RON KINGSTON Ron Kingston is the EBRHA state lobbyist and president of the California Political Consulting Group. Ron’s accomplishments are well recognized in the state of California as a result of a deep knowledge of historical, political, functional and technical aspects of the law. Ron has worked as a lobbyist for almost 30 years during which he has represented clients before Democratic and Republican Legislatures. He has carefully cultivated excellent relationships with the members of the Legislature. He is a personable, highly respected, and very knowledgeable lobbyist who has written 89 bills, with an enactment success rate of 94%. All but a handful of bills, including credit access and disclosure legislation ultimately became law both at the State and Federal level.

MATTHEW QUIRING Matthew Quiring graduated from the University of California, Berkeley with a degree in psychology, and received his law degree from the University of California, Davis School of Law in 2008. Prior to joining Fried & Williams in 2014, Matthew was in private practice in Berkeley with over five years of experience resolving and litigating landlord-tenant disputes in Alameda County.

WORKING WITH RENTAL PROPERTY OWNERS

More so than any other nonprofit in the region, Abode Services possesses the necessary expertise to achieve permanent housing outcomes in the Bay Area rental market. We work directly with rental property owners to open up the market to families and individuals experiencing homelessness in Alameda, Napa, San Mateo, and Santa Clara Counties. We couple our rental assistance with intensive services to keep hundreds of households stably housed. This strategy is a major piece in our evidence-based Housing First approach that works to end cycles of homelessness, not simply manage it.

We partner with community rental property owners to create a situation that benefits everyone involved. In return for providing units of housing, we offer rental property owners a range of services and incentives, including: n Free assistance finding and screening tenants who seek long-term housing n On-time payments every month n On-call and assigned Abode Services staff to respond to rental property owners’ concerns n Higher security deposits that meet rental property owners’ needs n Free inspections to keep units up-to-date with Housing Quality Standards We work with our participants on being responsible tenants as well as building financial and personal stability to maintain their housing.

Reminder: Bed Bug Disclosure Requirements

RSVP Now: EBRHA’s New Laws for 2018 Presentation will present information on the extensive housing laws that go into effect in 2018. The presentation will take place at EBRHA’s Member Meeting on Saturday, January 20 from 10am Noon. This year, EBRHA’s lobbying team identified 135 rental property-related legislative bills and four significant housing discrimination regulations. Several top priority bills were signed into law, but not before they were amended to address many of our rental property concerns. Ron Kingston will discuss residential rental housing-related bills that were signed into law in 2017, most of which will go into effect in 2018. In addition, he will discuss the statewide proposal to repeal CostaHawkins, which would be catastrophic for the State of California. For the past year, EBRHA has posted reminders about the new Bed Bug disclosure requirements in California. As a reminder, under the new California laws that became effective in 2017 and 2018, owners will have the following new duties and responsibilities regarding bed bug disclosures: Starting July 1, 2017 an owner shall provide to all new tenants with written notice in at least 10-point font containing the educational information about bed bugs; the procedure to report suspected infestations to the owner; and a statement that the tenant shall cooperate with the inspection and facilitate the detection and treatment of bed bugs. If an owner did not enact new tenancies, the written notice must also be provided to existing tenants by January 1, 2018. EBRHA members can access this form via www.ebrha.com under the “Members”section. Berkeley Annual General Adjustment is 2.3% Each year, the Berkeley Rent Board passes an Annual General Adjustment (AGA), which allows rental property owners to raise the rents for all rental units covered by the Berkeley Rent Ordinance for which the owner did not establish an initial rent during the prior calendar year. The 2018 AGA in Berkeley is 2.3%. An owner is not eligible to take the AGA if the property is not properly registered with the Rent Board, or if there is an order from the Rent Board denying AGAs (generally due to a decrease in services or substandard conditions). If owners are unsure whether they can raise their tenant’s rent by the AGA, call a Berkeley Housing Counselor at 510-981-7368. RH

he East Bay Rental Housing Association is governed by a Board of Directors, consisting of independent rental property owners and executives from property management firms who are elected by the general membership. The Board is responsible for supporting the Executive Director, ensuring effective organizational planning, enhancing EBRHA’s public image, monitoring legal and ethical compliance, as well as other important tasks. EBRHA is excited to welcome Jacqueline Jacobs, Arcola Moore and Joshua Polston to our Board of Directors. We are confident they will be a great asset to the Board and will help the Association grow. Below are some of the responses they provided in their Board of Directors application:

JACQUELINE JACOBS Jacqueline has been an EBRHA member since 1995, attending meetings, workshops and annual events regularly. In addition, she has been vocal about the issues she faces as a small rental housing owner at Oakland council meetings. She has also appeared before the Rent Board for a petition hearing. Prior to joining the EBRHA Board of Directors, she held leadership roles in many church and civic organizations. She describes herself as a leader, team player, independent thinker and liberal. IN WHAT AREAS OF THE HOUSING INDUSTRY ARE YOU INTERESTED? Fairness and honest interaction between the City

and property owners. Consistent information regarding new laws and how to navigate them. [I’m interested in seeing] better workshop presenters who have concrete answers to property owners’ ebrha.com

WHAT IS YOUR FAVORITE THING ABOUT LIVING OR WORKING IN THE EAST BAY?

ARCOLA MOORE

Arcola has been an EBRHA member for 6 years and has regularly attended meetings, workshops and annual events. She also volunteered to help with preparation of the 2016 NAA Expo in San Francisco. She owns and manages 33 units in Oakland and Berkeley. Her grandparents built the units in the 1960s and they have remained family-run ever since. “My grandparents wanted to help African Americans who were red-lined and refused credit back in the ‘60s—people who had a hard time finding a decent place to live,” she says.

WHAT ARE YOUR GOALS FOR EBRHA? To be more vocal

Obviously, to be a voice for other property owners and participate in the strategies we develop to work towards resolving and minimizing the housing problems in the East Bay. I’d like to assist property owners with running their small businesses so they can provide adequate, safe and affordable housing. WHAT IS YOUR FAVORITE EASY BAY RESTAURANT OR COFFEE SHOP? I really don’t have a favorite. I like to experi-

ence all types of eateries, as there so many new ones in Oakland. I am a tea drinker, and I go to Peet’s sometimes.

WHAT ARE YOUR GOALS FOR EBRHA? To reach out to

the public and create a dialog of how rent control laws are not being enforced. It’s not just in the owners’ best interest, but it hurts tenants as well. As an example, if we cannot afford to maintain our properties because of low rents, we lose the property. Whoever buys and builds on [these properties] will no longer house the tenants that these laws were created to help. So it’s a loss for small businesses and the consumer. WHAT QUALIFICATIONS WOULD YOU BRING TO THE BOARD WHICH WOULD BENEFIT EBRHA? I have a B.A.

in political science. I have participated in city council meetings in Oakland. I worked with AmeriCorps, so I am fairly knowledgeable about grassroots campaigning to reach a desired goal, which works great in East Bay cities. WHY DO YOU WANT TO PARTICIPATE AS A DIRECTOR?

WHAT IS YOUR FAVORITE OUTDOOR ACTIVITY IN THE EAST BAY? I enjoy Farmer’s Markets and outdoor music

events. I also enjoy walking around Lake Merritt and living a healthy lifestyle. 20 RENTAL HOUSING

difficult in the Bay Area and Bay Area rental property owners are under constant assault from over-reaching and misguided city council members who are driven more by emotion than rational thought. The need for the East Bay Rental Housing Association is clear, as the forces arrayed against local rental owners are quite powerful and have the ear of many of the local politicians. WHAT QUALIFICATIONS WOULD YOU BRING TO THE BOARD WHICH WOULD BENEFIT EBRHA? My

background is in environmental planning economics and city planning. I have worked as a consultant doing land use economic analysis for a number of years and now work as a project manager for large capital projects. In addition, I also have an interest in teaching and currently teach economics part-time at Laney College here in Oakland. I have been a bootstrap rental owner for the past eight years, essentially assembling my own properties, managing them, and learning along the way. WHY DO YOU WANT TO PARTICIPATE AS A DIRECTOR? I believe the

work that the East Bay Housing Association does is very important and would like to work towards protecting the interests of small rental property owners here in the East Bay. I also am interested in doing more networking and finding about more up-to-date activities and opportunities in real estate locally. WHAT IS YOUR FAVORITE EASY BAY RESTAURANT OR COFFEE SHOP?

My favorite restaurant is Lucky House Thai cuisine at the very top of University Avenue in Berkeley. It is not much to look at and the interior is rather drab, but they do have an excellent shredded green papaya salad that is worth coming back for. Probably what makes it stand out most in my mind is really the nostalgia. It was the first restaurant that we went to when we first had young children because they would put up with the screaming and yelling and never gave us any trouble. To avoid such confusion, either in court, or just between owner and tenant, it is good practice to update leases with tenants whenever a change is necessary, either to codify an existing practice not mentioned in the lease, or clarify a change in practice from how it was originally stated in the lease. This is done through a “Notice of Change in Terms of Tenancy”, delivered to the tenant, which clearly sets forth what the change is, and when it becomes effective.
