contributors JILL BROADHURST As EBRHA’s Executive Director, Jill is responsible for the strategic goals of the organization, including the financial health, membership growth, education curriculum and service options. Jill began her work with EBRHA as the Community Affairs and Advocacy Director back in 2010. At a very young age, Jill was introduced to property management and ownership through her immigrant parents. It is from this very personal story that she is able to provide balance and clarity in representing the diverse make-up of property owners.
GREG BROWN As Senior Vice President of Government Affairs for the National Apartment Association, Greg Brown directs all of the advocacy efforts for the federation of 170 affiliated apartment associations around the United States, representing 68,000 members and 7.8 million rental homes. He leads a team of eight professionals to implement a comprehensive strategy of federal, state and local advocacy, political engagement and tactical communications. He also counsels NAA leaders and senior staff, as well as affiliates and their members, on policy and political matters, manages a $2+ million annual budget, and represents the Association on Capitol Hill and in front of Executive Branch agencies.
STEVE WILLIAMS Steve Williams of Fried & Williams LLP received his bachelor’s degree in Law and Society from the University of California, Santa Barbara. He received his law degree from Golden Gate University. He has been representing property owners in the Bay Area since passing the California bar exam in 1999. Steve’s experience includes counseling property owners in many areas of the law, including landlord/tenant, co-ownership and neighbor disputes, and purchase/sales transactions.
ANGIE WATSON-HAJJEM Angie Watson-Hajjem is the Fair Housing Coordinator for ECHO Housing, a nonprofit housing counseling agency. Angie investigates housing discrimination cases and provides counseling, mediation, and fair housing education to members of the rental housing industry, tenants and the community at large.

TRASH & RECYCLING RATES GOING UP AGAIN! A year after hitting owners with trash and recycling fee increases of as much as 500%, the City of Oakland has agreed to ANOTHER hike that will PUNISH property owners even more! For 1-4 Unit Buildings • Curbside and backyard compost collection — increasing more than 7% • Curbside recycling collection — new separate fee of $12.56 per cart • 2-4 units: Per-unit surcharge — increasing 19% • Single-family home curbside and backyard trash collection — increasing 8-10% • Contamination fees — $25-$50 per incident For 5+ Unit Buildings • Trash and compost rates — increasing more than 7% • Curbside recycling rates — increasing nearly 20% • Push/pull fees — increasing 5% • StopWaste Benchmark fee increasing • Contamination fees — $25-$50 per incident The City approved more outrageous increases, proving once again that they don’t care about the rights of property owners! Before signing this unfair deal, city officials said that rate increases under the new contract would not exceed 40%. Instead, more than two-thirds of EBRHA members surveyed saw hikes of 40-100%, and a third saw increases of 101-525%! In response, EBRHA filed a landmark lawsuit in June to expose the increases as an illegal tax. The lawsuit also calls into question the $30 million dollar annual franchise fee that the City collects. In order to win this case, the EBRHA Legal Fund must be wellfunded, as it is common practice for cities to use legal tactics that prolong a case in order to deplete the plaintiff’s resources. EBRHA estimates that this will affect 1,500 units • The Rent Board will supposedly have more transparency and reporting requirements • Substantial rehabilitation has more restrictive requirements This ballot measure is in addition to proposed ordinance changes to capital improvement pass-throughs, owneroccupied exemptions, and more. increase to the Rent Adjustment Program (RAP) fee, from $30 to $68 in spite of opposition from property owners and renters. EBRHA’s suggestion was a one-time time increase of $30 to a total $60 for 2017, paid in one lump sum. This would have been a doubling of the rent board fee and would have been an easy figure to deal with. Renter support groups also supported this. However, the outcome at the July 19 meeting was a $68 fee beginning in 2017. After all councilmembers heard a unified voice from the audience on a one-time $30 increase, Vice Mayor Annie Campbell-Washington offered a substitute motion to raise the fee to $68, completely disregarding the public sentiments. All councilmembers approved except Kaplan and Gallo. Renters will still be obligated to pay half. EBRHA is encouraging rental property owners to demand the following at upcoming council meetings: 1) If neither resident nor rental property owner pay the annual fee, they are not entitled to file a petition; and 2) An enforceable form should be available to owners for resident collection of half of the RAP fee (should the rental property owner decide to collect). Not all owners collect their current share of the fee ($15), but with fees more than doubling, this will likely change. EBRHA thanks all members who fought the RAP fee increase at meetings and by calling council members.
Initiative to Ban Rent Control in Alameda Fails to Qualify for November Ballot An initiative pushed by Alameda property owners to prevent rent
control in Alameda will not appear on the November ballot. This was confirmed after the Alameda County Registrar of

Voters determined the petition was not sufficient using a random sample check of the signatures. A complete check will now be done to verify whether or not the petition could qualify, according to Alameda’s City Clerk. However, performing the complete check means the initiative will not appear in the November ballot. On June 14, members of the Alameda Community Preservation Coalition submitted more than 1,600 petitions with a total of 7,491 signatures to the Alameda City Clerk for the Alameda Homeowner & Private Property Rights Act. The initiative would have amended the City Charter so that property owners have “the exclusive right to establish the price for which that property may be sold, leased, rented, transferred or exchanged.” Campaigners needed valid signatures from 15% of Alameda’s registered voters. The initiative could still appear on a ballot sometime after November. According to its website, The Alameda Community Preservation Coalition is a group of more than 100 local homeowners, business owners, and housing providers who care about Alameda. Just a few weeks prior, another initiative that calls for rent control in Alameda qualified for the ballot on July 6. The Alameda Renter Protection and Community Stabilization Charter Amendment would amend the City Charter so that rent increases are capped at 65% of inflation and the city has an elected rent board. The initiative also calls for an end to no-cause evictions and for landlords to provide tenants with financial help for moving under some circumstances. The Alameda Renters Coalition, a volunteer group, gathered 7,881 signatures for the proposed amendment. The coalition’s effort to put rent control before voters follows the City Council passing an ordinance in March that limits the number of rent increases that a landlord can impose to once a year. tenant lawyers, City Council wants to impose even higher fees and add further restrictions that would make it impossible for owners to make affordable capital improvements to their properties. A tenant-supported ballot measure also under consideration would likely be the last straw for many owners already living on ultra-thin margins. If Oakland lawmakers are truly serious about wanting to protect the city’s diversity, they need to recognize the rights of all city residents. It’s time the City Council celebrated the melting pot and stop punishing Oakland’s small rental property owners for a crisis they didn’t create. RH

initiatives will have no impact on the availability or affordability of housing in Oakland, and that limiting opportunities to invest in real estate and improve Oakland properties is going to lead to a deteriorating housing stock – which will benefit no one. I am also concerned that the media and renter advocates characterize rental owners as being greedy, immoral individuals who just wait to cash rent checks and evict low-rent renters, while renters are innocent victims. In truth, there are good and bad owners, and good and bad renters. My husband and I have jobs and ALSO manage rental property. We didn’t inherit them, we invested fairly recently to help fund college for our three kids and our eventual retirement. We invest time and money maintaining our properties and work hard to be responsive and respectful to our renters.What we really need is more enforcement of the existing rules, including prosecution of property owners who conduct illegal evictions or don’t abide by the current rent control laws and the same for renters who don’t pay rent, damage property, or create a nuisance. I support the rent control
rules that were in place five years ago, but the proposals to limit rent increases to just CPI are unsustainable and the math just doesn’t work. How can a property owner afford to pay for the rising cost of housing services like garbage and utilities, increasing assessments and taxes, and capital improvements, when no increases above CPI can be passed along to renters? Further constraining the existing rent control rules is going to make it impossible for us to stay in business. And if we go out of business and a developer takes over and constructs a new building that isn’t subject to rent control, how will that improve affordability? WHAT IS THE MOST DIFFICULT PART ABOUT BEING A PROPERTY OWNER IN THE CITY? The City Coun-
cil and Rent Board and courts have a bias towards renters, and are creating a situation that is imbalanced and unsustainable. Property owners are small businesses that deserve city support. There is too much political misinformation about how tightening rent control is going to improve outcomes for those that need affordable housing, which is simply untrue. Many rent control properties are not occupied by people who need this form of subsidy, but by those who have realized the financial benefit of staying in place. The focus should be on increasing the supply of housing available. ANY OTHER COMMENTS? This situation is a crisis.
Affordability, housing supply, and rent control are serious issues that require careful and balanced consideration by all parties involved, rather than political promises that will promote certain election results but no real change. I hope our City leaders take a long view of the impact of these proposed measures and avoid creating bigger problems for the future. RH

Fair Access to Housing
Department of Fair Employment and Housing (DFEH) generally administers State fair housing laws. Oakland Law The City of Oakland has its own laws governing discrimination. Oakland law adds the following class of persons to the list of protected classes: (20) persons with AIDS It further broadly defines housing units as follows “all dwelling units, efficiency units, guest rooms, and suites in the city as defined by other city enactments, rented or offered for rent for living or dwelling purposes, the land and buildings appurtenant thereto, and all housing services, privileges, furnishings, and facilities supplied in connection with the use or occupancy thereof, including garage and parking facilities.” Examples of Discrimination With Federal, State, and Local laws prohibiting housing discrimination, there are multiple layers of laws and protections, many of which may overlap. A property owner and manager must comply with all layers of fair housing laws. So for instance, an owner may comply with Federal fair housing law while at the same time violating State or Local fair housing laws. Such conduct could subject the property owner to liability. Here are some examples of potential housing discrimination: 1. Failure to Accommodate Disability SCENARIO: The rental owner has a no pet provision in the rental agreement. The tenant informs the owner that the tenant suffers from depression and would like to have a dog in order to alleviate the effects of the depression. The owner simply denies the request and cites the no pet provision in the rental agreement as the basis for denial. LAW: It is unlawful for a rental owner to refuse to make reasonable accommodations in rules, policies, practices, or services, when such accommodations may be necessary to afford a disabled tenant an equal opportunity to use and enjoy a rental unit. Depression would typically be a qualifying disability. So it
may be considered discrimination against a person with a disability to categorically deny the request by refusing to make a change in the no pet policy. 2. Improper Apartment Listing SCENARIO: The rental owner posts a public listing to rent a tiny studio apartment and in the listing states that the apartment is “suitable for a single tenant.” LAW: If the owner’s listing has the effect or impact of discouraging a protected class of persons from applying for housing, then it may be discriminatory. So the listing may be considered discriminatory since it may discourage or preclude persons with families or married persons from applying. 3. Perception and Association SCENERIO: A tenant in an apartment complex is shot and injured by another tenant in the complex. The injured tenant sued the owner accusing the owner of being negligent because the owner rented to the offending tenant even though the offending tenant appeared to be a gang member or associated with gang members. In short, the injured tenant argued that the owner should have never rented to the offending tenant based on the offending tenant’s appearance and that the injury could have been avoided. LAW: The court disagreed with the injured tenant and reasoned that refusing to rent to someone simply because that person seemed to be in a gang, or whose family might have gang connections, would have been discriminatory.
4. Family Day Care SCENERIO: An owner includes a provision in the rental agreement prohibiting the tenant from operating a family day care. When the tenant notifies the owner that the tenant intends to operate a licensed day, the owner refuses based on the prohibition in the rental agreement and threatens to evict the tenant. LAW: Provisions in rental agreement prohibiting a tenant from operating a day care in the unit is unenforceable. A tenant is generally entitled to operate a licensed day care within a rental unit. The owner generally cannot evict or prevent a tenant from doing so. Liabilities for Discrimination A property owner who discriminates in housing may be subject to various forms of liability. The owner may be liable not only to the person discriminated against, but to the government for violating applicable laws. Such liability may include fines and penalties, compensation to the person discriminated against, cease and desist orders, payment of the other sides attorneys’ fees and costs, etc. In short, there may be very costly consequences for discrimination. So it is imperative for any housing provider to know and comply with all applicable housing laws, including Federal, State, and Local laws. Tips for Keeping Your Senior Residents Safe in Their Homes GIVEN A CHOICE BETWEEN NURSING HOME CARE AND STAYING AT HOME, most aging seniors enjoy the independence that comes with living at home. That can often be a challenge, especially if their health is not as good as it once was. But with a few modifications, family caregivers can keep their loved ones living at home safely and happily. Below are tips to help keep your senior tenants safe, healthy and happy. PREVENT FALLS AND INJURY • Remove loose carpet or throw rugs, and unneeded items like plant stands and end tables that could be obstacles to mobility. • Keep paths clear of electrical cords, oxygen tubing, and clutter. • Use night-lights in hallways, bathrooms, and stairways. • Place bedside lamps within easy reach. • Make sure they wear well-fitting shoes with good support and low heels, and non-slip soles. • If they use a walker or cane, put rubber tips on it, keep it in good repair and close at hand. • Tennis balls on walker front feet help them slide easily. • Remind them to always use handrails when using stairs. • Tell them to always go up the stairs with their “good” foot first and down with their “bad” foot first. • Make sure there are two secure rails, one on each side of the stairs. • Test for safe mobility by using the cane/walker/ wheelchair yourself. • Many medications can cause drowsiness or dizziness (e.g., meds for pain, cough, sleep, blood pressure, allergies). Know what meds they take and the side effects. • Consider purchasing a medical alert system, such as Lifeline. SAFEGUARD SENIORS WITH HOME MODIFICATIONS • Install smoke alarms outside every bedroom and check the batteries regularly. • Install a carbon monoxide detector that sounds an alarm. • Install an alarm that goes off if a pot on the stove is left unattended for too long. • Install grab handles in the shower, toilet, entryway, and anywhere without handrails. • Place non-skid mats inside and outside the shower or tub and near the toilet and sinks. • Use shower chairs and bath benches. • Store flashlights in an easy-to-find place and make sure the batteries work. Crank or solarcharged flashlights are great. • Make sure entrance areas are safe – install ramps and handrails, repair any loose steps or floorboards. RH

Tips for Sharing With Your Senior Renters MAKE DAILY ACTIVITIES SIMPLER • Store household items on lower shelves so they can be easily reached. • Purchase a phone and cell phone with large numbers and a speaker. • Clothing that fastens with Velcro can be a big help for arthritic fingers. • Use a long-handled brush or mittens with straps to help with bathing. • Keep jar openers handy. • Pre-load a week’s worth of doses in a plastic container with compartments for each day/dose. MAKE NEW FRIENDS AND KEEP SEEING THE OLD ONES, TOO As we lose people in our circle, it is vital to make new connections so the circle of friends doesn’t dwindle. • Look for classes, social groups, and activities at senior centers, adult schools, and churches. • Some cities have a “senior center without walls” where you can participate in activities via phone or with Internet resources. • Learn to use Facebook to chat and stay in touch. • Use Skype for virtual visits with family and friends. • Intergenerational relationships can be extremely beneficial. Young people can re-energize you and help you see life from a fresh perspective. Many schools, churches, and cities have friendly visitor programs. EAT WELL & KEEP MOVING Combined with physical activity, eating nutritious foods in the right amounts will help maintain health. • Eat plenty of vegetables, fruits, and whole grains. • If shopping for fresh produce is difficult, consider an organic veggie delivery service (“farm box”) that lets you choose foods you like and will eat. Some grocery stores offer delivery, too. • Many illnesses, such as heart disease, obesity, high blood pressure, type 2 diabetes, and osteoporosis, can be prevented or controlled with dietary changes and exercise. • Calcium and vitamin D supplements can help women prevent osteoporosis. • Do something to stay fit each day. Activities like walking, swimming, line dancing, yoga, and tai chi help maintain strength, balance, and flexibility and promote cardiovascular health. • Many senior centers have group exercise programs. Yoga instructors may offer “chair yoga” or “gentle yoga” classes. • Physical activity helps maintain a healthy weight, prevent or control illness, sleep better, reduce stress, avoid falls, and look and feel better.

ousing providers have an obligation to ensure that all persons have access to the housing of their choice. Housing providers can use criteria like income, credit and rental history to determine if an applicant qualifies for housing. Fair housing law prohibits denying an applicant housing based on race, national origin, religion, familial status, disability, among several other classes.
Tenant Selection
As a property owner or manager, you want to pick a qualified tenant. You want to choose a tenant that will pay her rent on time, take care of the property and be a good, conscientious neighbor. In making your selection, be careful with the language you use and the policies you enact. Let’s start with advertising. It’s important not to state preferences in the advertising. For example don’t put language in the ad like, “Perfect for empty nesters” or “Great place for single, professional person.” Talk about the property you are trying the rent, not about the kind of person you want to attract. Stick with the basics: “Large one bedroom, bay windows, backyard” or “Two bedroom, one bath, with large sunny kitchen, near transportation.” Here you are just giving a description of your property and that is perfectly fine.
Avoiding Discrimination
Once an interested person contacts you about your rental, be careful to not ask discriminatory questions. You can ask how many people
will be living in the rental, but don’t ask questions like, “How many kids do you have.” Never ask questions about a person’s age, race or marital status. You are allowed to ask the applicant questions that will help you determine if they can pay the rent and be a good tenant. It is critical to conduct a credit check on each applicant and get previous rental housing provider references as well. You are allowed to ask for verification of income. Just remember that some applicants have income not from employment but other sources like Social Security, Disability, child support, alimony. You can’t deny someone housing based on the source of their income. You can require them to meet your income guideline.
Open Houses
More property owners and managers are holding open houses to advertise their rental properties. This can be a great way to get more people to see what you have to offer in less time. It is common in this red hot Bay Area rental market to have a couple dozen people come out to an open house. Tell interested parties that applications are viewed on a first come, first serve basis. You might want to put a time stamp on the application and then process them in the order that they arrived. Once you find the applicant that meets your basic criteria, you should offer that applicant the housing. You should not wait around in hopes that an even better applicant comes along. A Note from NAA Regarding Occupancy Standards
explain why they did not qualify. If they paid for a credit check and were denied, the applicant should either be given a free copy of their credit report or told where to get their free copy.
Occupancy Standards
THE “KEATING MEMO” The two-persons per bedroom maximum occupancy policy is a standard utilized widely by apartment owner-operators in accordance with HUD’s standard of policy established in the so-called Keating Memo issued in December 1998. According the memo, a two-persons per bedroom rule is acceptable with some limited exceptions in light of other relevant factors (for example, two adult parents with an infant child should be allowed to rent a large one-bedroom). This recent complaint states that such a policy is unreasonable and both excludes and limits the number of families with children who can live at the owner’s properties thus discriminating against families with children. The complaint suggests that owners should use local building or zoning codes to develop a policy on the basis of square footage and accounts for the entire livable space in the unit. Alternatively, the complaint suggests that owners rely on the International Property Maintenance Code which would allow up to eight people in a two-bedroom unit measuring at 1100 square feet. NEXT STEPS FOR NAA & EBRHA MEMBERS NAA and EBRHA members are strongly encouraged to review their occupancy standard policies with an attorney to ensure they are in compliance with fair housing laws. To help in that review process, please refer to the guidance document issued earlier this year by NAA and the National Multifamily Housing Council: Fair Housing: Familial Status and Occupancy (available at http://iz3.me/fL6D3z8oaCB1). This document contains a review of the law, recent litigation specifically targeting familial status and occupancy restrictions and suggests best practices for proper compliance. There are many questions that can arise in renting housing to the public. It is important that everyone in the rental housing industry have a solid understanding of fair housing and rental laws to ensure that all persons have equal access to housing opportunities. IN JULY, a fair housing complaint was filed against an NAA member company that operates properties in several states. The complaint questions the member’s occupancy standards, alleging discrimination on the basis of familial status. It specifically targets the policy restricting occupancy to two-persons per bedroom. We anticipate that this is the leading edge of a trend in fair housing litigation.
Many owners and managers have questions about how many people should be allowed to live in a rental. There is no law around occupancy limits in rental housing; however there is a guideline called the 2 plus 1 occupancy guideline. What this guideline states is that for every bedroom, two people should be allowed, plus one extra one for the whole unit. So, for a one bedroom, three people should be allowed to rent. For a two bedroom unit, the owner or manager should allow five people. Although the 2 plus 1 guideline is just a guideline, the Department of Fair Employment and Housing will open up a fair housing investigation for a guideline more restrictive than 2 plus 1. The 2 plus 1 occupancy guideline is a safe harbor and housing providers are strongly encouraged to use it.

We need to open a tenant’s closet wall to fix a leaking water pipe. Please advise on action when the tenant refuses to empty his closet. Our tenant claims that the items are too big and heavy for him to move, and wants us to pay costs to empty and restack the personal items following repair.

During roof renovation to fix a leak in the attic, it was discovered that the tenant was storing rifles in the attic. One of the rifles was propped up against the heater in the attic and got wet. The tenant now wants us to pay to repair or replace the gun. What is the owner’s responsibility in this matter?

Annual fees are $30 per unit and are due March 1. Owners are allowed to pass through $15 to tenants. BUSINESS TAXES & REGISTRATION
Registration fee is $60 and is due March 1. Tax is based on annual gross rental income at a rate of $13.95 per $1,000 of gross rental income. Tax renewal declarations are mailed at the beginning of the year. LANDLORD PETITION FOR EXEMPTIONS
Claims covered include new construction, substantial rehabilitation, and single-family homes or condominiums.

2016-17 (2.0%) A CPI increase of 2.0% becomes effective on July 1, 2016. Tenants may only receive one increase in any 12-month period, and the rent increase cannot take effect earlier than the tenant’s anniversary date. In addition, California law requires that for tenancies receiving greater than a 10% increase, a 60-day notice is required; if the increase is 10% or less, a 30-day notice is required.
