hundred percent of our claims settle higher and/or faster than what the initial carrier offered,” says Friedson. “We have a 100 percent win rate.” Licensed and bonded by Texas and other states, Friedson applies his 10 years of trusted public adjusting experience to exclusively represent

commercial and multi-family property owners to settle property damage insurance claims fairly and promptly. The process includes reviewing the insurance policy for benefits and exclusions, inspection of buildings for damages, negotiating with the insurance company for maximum settlement in minimum time and meeting with the insurance company’s adjusters or representatives on site. ICRS produces a line-item estimate to support the damage model, requests an advance of policy benefits so their client can get reimbursed for incurred expenses and get immediate repairs started. Then ICRS negotiates the full and final claim for the remaining policy benefits the insurance company owes. Continued on Page 10>

“You wouldn’t have the IRS prepare your tax return and tell you what you owe. So why would you let your insurance company prepare your claim file for you and tell you what they’re going to pay you?” he asks. The first deadline Friedson wants commercial property owners to be aware of is when you can file a claim. Some policies only allow you to file a claim within a year from the date of the loss. “A lot of people don’t even realize they have a claim or building damages. They think, ‘Oh, we had a hail or windstorm but we don’t have any roof leaks.” That doesn’t mean you don’t have damage to your roof, windows, siding, gutters, etc,” he says. “You don’t want to wait to inspect your property and file your claim because you can run out of time.” Another important deadline (in a process full of them) deals with business interruption claims. Typical business interruption policies only provide benefits to cover a year. For example, if you make $100,000 of net income each year, the insurance company will typically cover most of that $100,000, but only for a year from the date of loss. “So if the property damage portion of your claim isn’t settled within the same time frame that your business interruption claim is processed, you could easily run out of time on your business interruption claim benefits before your property damage is settled, completely fixed, and you’re back in business,” Friedson points out. “Too often, people wait to call me until six or eight months into the claim process when they have been struggling with problems hoping their insurers will do the right thing. What they don’t realize is that they’re going to run out of their loss-of-us benefits before the property is completely repaired.”

time is to hire ICRS as soon as you have a claim, says Friedson. Policyholders carry the burden of proving their claim to an insurance company. Without considerable training, documentation and experience, navigating the process is a considerable challenge. Friedson says the process without him usually goes a little something like this: the property suffers damage, the policyholder files a claim and then comes what he calls the “hope stage.” “That’s when people hope the insurance company will do the right thing. That seldom happens, especially with larger losses over $250,000” he says.

That’s why, he says, it is important to bring him into the process immediately. Though he is able to come on board at any time or even reopen closed claims, he is able to save his clients a lot of time the sooner he gets involved.

Instead, the insurance company sends out its representatives to cover the insurer’s best interests, not those of the policyholder. Their goal is usually to pay as little as possible, often while dragging the process out. If no one is representing the policyholder’s best interest, they are simply on a level playing field with their insurer.

“The number one way to settle a claim for the maximum settlement you deserve in minimum

leave it and if you don’t like it, prove us wrong otherwise,’” says Friedson, adding that this is the point in the process when he typically gets a call from first-time clients. “They call us with a big problem or tell us they are in a huge battle with their insurer and we love solving insurance claim problems. After our clients see how we hold insurers accountable and get great results, they hire us the moment they have another claim to avoid future problems and headaches.” The whole process is far more balanced when Friedson is retained immediately. “Before the insurance company digs its heels into a coverage decision, they are required by law to give equal consideration to anything that I present to an insurer as a policyholder’s representative,” he says. “Our clients gain both time and money engaging ICRS at the beginning of a claim to avoid delays and underpaid insurance claim settlement so we can present the policyholder’s position in real time. That way we’re able to avoid a lot of delays and underpaid insurance claim settlements unrepresented policyholders are forced to deal with. If policyholders wait until they feel wronged or betrayed by their insurer to hire us until after the insurance company has paid some, but not all, the money a claimant believes is owed, Continued on Page 12>

that is considered a supplemental claim under the typical public adjuster contract. Public adjusters usually charge 25 percent of any supplement or 10 percent of the gross claim less the deductible, whichever is less. Policyholders typically don’t save time or money waiting for a problem to arise before they hire us. Business owners who know time is money retain us the moment they have a claim to avoid issues. Taking on insurance claims

“We can get it legally done faster and cheaper so the policyholder receives the settlement they deserve,” says Friedson. He tells the story of a property owner whose insurance claim on a 700,000-square-foot facility was initially denied. Preparing to sue the insurance company, the property owner’s insurance broker suggested calling ICRS instead.

“Plus, you’re probably going to get a subpoena for your records. You could have depositions. And you’re required to go to mediation in most courts in Texas before you go to trial,” he says. “We typically get it done with no depositions, no subpoenas, no required mediation, no courts, and no juries. Our modus operandi is to avoid a lawsuit like the plague!” Most litigated cases do not make it to trial, according to Friedson, who says nine times out of 10, insurance companies settle the claim in mediation if a lawsuit is filed. That may sound good on its face, but Friedson explains how it often backfires. “Let’s say you want $2.1 million because you’ve suffered $1.5 million in property damage, plus you’re paying $600,000 in legal fees. The insurance company may say, ‘OK, we’ll pay you $1.5 million,’ but you still have to deduct your attorney’s fees from that. Don’t be surprised if your attorney turns to you in mediation and says ‘This is a business decision you’re going to have to make. We can take this bird in the hand or we can roll the dice and go before a jury.’ So a lot of times people will just settle, which you don’t ever hear about because they also have to sign a confidentiality agreement.”

without representation is just not worth risking your livelihood or mental health.” Friedson’s experience and attention to detail mean that he is able to fight for his clients in a unique and wildly successful manner. “Every single one of our claim files is a custom piece of work,” he says. His words are backed up by the company’s numbers. ICRS has settled $40 million just in the past year, adding to the well more than $100 million in claims settled over the past four years. His largest client has more than $2 billion in assets and calls ICRS every time a claim comes up. In any event, a commercial property owner should call ICRS before relying on a contractor, hiring an attorney or invoking the appraisal clause to settle their claim. 12

“We got the denial completely reversed and settled that claim for seven-figures.” Friedson shares. Without ICRS, he suspects the client would have been forced to sue and the process would have dragged on as it so often does. Appraisal, he complains, costs the policyholder money out of their own pocket. On top of that, there is usually no timeframe in the policy to keep insurance companies in line. As a result, it can take one to two years. Plus, most policies have language that give the insurer the right to deny any appraisal award after the process is complete, and then the policyholder will need a lawyer to litigate for coverage! Litigation, Friedson adds, can also stretch to two years if the verdict isn’t appealed.

Most attorneys charge 40 percent. ICRS, on the other hand, charges 10 percent less the deductible. Also, Friedson works on contingency, so if there’s no recovery, there’s no fee. There are several reasons first-time clients often become long-time clients of ICRS: Friedson’s experience, attention to detail and passion for what he does. His 100 percent win rate and track record of always getting clients more and/or faster than what insurance companies offer add to the list of reasons why even insurance brokers have Friedson on speed dial. Says Friedson: “Insurance companies have experts working for them. A powerhouse city. Boomtown. The epicenter of the Rio Grande Valley. There are plenty of ways to describe McAllen, Texas, but they all have one thing in common: growth. “With the volume of consumers that comes in to McAllen daily, our city has developed a robust economy,” says Rebecca Olaguibel, the city’s Director of Retail and Business Development. The numbers are incredible for a city its size. With a population of around 140,000, McAllen generates more than $3 billion in gross retail sales thanks to 18 million people (an average of 39,000 people per day) who visit the city every year. It’s just 10 miles north of the Mexican border, so international visitors flow through it via McAllen International Airport and the two international bridges managed by the city. “It’s truly a geographic jackpot,” says Olaguibel, who has worked for the City of McAllen for 12 years.

The city can do that with the confidence of a AA+ rating from Finch, which looked at a variety of factors, including revenue and expenditure frameworks. The financial rating agency has bestowed that rating on the City of McAllen’s $5.6 million general obligation refunding bond, as well as its $101 million in outstanding GOs and longterm issuer default. According to Fitch, “the ‘AA+’ GO and IDR reflect the city’s strong operating performance and prudent budget practices that have resulted in ample financial flexibility.”

The grants of up to $15,000 can be used for storefront improvements, covering anything from facade painting, to landscaping, to lighting. The designated areas include 10th Street from Houston Ave. to Nolana Ave.; U.S. Business 83 from McColl Rd. to 29th St.; 23rd St. from Idela Ave. to Pecan Blvd; and S. Ware Rd. from Idela Ave. to Pecan Blvd. “We’re trying to help our small businesses with this token of support,” explains Olaguibel. “As

As it offers up opportunities for existing businesses, Olaguibel is also looking to real estate developers for new opportunities that would be a good fit for the city. “We want to partner with developers who share our vision. If there is a developer out there with a big idea, we want to hear about it,” she says. The 2,500-acre Tres Lago subdivision in North McAllen is representative of that kind of partnership’s success. The new and innovative development boasts 5,000 single-family homes along with amenities such as parks, pools, sports fields and hike-and-bike trails. One of the projects she thinks would make a great addition to McAllen is a mixed-use development offering a live-work-play atmosphere. “We would love to see the combination of business, retail, office and service in one space,” Olaguibel says. With a booming economy and business development at an all-time high, she adds that the city is open to any concept that would elevate the quality of life for McAllen’s residents and visitors. “McAllen is a well-rounded city in deep south Texas. CEDAR HILL, TAJ HOSPITALITY BREAK GROUND ON HOTEL & CONVENTION CENTER PROJECT

On Thursday, October 3, the City of Cedar Hill broke ground on a Hotel and Convention Center project that will bring 136 hotel rooms, convention center space, adding enhanced commercial and entertainment amenities to the City. The project will be constructed on the eastern side of Hillside Village shopping center and will include an approximate 136-room Aloft hotel and adjacent convention facility to include an 8,000 square foot ballroom, 4,000 square feet of flexible meeting space, and various support spaces. The project is being designed to interact closely with existing retail activity and provide a foundation for an enhanced entertainment presence in the area. The anticipated total value of the facility is approximately $25 million and is projected to open for business in the summer of 2021. Continued on Page 26>

“This is a project that has long been anticipated, and we’re excited to add a hotel/convention center to the high-end retail and entertainment offerings at Hillside Village in Cedar Hill,” says Mayor Stephen Mason. The project is being developed and operated as a public-private partnership, where partner Taj Hospitality will own and construct the hotel while the City will hold and build the convention facility. The financial contribution of the City for the convention facility is an estimate of $7.5 million, which would be financed and supported through revenues generated by the facility. During the last legislative session, Cedar Hill sought and received special legislation allowing its eligibility to recapture certain State funds to assist in supporting its contribution to the project. n

EQUINOX AUSTIN OPENS FITNESS CLUB Equinox has opened its first fitness club in 29,333 sf at 1007 S. Congress next door to Music Lane, which is under construction. 41-STORY OFFICE TOWER PLANNED Minneapolis-based Ryan Companies is planning to build a 41-story office building at the corner of Fifth & Colorado streets which is currently the home of the technology office of Walmart as well as several adjacent restaurants. LOREN AT LADY BIRD LAKE STARTED New York-based Loren Hotel Group has broken ground on a 108-room luxury hotel at 211 S. Lamar Blvd called Loren at Lady Bird Lake. Construction should be complete by fourth quarter 2021. PLAZA AT BEE CAVE SOLD A 14,212 sf office building known as Plaza at Bee Cave was sold to an undisclosed buyer. Matt Fain of ECR represented the buyer & Patrick Ley & Haley Smith of ECR represented the seller. MIXED-USE PROJECT FOR RAINEY STREET River Street Partners is planning a 46-story hotel & apartment tower called River Street Market & Hotel along River Street between East Avenue & Rainey Street. The 598,000 sf project will have 251 hotel rooms, 196 apartments & 27,800 sf of restaurant & retail space. SECOND HOMELESS SHELTER Austin City Council plans to purchase a 71-room hotel at 7705 Metro Center Drive near Bergstrom IAH for the purpose of utilizing it for a homeless shelter. The hotel will reportedly cost the city $6.8 million to purchase and $1 million for renovations.

HUNTINGTON SQUARE CENTER SELLS Hunt Development , Ltd sold the 90,768 sf Huntington Square Shopping Center located at the corner of Staples & Saratoga to LRIC Corpus Christi, LP. The center is anchored by a 174,000 sf HEB Plus grocery store. The seller was represented by Lynann Pinkham with Cravey Real Estate.

LAREDO, TX 250,000 SF FOR BUCKLAND COMPLETED The first built-to-suit facility in the 211-acre master-planned Khaledi Industrial Park at 10302 IH 35 has been completed for Buckland Global Trade Services, Inc, a Canadian-based customs broker, freight forwarded & distribution service manager for the automotive & consumer goods industry. Buckland’s facility is 250,000 sf with 92 dock doors, 288 trailer parking spaces & over 150 car parking spaces.

Santikos Enterprises is developing a movie theater which will anchor the planned 150,000 sf Boerne Stage Crossing Shopping Center located at I10 & Boerne Stage Road.

ROCKPORT, TX HIGH-VISIBILITY CORNER TRACT SELLS A 62-acre tract of land located at the southeast corner of SH 35 Bypass & FM 3036 sold to Staudt Investment Properties, LLC from Rock-N-Riviera VIII, Ltd. The seller was represented by Janae Evans of the Rockport office of Evtex Companies & Cullen Realty Group based in Houston. The property is zoned “R-1 First Single Family Dwelling District” but development plans have not been announced.

NAI Partners has purchased the 58,929 sf Triangle Center located at 2000 N. Mays Street from Triangle Center I Ltd. Equitable Commercial Realty represented the seller.

Methodist Healthcare is developing a clinical campus on 70 acres in Westover Hills which will include a full-service hospital & a 100,000 sf medical office building. EAST END PROJECT UNDERWAY Dallas-based Quadrant Investment Properties in under construction for a mixed-use project on five acres located at 1220 E. Commerce Street. Upon completion the project will include a 6-story, 187,000 sf office building, a 40,000 sf retail building & a 700-car parking garage. Construction will start July 2020.

The city of San Marcos & Pursuant Ventures Development LLC are turning 30 acres on Centerpoint Road into an indoor/outdoor sports & entertainment complex that will feature eight championship baseball fields & education, computer & study rooms. Construction will commence early 2020.

AVANZA MOVES INTO 95,000 SF Avanza, a Mexican customs broker, is moving into a 95,000 sf, state-of-the-art facility located in the 2,000 acre Port Grande Industrial Park which is located on the site of the former Mercedes Benz test track located east of I35 & 10 miles from the US-Mexico border.

VICINIA DEVELOPMENT UNDERWAY A group of local San Antonio developers, PMI 2016, recently launched development of Vicinia, a 97-acre mixed-use development at Potranco Road & West Military Drive, which is located on the site of the former Persyn family farm. Vicinia will be the first project to utilize San Antonio’s Transit Oriented Development (“TOD”) zoning code that encourages density near transit facilities.

BOY SCOUTS CAMP TO BE PUBLIC PARK Hays County has purchased 536 acres of the former 2000 acre El Ranco Cima Boy Scouts Camp along the Blanco River near Wimberley for $13 million. The property has a mile of frontage along the Blanco River & will be utilized as parkland.

The company now owns at least nine industrial properties in North Texas. MCLANE LEASES 157,000 SF McLane Company, a grocery wholesaler & distributor, leased 157,000 sf at 4721 Mountain Creek Parkway. AVENGER FLIGHT LEASES 116,640 SF Avenger Flight Group LLI, an aviation simulator company, leased 116,640 sf of industrial space in the Valley View at DFW Center with plans to construct a flight training center in the spec space.

Dunhill Partners, Inc sold the 150,007 sf Little Elm Towne Crossing retail center to an undisclosed buyer. The center is located on 17.6 acres at 2700 East Eldorado Parkway in Little Elm which is situated on the northwest border of Frisco, Texas.

RHOME, TX 3,400 ACRES FOR MASTER-PLANNED COMMUNITY PMB Capital purchased more than 3,400 acres at SH 114 & US 287 for the development of a $3.5 billion project which will include more than 10,000 homes. The property is located west of AllianceTexas north of Fort Worth. The first phase of construction is planned in 2020 & homes are expected to range from more than $200,000 to above $500,000. The building was developed by Skanska. SKANSKA BUYS 3.5 ACRES NEAR DISCOVERY GREEN Skanska purchased the downtown block bordered by Dallas, Lamar, LaBranch & Austin for $55 million and plans to develop the site into a mixed-use project including office, apartments and retail. Weingarten Realty Investors purchased the 117,893 sf, Shops at Hilshire Village retail center located at the northwest corner of Wirt Road & Westview, in addition to another retail center in San Jose, California. They recently sold Cypress Pointe Retail Center in Cypress to Tarantino Properties & also sold a property in Las-Vegas, Nevada.

Houston-based Pros Holdings, Inc., one of the city’s largest technology companies, leased 118,000 sf at 3200 Kirby a year ago in the Kirby Collection development. They are reportedly spending $12.4 million to complete the build-out of floors 2, 4 – 10, 12 & 13 which will include a dining facility, lounge area and conference center in addition to office space.

Takeaway: Although projections for new job growth for the Houston area is slowing somewhat, land sales/purchases-a precursor of development-continue active. Industrial is the ‘darling’ segment, office is mostly out of favor, and the other segments are healthy. Compared to other markets across the U.S., Houston is a relatively easy market for CRE development, hence lower cost of living.

Bullets-General:

• As infill development continues in multi-family and retail, land prices continue to rise • I ncreasing density equals increasing traffic on our streets-we are all noticing that •H ouston area population has grown from 6 to 7 million in last ten years, and is projected to grow by 3 million more in the next 10-15 years…the equivalent of moving the combined populations of Austin and San Antonio into Greater Houston-how will all the cars fit? • I n spite of our hearty growth rate, the DFW Metroplex is growing just a little bit faster •O il industry technology continues to lower the cost of producing oil & gas, which has mixed results for the Houston economy • I nfill land prices are ranging from $80-120 in The Heights and from $20-35 in nearby Garden Oaks

• I n spite of the growth of online retail, bricks and mortar development continues in infill sites inside the Beltway, and in the far suburbs, following residential growth •R etail is evolving, with few to none ‘power centers’ focused on big box retailers such as Lowes, Target, or Home Depot; todays retail anchors are large grocers instead •W e are seeing 4-6 million SF per year of retail and specialty retail coming in to our metro area •M any retailers are not abandoning brick and mortar locations, but are making their stores smaller; many new retail shops are designed to sell goods but also to serve as pick-up and return centers for their brands’ online purchases

Industrial:

•W e have just over 13 million SF of industrial under construction, the most in modern times

Office:

•W e still have a vacancy rate of 28%, although four or five new buildings are going up-new supply overall is slowing dramatically, though •C lass A buildings built prior to 2014 are losing tenants to newer buildings, with their newer amenities, •E ven in this period of overall stagnant absorption, newer state-of-the-art buildings are filling up-even under construction they are experiencing vigorous pre-leasing

•F avored areas are I-10 west of Katy, and off-I-10; the Southwest; the Southeast (Baytown and Ship Channel/Port); the Northwest (290 @ BW-8) • I nvestors/lenders are lined up to provide funds for this segment, and although a healthy supply of new spec space is in the pipeline, there is not currently a fear of oversupply

Single Family

Multi-Family:

• L ots of development in this segment •S trongest markets are Heights/Washington, Montrose, Galleria, Medical Center, Midtown, North, and Katy • I t takes 1-3 years to deliver new units •2 0,000 units are under construction due to open in 2020, and there is a concern that this is too many given the slowing of job growth •1 6,500 units are currently in lease-up stage •O verall MF occupancy is 90%; rates are at an all-time high, with an average continuing growth year to year of 3-4%

• T his segment of commercial real estate is consuming about 20,000 acres per year, and is producing about 27,000 homes per year •O ur single family growth is slightly behind that of DFW but ahead of Phoenix and Atlanta •G rowth is directly connected to job growth, which is leveling out for the moment with slowdown in oil & gas
