PROBABLE CAUSE AFFIDAVIT Comes now Carl Pieczonka and hereby swears or affirms as follows:
This affidavit does not contain all the details currently known to law enforcement, but includes only sufficient information believed by your affiant to establish probable cause, and in support of your affiant's assertion of probable cause, the following facts are within your affiant's knowledge,
At all times pertinent to the matters discussed herein, your affiant has
been
employed as a law enforcement officer with the Dearborn County Sheriff's Office. Your Affiant is a graduate of the Indiana Law Enforcement Academy. In the course of Your Affiant's employment as a law enforcement officer, Your Affiant has Bained training and experience related to
the investigation of narcotics offenses, burglary, theft, impaired driving, and unlawful multi-media communications. On July 30, 2019, at approximately 9:45 p.m. Dearborn county Sheriff's Department was called to the residence on 2182 Banberry Drive, Lawrenceburg, lN 47025 in reference to a male, armed with a handgun that was threatening to commit suicide. This person was identified as Nicholas A. Gregory. As
officers were approaching the residence it was learned that Gregory forced entry into the residence. This residence belongs to William and Sheila Bierman. Your affiant learned that the Bierman's are related to Jerrica Watson. Jerrica Watson and Gregory are in a dating relationship. Prior to the Dearborn County Sheriff's being called to the residence on Banberry Drive, your affiant learned of prior criminal events that took place earlier in the evening on St. Peters Road, Franklin County, State of Indiana. Your affiant was advised by Jerrica Watson that earlier on the 30'h, she and Gregory had a verbaland physical altercation at a residence on St. Peter's Road. Through the course of the verbal and physical altercation, Gregory obtained a black handgun from inside the residence. Gregory repeatedly stated that he was going to shoot their Boat, Maddie if Jerrica left the residence on St. Peters Rd. with her mother, Sheila Bierman. At that time, Gregory fired one shot toward the goat. Sheila grabbed her daughter, lerrica and placed her in her vehicle. Gregory continued to yell towards Jerrica and then fired another shot from the gun. Gregory then said, "lf you leave, you a re going to be calling the morgue." As Ms. Bierman and lerrica pulled out of the residence, they hea rd a third gunshot, ln addition to Ms. Bierman and Jerrica, Jerrica's son, GB, age 4 was present as well. They were enroute to the Bierman's residence on Banberrv Drive, in Dearborn countv, State of Indiana.
At their residence on Banberry Drive, Ms. Blerman and Jerrica had a private conversation, on their front porch on Banberry Drive regarding the argument between Jerrica and Gregory. As their conversation was ending and they were heading into the residence, Ms. Bierman and Jerrica heard a child scream that
someone was trying to gain entrance into the house through a window. Your affiant learned that this child, was a niece to Jerrica. Jerrica's sister and several of her minor children reside at this residence as well. Jerrica proceeded to the bedroom in the basement area where a person attempted to gain entrance into the house. At that time, Jerrica observed that this person was Gregory. Gregory then took several large, pieces of wood and shoved them in front of the window so no one could enter or exit. Gregory then comes running around the house yelling out that he needs to speak with Jerrica. As this was transpiring, William Bierman told your affiant
that he saw Gregory outside the residence and saw Gregory point a firearm towards William and other family members that were inside, gathered on the first floor of the house. When this occurred, Willia m told everyone on the first floor of the residence togo upstairs. G regory continued to scream for Jerrica and bega n pounding on the front door. William was standing in the kitchen when Gregory forced entry into the residence while armed with a firearm,
William stated that Gregory busted the deadbolt while making entry and proceeded through the residence, to the garage where a safe was located. The safe contained a large quantity of guns that only Gregory knew the passcode ofthe safe. At this time, as law enforcement was arrivlng on the scene, William exited the residence and Gregory ran up the steps and barricaded himself into a bathroom.

Dearborn County Sheriff's Department along with Indiana State Police were on scene trying to make contact with Gregory. At the time of preparing this search warrant affidavit, your affiant learned that a negotiator was enroute to the Banberry address to attempt contact with Gregory. Law enforcement was able
Your affiant has quickly learned that Gregory is ex-military and has a couple of pending cases. One case is a battery in Ripley County, that occurred in February, 2019. Another pending case is a Possession of Methamphetamine along with other drug related charges in Franklin County. These charges were filed in J une of 2019.
All events, unless otheruise described or noted, occurred in Dearborn County, State of lndiana.
Based upon the foregoing facts, your affiant believes that Probable Cause exists to believe Nicholas A. Gregory, DOB 12105/1981 , a white male adult approximately 6'01 ", 190 lbs has committed the crime(s) of: CRIME(S)
