A FAREWELL FROM EBRHA EXECUTIVE DIRECTOR JILL BROADHURST EBRHA members: It is with mixed emotions that I announce I have ended my tenure as Executive Director for the East Bay Rental Housing Association. It has been such a rewarding experience, one that has been so very personal to me. It has been a pleasure partnering with you over the last seven years. EBRHA is a needed resource and valuable advocacy asset for rental property owners. Our continued participation is critical to the organization’s success and voice. Although the work never seems to end, especially in California and the Bay Area, we have accomplished so much together. We have made a difference! EBRHA’s team of staff members, whom I am so very proud of, are dedicated to serving you and will continue to run the organization with the same loyalty and superb customer service as always. During my time at EBRHA, I am especially proud of: • Working with members, often one-on-one, with their specific management concerns • Representing membership on policy issues, in front of local and state officials • Enhancing and updating EBRHA’s education curriculum, including monthly roundtables • Restoring and surpassing financial expectations of the organization • Launching an enhanced web site with continuous technology updates • Creating EBRHA on Your Side as a communication tool between members and staff • Organizing social mixers and creating an annual economic and legislative forum breakfast My last day as Executive Director was Friday, September 22nd. Union City Rent Review Ordinance Effective October 2; New Rental Property Fees Effective November 1 the City Council of Union City adopted two new residential rental property fees. The fees will be used to cover the City’s cost to administer the recently adopted Rent Review and Eviction Protection Ordinances. Effective November 1, 2017, all property owners with rental units in Union City that are subject to the Eviction Protection Ordinance and/or the Rent Review Ordinance must pay the annual fees listed below. The fees are due at the time a property owner applies for a new residential rental business license or renews an existing business license. The Rent Review Ordinance Fee is $21.50 per rental unit, and the Eviction Protection Ordinance Fee is $10 per rental unit. For questions regarding the business license application/ renewal process, rental owners can contact the City’s Revenue Division at 510-675-5312. As a reminder, the City Council of Union City approved an ordinance in June that adds Chapter 5.55 “Rent Review” to the City’s municipal code. The ordinance regulates most residential rental units in Union City and provides a mediation process for qualifying rent increases. Renters will have the right to request non-binding mediation when: a renter receives a rent increases over 7% OR a renter receives two or more rent increases in a 12-month period and the total of all rent increases exceeds 7% in the 12-month period. Rental owner participation ON SEPTEMBER 12,

in the mediation process is mandatory; however, all recommendations are nonbinding. Rental owners are required to notify tenants of their rights when issuing a rent increase on or after October 2, 2017. The full ordinance and additional information can be found at the following link: www.unioncity. org/rent-requirements. The City will be holding two informational meetings on the Rent Review Ordinance that are open to the public. Both meetings will cover the same information. The dates and times are as follows: Wednesday, October 18 from 7:00 to 8:00 p.m. and Thursday, November 16 from 10:30 to 11:30 a.m. Both meetings will be held at City Council Chambers, 34009 Alvarado-Niles Road in Union City. Rental owners can RSVP at housing@ unioncity.org. General questions about the ordinance can be directed to the Rent Review Program Administrator at 1-855-275-3246 or unioncityrentreview@echofairhousing.org.
Notice of New Annual General Adjustment (AGA) in Richmond The Richmond Rent Board has deter-
mined the 2017 Annual General Adjustment (AGA) rent increase for controlled rental units is 3.4%. Effective September 1, 2017, the maximum allowable rent for tenancies in effect prior to September 1, 2016, may be increased by 3.4%. To apply the 2017 AGA rent increase of 3.4%, rental property owners must not only comply with state law requirements, but also file a notice of rent increase with the Rent Board before service on the tenant, in accordance with the rent increase procedure. Rent increases may not take effect prior to September 1, 2017. What if I never applied the 2016 Annual General Adjustment? Rental property owners with tenancies in effect prior to September 1, 2015, who did not apply the 2016 AGA, may apply a combined 2016 and 2017 AGA rent increase of up to 6.56%, based

on the rent in effect on July 21, 2015, or the first time the tenant paid rent after July 21, 2015 but before September 1, 2015. Rental owners must follow the rent increase procedure specified on the Rent Board website. What’s the Annual General Adjustment? The AGA is an annual rent increase adjustment allowed by the Richmond Fair Rent, Just Cause for Eviction, and Homeowner Protection Ordinance. The AGA is calculated based on the percentage change in the Consumer Price Index (CPI). City of Alameda Repeals its Just Cause Ordinance at Tenants’ Request The Alameda City Council removed a provision in the city’s rent ordinance that establishes Just Cause for Eviction rules. The City Council rescinded the provision in early September, forgoing the option to put the issue on an upcoming ballot after Alameda County officials validated enough signatures on a property owners’ petition. Property owners say they submitted the petition from the city’s registered voters asking for the “nocause” provision’s removal because it was not part of the ordinance when voters approved it in November 2016. Property owners argued the Just Cause provision limited their ability to manage their properties and get a good return on their investment. The removal of the provision also came after tenant advocates asked the council to pull the ordinance, which was added to the ordinance in June as part of an annual review. Thousands of Oakland apartments will be added, lowering asking rents for everyone. Builders will return to Oakland to add housing as soon as it is clear that city officials are serious about solving the housing shortage instead of just playing politics with it. We urge Oakland leaders to take a fresh look at the rent laws in light of the same laws of economic science the Mayor and most of the housing community now embrace. There is no “controlling” rent. There is only a mandated direct subsidy from the small owners of Oakland to all tenants, regardless of need, based only on how long someone stays in the apartment. Why does Oakland still force small owners to subsidize middle-class tenants, even wealthy “techies”? Carefully phasing out rent laws will increase the housing supply in Oakland and correct this decades-old injustice. If justice is truly blind in Oakland, this should be a matter of policy instead of politics. The science is there. If you own rental housing and can see these issues on your property, call and email the Mayor and Councilmembers and explain your situation to them in personal terms. Explain your limited financial situation and the unfairness of forcing you to subsidize middle-class tenants for life. Write us to record your story and your efforts and the reactions you get. I
n the coastal cities of California, the declining affordability of housing has been a source of universal exasperation for decades. Recently, new legislation was passed at the local and state levels aiming to encourage the construction of secondary units—also known as Accessory Dwelling Units (ADUs)—as a way to grow the housing supply. For property owners and renters in the Bay Area, this opens up new opportunities to generate rental income or create flexible housing arrangements for extended family, while simultaneously adding to the region’s housing supply.
Mitigating the Housing Shortage with ADUs
The increase in housing prices has been driven by the strong draw of California’s natural amenities and economy, coupled with decades of constrained home construction. Community advocates disagree on how to best mitigate the shortage, but a growing number of policymakers, economists, and urban planners are pointing to secondary units as lowhanging fruit in the struggle to create more housing. ADUs are independent dwelling units added to a primary residence and can be built within the envelope of an existing building or as a detached structure in the rear of the lot. Also known as in-law units, backyard cottages, secondary units, basement apartments, or granny flats, these dwellings are equipped with kitchens, bathrooms, and entry ways. Compared to your average single-family home, they
are relatively simple and cheaper to build. Adding ADUs to existing single-dwelling lots are essentially a form of micro-infill, where underutilized spaces can be used for densification without compromising neighborhood character. Since ADUs are a fraction of the size of primary residences, they add to the stock of more affordably-priced housing, and help to minimize the displacement of lower and middle-income residents. The fact that ADUs aren’t exclusively serving the wealthy and won’t greatly transform the physical appearance of the city is important for finding common ground with activists who argue against new developments. The potential for ADUs to address housing issues and create flexibility in living arrangements is not a novel concept for policymakers. The state of California sought to encourage the construction of ADUs back in 1982, when it passed the Mello Act, which mandated that secondary units be permitted in all jurisdictions. Yet the means of implementation and the power to set parameters remained with local governments, where a confluence of restrictive land-use regulations, building codes, and lengthy permitting processes often precluded opportunities for building ADUs.
New Statewide Regulations
Recent amendments to the state Government Code effective January 1, 2017 take a bolder stance in lowering barriers to ADU construction and prevents local regulations that are “so arbitrary, excessive, ebrha.com

or burdensome so as to unreasonably restrict the ability of homeowners to create second units.” Under the two major bills Senate Bill No. 1069 and Assembly Bill No. 2299, a secondary unit can no longer be charged connection fees and capacity fees equal to a primary residence, and impact fees for water, sewage, or traffic services must be proportional to its size. Another big impediment to ADUs used to be the requirement to create off-street parking for the tenant. SB 1069 waives this requirement if the second unit is within an existing primary residence, if the home is within one-half mile of public transit, if the home is within a block of a car-share location, or if it is within an architecturally and historically significant area. The installation of fire sprinklers is also no longer necessary if they are not required in the primary residence. The amendments also streamline the permit process by obliging local governments to ministerially approve any ADU in an existing residence regardless of zoning standards, as well as all ADUs that comply with given criteria such as parking requirements, maximum size, and setback regulations. Ministerial approval means the person who reviews the application will no
longer exercise their own discretion in whether to approve the project in cases where all necessary criteria have been met. A third bill, Assembly Bill No. 2406, creates more flexibility for ancillary residences by authorizing a smaller version of the ADU, known as the Junior Accessory Dwelling Unit (JADU) which has a maximum size of 500 square feet and does not require its own bathroom facility.
Regulations in the East Bay
In parallel with the state-level amendments, Bay Area jurisdictions have begun to implement laws that encourage ADUs that align with the state amendments. Below is an overview of regulations regarding the building and rental of Accessory Dwelling Units (also see chart below): City of Oakland — The City of Oakland has a different set of regulations for ADUs that fall into Category One and Category Two. Category One refers to ADUs within the existing envelope, or detached units that existed legally before January 1, 2017. Category Two refers to the construction of a new structure, or an exterior addition to an existing structure.

family home. A detached ADU may not be located in the front yard, and must allow 4 foot side and rear setbacks. Parking is not required for ADUs within an existing structure, but a replacement parking space is necessary if the ADU takes the place of the garage or parking space of the primary residence. Berkeley requires the property owner to live in either the primary dwelling unit or the ADU, and does not allow short term rentals for any ADUs approved after April 1, 2017. City of Alameda — In compliance with state laws, Alameda allows ADUs within an existing structure to be built in any single-family residential zoning district. Detached ADUs are permitted on singlefamily dwelling lots within the Second Unit Overlay District. A new detached ADU cannot exceed 15 feet in height, and must meet the same setback and coverage limits as the primary residence. Similar to Berkeley, Alameda only requires creating a new parking space if the previous parking space or garage was converted into an ADU. The property must be owner-occupied and the ADU may not be rented for a period of fewer than 30 days.
The Future of ADUs and the Housing Market
We already see the new amendments making an impact across the state in cities like Los Angeles, San Diego, and Santa Barbara, where ADU applications have tripled since May. For San Francisco, the Department of Building Inspection estimates that as of August 8 of this year, 380 permits have been submitted to add an accessory dwelling unit since the program was expanded, of which 8 have been completed. The number of applications for new ADUs has surged into the hundreds within months of passing the ordinances in San Francisco, and we can expect to see similar increases in applications for the Bay Area. Illegal Units: Risks & Liabilitie Important factors owners should consider before renting an illegal unit in Oakland. BY STEVE WILLIAMS

akland’s Just Cause for Eviction Ordinance defines a “rental unit” as any unit in any real property, regardless of zoning status, that is rented or available for rent for residential use or occupancy. Oakland’s Rent Adjustment Ordinance defines a “covered unit” simply as “any dwelling unit.” Neither ordinance distinguishes between legal or illegal units. So generally, when an illegal unit in Oakland is rented to a residential tenant, the tenancy is subject to the protections afforded by both ordinances.
What is an Illegal Unit?
The term “illegal unit” is actually a misnomer. The unit itself may not actually be illegal. Instead, it is the use of that unit that may be illegal because it does not comport with occupancy laws. Nevertheless, for purposes of this article, I will refer to these units as illegal units. In order to have a lawful unit for residential occupancy, there must be a certificate of occupancy issued by the City of Oakland for that unit. So, for example, a single-family home would have a certificate of occupancy identifying one permitted dwelling unit while a duplex would have a certificate of occupancy identifying two permitted dwelling units. It is not uncommon for a single-family home with an in-law room or cottage to have a certificate of occupancy identifying the property as having only one permitted dwelling unit. These in-law rooms may be perfectly legal when used for the purpose intended, such as allowing a family member or friend to stay and sleep in the room as an accessory use of the main part of the house. However, installing a kitchen or oven without permits and renting them as separate dwelling units would be an illegal use of that space. And as explained above, once an illegal unit is rented to a tenant, it generally results in a tenancy that is protected under both the Rent Adjustment Ordinance and the Just Cause for Eviction Ordinance.
Rent Adjustment Ordinance
The Rent Adjustment Ordinance significantly limits the amount a rental property owner may increase rents to residential tenants. An owner may only increase it once per year and in an amount deter-
mined annually by the Rent Board. These limitations would apply to illegal units. There are a few exceptions to the applicability of the Rent Adjustment Ordinance, including rental units located on a property containing three or fewer units where the owner is principally residing in one of those units and has been doing so for at least two years. So, for example, if an owner has lived in a single-family home for two years and rents a second illegal unit located on the property (such as an in-law unit) separately, then the tenancy in the illegal unit may not be covered by the Rent Adjustment Ordinance. Under such a scenario, the owner could increase rents despite the limitations imposed by the Rent Adjustment Ordinance. Notwithstanding the above, whether an owner is even entitled to any rent at all for an illegal unit, let alone an annual increase, is questionable due to a recent Southern California case discussed in more detail below.
Just Cause for Eviction Ordinance
The Just Cause for Eviction Ordinance requires that an owner have “just cause” in order to evict a tenant. The ordinance sets forth eleven just causes for eviction. One of the just causes for eviction is nonpayment of rent. Presumably an owner could evict a tenant in an illegal unit who fails to pay rent. This seems logical since an illegal unit is covered under the Just Cause for Eviction Ordinance and nonpayment of rent is an established just cause for eviction. However, a recent court case out of Southern California challenges this logic. In November 2016, the Appellate Division of the Los Angeles Superior Court held that a nonpayment of rent eviction of a tenant in an illegal unit was not proper. The Court reasoned that a rental agreement for an illegal unit is void, and therefore an owner is barred from collecting any rent or evicting a tenant for nonpayment of rent. In other words, the tenant had no obligation to pay any rent at all to the owner, so any notice to pay rent or quit necessarily overstated the amount of rent due and was therefore, invalid. While this court decision from Southern California is not binding on Alameda County Courts, judges here may still consider the analysis and persuasiveebrha.com

rent ordinance, breach of the warranty of habitability, etc. In any such lawsuit, a tenant may seek to recover damages from the owner, which may include: Return of some or all rent that has been paid — If there is no obligation to pay rent, then the tenant may seek reimbursement of any rent that was paid. Emotional distress — A tenant may seek to be compensated for emotional anguish suffered as a result of living in, or being displaced from, an illegal unit. Out-of-pocket expenses — A tenant may seek reimbursement for expenses incurred, such as expenses necessary to move out of the illegal unit. Treble damages — If the owner’s conduct resulted in a Rent Adjustment Ordinance or Just Cause for Eviction Ordinance violation, then under those ordinances, the tenant’s actual damages would be tripled. Punitive damages — A Tenant may seek an additional sum of money to punish the owner if it is found that the owner’s conduct was intentional and reprehensible. Attorney’s fees and costs — A tenant may seek reimbursement of the attorney’s fees and costs incurred to litigate the case against the landlord.

Furthermore, this decision underscores the harsh reality an owner may face when electing to rent an illegal unit. If nonpayment of rent is not a viable option to evict a tenant in an illegal unit, then the Just Cause for Eviction Ordinance provides another just cause basis that an owner may utilize. An owner may evict a tenant from an illegal unit in order to remove that illegal unit from the residential rental market due to a code violation. This can be a lengthy (typically requires a minimum 60-day notice) and expensive (tenant would be entitled to considerable relocation payments) basis to evict a tenant. But it is still an option an owner may consider when seeking to recover possession of a tenant occupied illegal unit. And like with the Rent Adjustment Ordinance, there are some exceptions to the applicability of the Just Cause for Eviction Ordinance, including rental units located on a property containing three or fewer units where the owner is principally residing in one of those units. Under this circumstance, the owner who principally resides in one of the three or fewer units on a property does not need just cause to evict a tenant residing in an illegal unit on that property. In other words, under this circumstance the illegal unit would not be subject to the Just Cause for Eviction Ordinance as soon as the owner began principally residing in one of the units and for so long as the owner continued to live in that unit.
Owner Liability
Under California law, contracts that are entered into for an illegal purpose are void, so the parties are not obligated to perform under that contract. A lease is a contract. So, where the purpose of the lease is to rent an illegal unit, the lease may be void. This was the analysis that led to the decision in the above discussed Southern California case. Consequently, in addition to a potential zero rent liability, there are other potential risks and liabilities associated with renting an illegal unit. For instance, a tenant may break the lease and walk away at any time without consequence. The tenant may also sue the owner claiming a multitude of things, such as fraud and misrepresentation, violation of the 28 RENTAL HOUSING

Potential Defenses to Tenant Lawsuits
There are numerous potential defenses an owner may raise in response to a tenant lawsuit. Here are a few: Statute of limitations — This is the time within which a lawsuit may be filed after the adverse conduct. Here are some potentially relevant statutes of limitations: Violation of the Rent Adjustment or Just Cause for Eviction Ordinances – 1 year; Breach of oral contract – 2 years; Personal Injury and Negligence – 2 years; Fraud and misrepresentation – 3 years; and Breach of written contract – 4 years. The illegal status of the unit was known to the tenant — Such tenant knowledge may undermine a tenant’s claims of fraud and misrepresentation. It may mitigate liability for other claims as well since the tenant assumed the risk when moving in. Quantum Meruit — This is a Latin phrase meaning “as much as he deserved.” It refers to the actual value of the services performed. Quantum meruit determines the amount to be paid when no contract exists. In other words, there is an actual value for the housing services provided and the tenant should not be entitled to a refund of all the rent, but instead an offset for the value of the services provided.
Ways to Minimize Liability
While there are thousands of illegal units rented throughout the Bay Area, the safest course of action to minimize liability is simply not to rent them. The risk and potential exposure to liability may outweigh any benefit an owner gets from renting an illegal unit.

An owner may also consider legalizing the rental unit. Given the need for housing in the Bay Area, some local governments are making it easier to obtain a certificate of occupancy for illegal units. If the owner chooses to assume the risk by renting an illegal unit, then the owner should not misrepresent or hide the fact that it is an illegal unit. If a tenant is aware that the unit is illegal before moving in, then presumably the tenant is making an informed decision to do so, which may minimize potential liability. Of course, the tenant may have more sinister motives behind the desire to move into an illegal unit. An owner should treat the tenancy and rental unit with care. Be responsive to tenant complaints. Don’t give excessive rent increases that violate the limitations imposed by the Rent Adjustment Ordinance. Illegal units, which are often more affordable than other rental units, provide a source of much needed housing in the Bay Area, and the vast majority of tenancies in those units don’t result in adverse litigation. The ones that do generally begin with a disgruntled tenant. So, the owner should not stir the pot. Whether renting legal or illegal units, all owners should maintain an insurance policy for the subject property at all times that provides coverage for “personal injury” and “wrongful eviction.” Having such a policy may afford an owner protection against some of the potential claims that may be asserted by tenants. Finally, all owners should consider various asset protection strategies. No one ever expects to be sued, whether by a tenant in a legal unit or in an illegal unit. But everyone must recognize that it may occur. So, owners should be prepared. There are a number of legal strategies that an owner may employ before a lawsuit occurs to protect assets and minimize potential losses in the event of a future lawsuit. These strategies should be considered and implemented sooner rather than later. Because once a lawsuit is filed, it is usually too late to do so. What should owners do when tenants ask to make big modifications in their units? BY VARIOUS AUTHORS
prohibited by the rental agreement and you do not give consent but they install it anyway, then your tenants are violating the rental agreement. You can require your tenants to remove it and restore the closet back to its original condition. If your tenants refuse after proper notice, then you may have grounds to terminate the tenancy. Another thing for you to consider is that perhaps a professionally installed shelving system may actually improve the closet. If this is the case, then it may be beneficial to consent to the installation but make it clear that the shelving system will become a fixture (a permanent part of the rental unit) and as such must remain even after your tenants vacates. You should also ensure that it is properly and professionally installed at your tenants’ sole expense. —STEVE WILLIAMS

I suspect that my long-term tenant is hoarding. She’s got a bunch of old stuff in her apartment, but she tells me it’s because she’s a collector. How does the law define hoarding and what are my legal rights in this situation?

My tenants want to hang up a shelving system in one of their closets. It would be screwed into the wall and leave several large holes when it is eventually removed. Do I have to allow it? If I tell them no and they do it anyway, what can I do?

The first thing you should do is refer to your written rental agreement. Many rental agreements have provisions that prohibit the tenant from making alterations without the owner’s prior written consent. Installing a shelving system in the manner you describe would likely fall within this provision. your other tenants’ use and enjoyment of the property. Cluttering may also result in housing and building code violations. These are just causes for eviction in most eviction controlled cities. The current debate is whether or not a tenant’s propensity to hoard items is considered a “disability” or whether the owner must make a reasonable accommodation for the tenant. Hoarding may not be just a matter of poor housekeeping, but may be the result of a psychological disorder. Whether or not hoarding is a disability that requires the owner to reasonably accommodate, it is a good idea to work with the tenant on resolving the problem without having to evict. Referring the tenant to a public agency that assists hoarders is a good start. The Mental Health Association of San Francisco is a good start. Also, giving the tenant more time to remove clutter and clean the unit could help. Don’t just give a Three Day Notice to Perform or Quit. Provide a written schedule and timetable in which the tenant must clean up and remove clutter. Give multiple warnings before serving an eviction notice. All of these efforts will show your good faith should an eviction be necessary. —CLIFFORD FRIED RH

2017-18 (2.3%) A CPI increase of 2.3% becomes effective on July 1, 2017. Tenants may only receive one increase in any 12-month period, and the rent increase cannot take effect earlier than the tenant’s anniversary date. In addition, California law requires that for tenancies receiving greater than a 10% increase, a 60-day notice is required; if the increase is 10% or less, a 30-day notice is required.
