JILL BROADHURST Jill Broadhurst is the Executive Director of EBRHA and is responsible for its strategic goals including increasing membership, education curriculum and the Contra Costa County expansion. GRANT CHAPPELL Grant Chappell is the Vice President of NAI Northern California. Since 2005, Grant has focused on East Bay apartment opportunities for his clients. Grant also serves on the Board of CEI, the Center for Elders’ Independence, a local nonprofit providing PACE Care to seniors in Alameda County. In his free time, Grant enjoys skiing, golf, biking and traveling.
MARK TARSES Mark Tarses is an East Bay landlord, and has been renting houses and apartments in Berkeley and North Oakland since 1972. He was born and raised in Baltimore, Maryland. He graduated from the University of Maryland in 1970 with a B.S. in Business Administration. In his spare time, he is the Vice President of the Oakland Magic Circle, and he is a volunteer history teacher at Orinda Intermediate School.
STEVE WILLIAMS Steve Williams of Fried & Williams LLP received his bachelor’s degree in Law and Society from the University of California, Santa Barbara. He received his law degree from Golden Gate University. He has been representing property owners in the Bay Area since passing the California bar exam in 1999. Steve’s experience includes counseling property owners in many areas of the law, including landlord/tenant, co-ownership and neighbor disputes, and purchase/sales transactions. He has represented clients in court, at arbitration, at mediation, and at government agency hearings, including Rent Board hearings.

hosted its 1st Annual Awards Ceremony and Holiday Reception on December 4, honoring leaders in the East Bay rental housing community. Those honored included Charlotte Woodard as Member of the Year; Bay Property Group as Property Management Company of the Year; Bay Area Contract Carpets as Vendor Member of the Year; and Moretha Parker as Goodwill Ambassador. “EBRHA is thrilled to initiate a celebration of rental housing leaders who do so much for our communities,” EBRHA Executive Director Jill Broadhurst said. “This event provides a great opportunity to mix and mingle with all levels of property owners and vendors.” In addition, EBRHA honored Past Board Member Daniel Bornstein, and Board Member Emeritus Fred Morse and Carlon Tanner for their years of dedication to the Association. In response to new housing laws and the importance of compliance in rental housing, EBRHA will be updating its rental forms starting in January 2014. EBRHA values member feedback, and will consider all member-suggested changes and improvements to forms, to help you manage your properties effectively. Look for updated forms and announcements in early 2014.
Berkeley Bans Tobacco Smoking in Apartments, Condos Smoking cigarettes will no longer be allowed inside the multifamily housing units in Berkeley, effective May 2014, after a unanimous vote by the Berkeley City Council in December. The council decision, once it’s adopted on second reading, would prohibit tobacco smoke inside all residential buildings that have more than one unit, and in all common areas of those buildings as well. Berkeley officials hope the smoking-ban will protect the rights of both non-smoking neighbors as well as residents who receive complaints. The ordinance includes processes for tenants to get smoking cessation services, and an outreach and education campaign about the law, that will be in effect through December 2016. City staff will provide sample language about the ordinance and its enforcement to

Updated EBRHA Rental Forms Coming in 2014
landlords to help spread the word. Serena Chen, regional advocacy director in Oakland of the American Lung Association, told the council that, by her count, Berkeley would be the 17th city in the nation to pass an effective smoke-free multi-unit housing ordinance. “But you will be the first city to enforce it right,” she added. Beginning in May, new leases for all tenants will include mandatory non-smoking clauses. Existing tenants will be offered a voluntary nonsmoking addendum to their leases. One challenge to the ordinance previously had been how it would be enforced equitably and who would be responsible for enforcement. Staff explained the process to council members Tuesday night. Under the new law, upon receipt of the first complaint about a resident smoking indoors — which must be made in writing using a city form — staff would send a notice to alert the resident about the complaint and provide information about the rules. If, within six months, the city receives additional complaints from two residents in two separate units about that same smoker, the city could issue a ticket or an infraction. Smoking is already banned in the city’s commercial zones, and “Berkeley has implemented bans on smoking in public places such as restaurants, bars, grocery stores, and parks,” according to Tuesday night’s staff report. We really thought we made a huge leap when we updated our website almost three years ago. And while that is true, we are now ready to jump ahead and make you all say, “Wow!” We are busy meeting with our Web developer and adding our requests and expectations, as well as yours. This new navigation and design will make it easier to find the information you want in a simple format. A new and improved website will be live in early 2014. As always, we encourage member feedback to help us improve your experience. If you have any suggestions, please contact us. What is integrated leasing? Integrated leasing is a turnkey solution that includes marketing, touring, screening and leasing your rental property. Providing Care to Elders The Center for Elders’ Independence and PACE helps aging tenants stay safe in their homes BY GRANT CHAPPELL
I
first learned about Center for Elders’ Independence back in 2009 through a long–time supporter whom I had met through real estate work. I was in my third year on the EBRHA Board at the time. Healthcare was becoming more of a hot button issue as the Affordable Care Act was in the nascent stage before ultimately becoming law the following year. Getting involved in volunteer work for CEI, and ultimately joining their Board of Directors, has opened my eyes to a model of healthcare that is second to none in my opinion.
Aging Tenants
As California ages — the over-65 population will double in the next 10 years — and the number of elderly renters rises, property owners are often faced with tenants who become frail and less able to care for themselves. This can expose tenants and the owner to safety hazards, such as fires when someone forgets to turn off the stove, or floods when water is left running. What can a landlord do when a tenant seems to need help? Most brokers, property managers and owners have come across similar situations in dealing with long term, elderly tenants. Often times the owner or manager becomes the de facto “family” in assisting with issues that come up later in life. These challenges are often not widely talked about as resources are few. If the tenant does not have family nearby to turn to with these difficult decisions, what options are there for the property owner?
Alternatives for Elders
Most people would much rather remain at home with some level of independence, and many landlords would prefer not to evict long-term tenants if it can be avoided. In many places, moving to a nursing home may be the only option for someone with significant physical and/or cognitive decline. Elderly (PACE). CEI offers comprehensive, integrated health care and social services designed to keep seniors functioning at their highest possible level, so they can stay living safely and with dignity in the place they call home. Nationally, there are 96 PACE organizations in 31 states. I joined the CEI Board of Directors in 2010 because they do such vital work caring for the most vulnerable members of our community. Later, when the Fund for Elders’ Independence (FEI) was formed to support CEI, I became a founding FEI trustee. In these roles, I’ve been able to observe the organization’s development and growth to its current enrollment of more than 600 seniors who might be living in nursing homes if it were not for CEI’s comprehensive care. The three PACE Centers in Oakland and one in Berkeley serve seniors in central and northern Alameda County and West Contra Costa County, from Hayward and Oakland, to Richmond and San Pablo.
A Safe and Healthy Environment
Whenever I visit, the centers are always humming: seniors socializing, enjoying art projects and musical entertainment, playing games that exercise their brains, and getting physical exercise so they can keep moving. CEI’s pastel-colored buses are a common sight on the freeways and in our neighborhoods, bringing participants to the centers for health care, activities, 20 RENTAL HOUSING

and lunch, or taking them to outside appointments and then back home. “We sometimes get calls from property managers concerned about a frail tenant,” CEI Outreach/Intake Director Marvin Gibson said. “We can quickly go out and screen the person for eligibility for CEI-PACE. If the person doesn’t qualify for our program, we can refer him to other community resources.” For instance, if you have a tenant who is hoarding and then, because of medical conditions, may be losing her balance, afraid to go outside, not eating right because she can’t go shopping, and falling so the paramedics are constantly showing up, CEI-PACE can help stabilize things.
Providing Home Care
Home care aides can also go in and clean the apartments, the CEI occupational and physical therapists can survey the apartment and make improvements, such as installing grab bars, to prevent falls. Also, a transportation driver will come to the door and into the apartment to escort a senior to the PACE Center clinic and day center, and to deliver medications and equipment. CEI can even arrange a shopping service, meal delivery and aides to prepare meals in the apartment. “CEI’s PACE program has been incredibly effective in stabilizing many of our residents at Satellite Affordable Housing Associates,” Director of Resident Services Shashi Jivan said. “Our residents who participate in the CEI program are receiving extensive medical care, ongoing

services such as physical therapy, in-home care services, day center activities, and transportation to and from CEI, and to all medical related appointments. This incredible partnership and the services that our residents receive are integral to their ability to live independently at our properties and age in place successfully.”
CEI Program Benefits
CEI provides and/or pays for all medical care (24 hours a day) and all medications (home-delivered). Its four day centers each include a fully equipped geriatric clinic, recreational activities, hot meals, rehabilitation therapy, social services, home care and transportation. Participants have access to a physician, specialists and nursing care; prescription drugs and durable equipment; physical, occupational and speech therapies; dental, eye and foot care; surgery and diagnostic tests; and inpatient hospital, emergency and nursing home care. CEI social workers and home care nurses regularly visit each participant at home to assess safety factors, arrange home-delivered meals or help with managing finances/paying bills, supervise personal care aides, assist with organizing belongings, and help with medications and proper use of assistive equipment. “If a participant’s environment changes, such as a move or return from a hospital stay, we go and check on them,” CEI Home Care RN Ellen Swords said. “If they’re having trouble with their medications, or they’re on a new medication, we’ll visit to make sure that they understand. If they’re not feeling well, we go check on them. We visit to draw blood, give shots, change bandages and teach family members. We communicate everything we see and do with the service that needs to know, and bring it to the CEI Interdisciplinary Team. And on top of that, if a participant needs supplies urgently and there isn’t a driver available, we’ll go. We also take turns being on-call.” This intensive case management means that CEI staff knows the participant’s

Whenever I give my tenants a nice box of chocolates, I always get a big smile and a very sincere “Thank You!” I know a landlord in Oakland who owns a vacation cabin near Lake Tahoe, and when he isn’t using it, he lets his tenants stay there. He makes them reimburse him $50 per stay for his cleaning service to tidy up the place after guests leave, but his net cost is nothing. Another landlord I know owns a Chinese restaurant, so he sends gift cards to tenants on their birthdays with a gift certificate inside for a free dinner for two. If you’d like to improve your property’s appearance and provide your tenants with a comfortable backyard, a 6-foot redwood picnic table with built-in benches costs $100-200. Your tenant will appreciate it, especially on warm summer days. When you finish a construction or remodeling job, cut up the scrap lumber into 18-inch lengths and give them to your tenants who have fireplaces. It reduces your junk pile and debris hauling costs, and firewood is a valued gift. A brushed nickel Kohler shower head costs $50, but it look great, the shower feels great, and it will last up to 20 years. Replace single glazed windows with double glazed ones. Tenants do notice it when their landlord improves their apartment and buys high quality appliances and fixtures. Keep your ears open when talking to your tenants. Tenants frequently want things from their landlords but are too embarrassed to ask for them. For example, if a tenant complains that there isn’t a robe hook in the bathroom or aren’t enough towel bars, offer to put them in. Don’t make your tenant beg for little things that they want. Doing a little thing for your tenant, like putting an extra towel bar in the bathroom, can make the difference between having a happy tenant and an unhappy tenant, and you don’t want unhappy tenants. We have had trouble with our neighbors and now want to put lights and cameras on our property, pointing at the street in front of their property. Are we allowed to do this? What if it was partly in front of our property and partly in front of their property?
Q
We recently put our rental property on the market and one of the tenants has been telling potential buyers about all the repairs that he believes the building needs and what he sees as deferred maintenance. He has never complained to us about any of these “problems.” What can we do?
A
Most real estate purchase/sales transactions require the owner to disclose certain information about tenancies at the property. This commonly results in the seller requesting the tenant to provide information about the tenancy and rental unit, often in the form of a questionnaire or estoppel. When the tenant chooses to disclose this type of information directly to prospective buyers or their agents, there may not be much the owner can do to prevent the tenant from doing so. An owner is required to provide the tenant with a habitable unit and is not 32 RENTAL HOUSING

relieved of this obligation because of a pending sale of the property. If an owner becomes aware of a complaint about the condition of the unit, even if the complaint is not made directly to the owner, then the owner still has an obligation to respond and perform any needed repairs or maintenance. So here, in response to your tenants complaints, you should investigate and perform any needed repairs or maintenance. Once you have done so, you should provide this information to any prospective buyer. This information, along with the buyer’s typical independent inspection of the unit, should help alleviate concerns about the condition of the unit. If you have made all needed repairs and your tenant continues to knowingly make false statements or representations to prospective buyers that prevent or interfere with the sale of the property, then you may have grounds to take legal action against him.

A property owner may install lights to illuminate his or her own property for safety and security reasons. The owner may not install lights in such a manner that the lights unreasonably interfere with a neighbor’s use and enjoyment of property. In other words, the lights cannot create a nuisance. Directing a light to shine on or about a neighbor’s private property may be considered a nuisance. Installing lights that are so bright that they keep the neighborhood up at night may also be a nuisance. But reasonably illuminating one’s own property or an adjacent public area such as a public street, particularly where there is a history of unsavory conduct, is generally acceptable. A property owner may also install video security cameras about his or her own property. The cameras should be installed so that they are visible so that people can see that they are being video recorded. The owner, however, cannot use video cameras to record in such a manner that intrudes on a person’s reasonable expectation of privacy. An example of this might be directing a camera toward a neighbor’s bedroom window. But recording a common area or a public area, such as a street, is generally permissible since a person typically does not have a reasonable expectation of privacy in those areas. —STEVE WILLIAMS RH

EBRHA Launches New Green Committee East Bay Rental Housing Association because they want to get it right. Our members also have a keen interest in energy efficiency, conservation and green building. To address this interest, EBRHA is excited to announce the formation of the Green Committee. MISSION STATEMENT: EBRHA’s Green Committee provides guidance to our landlord and property manager members, partners, and local municipalities on how to implement green practices and trends in the multifamily sector through the sharing of sustainability information, strategies and tools. GOALS: 1) Help members improve their bottom line by adopting green building best practices; 2) Show members how to operate and maintain property that is compliant with green building laws; 3) Offer local municipalities and agencies insights on how to incentivize landlords to implement green building solutions. LANDLORDS AND PROPERTY MANAGERS JOIN
Background The Green Committee provides resources and information in our print and digital publications, as well as through our educational programs. We also offer promotions with vendors and partner organizations, like PG&E, StopWaste.org, EBMUD and Waste Management. Issues addressed by the Green Committee include water and energy efficiency, indoor air quality, green renovation and construction, recycling, green turnover practices, waste disposal and reduction, blight, landscaping, and California’s emerging mandatory green building and energy codes. Green building is a defining characteristic of good building design and efficient building operation. It is in our members’ interest as property owners and property managers to have the knowledge, strategies and tools to 34 RENTAL HOUSING

create and maintain well-performing green investments — a performance that goes beyond a stable cash flow in the short term and makes steps to encompass return on investment for the duration of the building ownership or operation. Oakland RENT ADJUSTMENT PROGRAM FEE
Annual fees are $30 per unit and are due March 1. Owners are allowed to pass through $15 to tenants. BUSINESS TAXES & REGISTRATION
Registration fee is $60 and is due March 1. Tax is based on annual gross rental income at a rate of $13.95 per $1,000 of gross rental income. Tax renewal declarations are mailed at the beginning of the year. LANDLORD PETITION FOR EXEMPTIONS
Claims covered include new construction, substantial rehabilitation, and single-family homes or condominiums.
ANNUAL ALLOWABLE RENT INCREASE
2013-14 (2.1%) A CPI increase of 2.1% became effective on July 1, 2013. Tenants may only receive one increase in any 12-month period, and the rent increase cannot take effect earlier than the tenant’s anniversary date. In addition, California law requires that for tenancies receiving greater than a 10% increase, a 60-day notice is required; if the increase is 10% or less, a 30-day notice is required. Owners can only impose “banked” rent increases equal to three times the current annual allowable rent increase rate. See schedule at right.
