How much is the IRS Exemption for gifting to my children? -Jim Great question. First, some clarification for the rest of the readers. The Internal Revenue Service allows you a “gift exemption” of $13,000 per year, per person, every year. If you’re married, you can each gift up to $13,000 to each heir. If you go over that amount, you’ll have to file a Gift Tax Form (Form 709). This doesn’t necessarily mean you’ll have to pay tax on the above amount, but you will have to notify the government. Roger Ford Regarding gifting, the donor usually pays the taxes, not the donee. Second, property can be gifted, but be careful how you calculate the amount. There is a maximum amount you can gift over your lifetime, and every gift you give goes towards that “Gift Ceiling”. Finally, cost basis goes with your gift. If you gift P&G stock you bought at $30/share, your children will “retain” your cost basis. (However, if the P&G is inherited upon your death, your children experience an increase in cost basis to a more current price.) Whether you are looking at blessing your kids or protecting your money from Medicaid Spend Down, gifting your assets is a tremendous way to dictate where your money goes. However, there are many nuances with these codes and even the IRS website states, “the laws on Estate and Gift Taxes are considered to be some of the most complicated in the Internal Revenue Code”.
