City Council during its regular meeting on March 5 awarded a construction contract to finish a park that is months behind schedule, and also looked at potential changes to council districts. Construction of the next phase of the Abernathy Greenway Linear Park will begin soon and city officials hope it can be completed by spring 2014. City Council awarded the $3.2 million contract to Johnson Landscape. Johnon Landscape will have 180 days to complete the construction, which will include installing sidewalks, lighting, bathrooms and parking facilities. The delay in awarding the contract has kept plans to install “playable art” – playground equipment designed by artists and do-

City Attorney Wendell Willard has co-signed a motion with an attorney representing 28 descendants of Judge John Heard asking a Fulton County Superior Court judge to return Heard’s historic family cemetery to the descendants. The motion, filed on Feb. 25 by Willard and the Heard descendants’ attorney, Wright Mitchell, contains summaries of numerous court precedents and additional evidence in support of the descendants’ claim to the property. “This court must grant summary judgment to defendants because the material undisputed facts establish that Heard Family Cemetery is not abandoned,” the joint motion says. “Therefore, it is perpetually dedicated to burial purposes.” The motion also asks the court to award Heard’s descendants unspecified damages for alleged trespass on the property by its current owner. Local attorney Christopher Mills, who is not a Heard descendant, holds title to the property, located at 0 Heards Drive in Sandy Springs. Mills wants to build a house on a portion of the land that does not contain graves, according to an archeological survey Mills obtained. Sandy Springs officials denied Mills request for a building permit on the one-acre parcel, citing a city ordinance prohibiting development on land dedicated as a cemetery. Mills sued in August and the resulting uproar got the attention of the Heard descendants around the country. Mills has declined to comment on the case. His in-laws, Henry and Wan-

da Cline, also have not returned messages seeking comment. Mills received the property from the Clines, who obtained it by paying off back taxes and acquiring the property rights from Mary Ann Elsner, a Heard Descendant. The property is legally exempt from taxes under Georgia law, however. The lien was placed on the property by mistake. The Clines paid $38,400 to settle the tax debt. The lawsuit claims the Clines in 2008 received $18,898 from Fulton County, “presumably as reimbursement for the money they paid to redeem property sold by Fulton County.” Neighbors living around the cemetery thought the Clines intended to donate the property to Sandy Springs Heritage and Preservation, according to the court records. They were furious when they learned in 2012 that the Clines transferred it to Mills so it could be developed. The lawsuit cites several court precedents where state judges have honored properties dedicated as cemeteries. The Heard cemetery contains the grave of Judge John Heard, a Confederate veteran who in 1900 dedicated the property as a cemetery. “This deed is made for the purpose of maintaining and keeping perpetually the property described above, for a family burying ground, for the grantor and his heirs, and the same is to be used for said purpose only,” the deed says. A group of neighbors living around the cemetery formed Friends of the Heard Cemetery to raise money for the legal fund to protect the cemetery. A Jan. 27 fundraiser brought in more than $10,000. SS

‘To Kill a Mockingbird’ chosen for reading program

By Dan Whisenhunt Sandy Springs Reads has announced the novel “To Kill a Mockingbird” will be part of this year’s “One City, One Book” event. The book will be featured during the annual ArtSSpring Celebration that runs from April 18 to May 17. The celebration will hold several events honoring the book. “To Kill a Mockingbird” is the only novel written by Harper Lee and won the Pulitzer Prize. The book is set in small-town Alabama and the characters grapple with issues of racism, injustice and poverty. The book was also turned into a classic film starring Gregory Peck as Atticus Finch. Event chairwoman Laura Jones said in a press release that the planned events will be used to explore different themes of the book. “The programs feature debates, lec-

tures, and discussions about what makes this novel still socially relevant today in our community, and what lessons can be learned from the humility and integrity of a character like Atticus Finch,” Jones said. According to the press release, the Sandy Springs Bar Association will hold a mock trial at the public high schools, volunteers will read to public school students, and there will book discussions at the Sandy Springs Library “led by friends of the author.” “The literary events culminate with a screening of the documentary, “Hey Boo!” which tells the untold story of the novel, on April 27, and the Oscar-winning movie on April 28, both at 10:30 a.m. at the Lefont Theater in Sandy Springs, with a panel discussion after both,” the press release says.

Interior designers from Buckhead and Brookhaven have been selected by the American Craft Council to create rooms inspired by its fine craft pieces. The American Craft Council Show, coming to the Cobb Galleria Centre March 15-17, will feature jewelry, clothing, furniture, home décor and other crafts from 240 of the country’s top craft makers. This year, the council has selected 10 Atlanta interior designers to compose rooms using craft pieces from the show’s artists. The display, called “Make Room: Modern Design Meets Craft,” features room designs that reflect the character of each piece. The designers start with a blank 10x10 white space and a craft piece. Each room will showcase the craft, and reflect the designer’s personal style and vision. Four of the 10 selected designers are from Buckhead and one lives in Brookhaven. Janice Palmer, of Buckhead, said she will be designing around two pieces -one made from Moreno glass and the other a piece of pottery. “I wanted to do a sexy, sophisticated living room and I wanted to use another element to wood. A lot of people are using wood, so I found myself using glass. I love Moreno glass,” Palmer said. Palmer describes her style as “classic contemporary with a twist.” “I like timeless stuff, but I’m more on the contemporary side,” Palmer said. Buckhead designer William Peace said he is creating a “thought-provoking” sitting room or studio area with textured walls that evoke a European ruin.

“We’re kind of creating an industrial background,” Peace said. “It will be a relatively neutral palette which will enhance the artwork we’ll be using.” The art Peace selected is made from structural wire and pottery. There are wall-mounted and table-top pieces. “It will have a loungy, mid-century furnishing quality about it,” Peace said. Peace, a longtime fan of the American Craft Council Show, said the display will give people an opportunity to see how crafts could be used in their own homes. “You see so many of these crafts together, it can be hard for people to visualize, how will this work in my own home or my own office?” Peace said. “Especially if they see them out of context, it’s hard to visualize how would one of these, or a series of these, would look in my space?” Peace said he’s glad the show will incorporate designers this year. “It really is kind of fun for us to get creative and do something different than a client might hire us to do,” Peace said. Wireless infrastructure investment is good for Sandy Springs To the editor: As a professional in the wireless service industry, I know how dynamic my industry is and how important it is to Sandy Springs and to Georgia. My Sandy Springs newspaper arrived today and I was both surprised and dismayed to see your lopsided and inaccurate coverage of House Bill 176 - the Mobile BILD act [“City Counciil blasts cell tower deregulation,” Sandy Springs Reporter, Feb. 22-March 7]. First, this legislation does not deregulate cell towers. All cell tower permits, whether new, co-locations, or modifications, will still have to be reviewed by local jurisdictions “for conformance with applicable site plan and building permit requirements, including zoning and land use conformity.” That is in the plain language of the legislation which the City Council does not appear to have read.

Second, this legislation simply streamlines and standardizes the permitting process for wireless infrastructure to remove unnecessary delays and eliminate excessive costs, which hurt consumers and the citizens of our community. Thus, it will incent investment in wireless infrastructure in our state to provide the wireless service that Georgians want. Third, this legislation has been written carefully to not effect local zoning. It strikes a balance between the needs of local governments to determine the zoning for their communities and the need to attract investment to our state. At AT&T, our goal is to be a good partner in our communities and to deliver the products and services that help Georgia keep moving forward. All the leaves are brown and the sky is grey We went looking signs of an early spring. We found snow. Really. In March. On the banks of the Chattahoochee River. The sky spit flurries of the stuff. Not enough to stick to the ground, of course, but brief flurries of actual snow. Time and time again. At first, everyone made jokes. We were here in search of warmer weather, after all. Maybe these flakes falling all around us were really white flower blossoms floating on the first spring breezes, someone suggested. They weren’t. Winter had played a trick on us. During the first weekend of March, at the end of a mild winter, grey clouds filled the sky. Chilly breezes blew. Everyone wore layers. Snowflakes dusted our jackets and caps. Somewhere, no doubt, groundhogs were laughing at our alltoo-human inability to predict a change in the seasons. “I feel like we should run to the grocery store and buy milk and bread,” one hiker joked.

With re-enactors portraying soldiers, and actors portraying civilians, the Atlanta History Center plans on March 16 to present a family-friendly look at life both on the front lines and on the home front during the Civil War. “Citizens and Soldiers: The Civil War,” part of the center’s observance of the 150th anniversary of the Civil War, includes watching antique rifles being fired, learning to march or trying to enlist in the army, and an opportunity to take part in a bread riot, oﬃcials at the center say. “I think it will give guests a great idea

of what was happening on the home front as well as the battlefield,” said Cary Ann Moody, manager of public programs for the center, said of the event. Take that bread riot. “Bread riots were taking place all over the Southeast,” Moody said. “These were led by women. Throughout the Southeast, women were looting stores because they were unable to buy the items they needed to survive.” So, during the program, participants will have a chance to join in a march to a local store to demand pre-war prices on necessary goods, such as shoes, Moody said. Actors will lead the debate.

Billy Grogan didn’t see one of his home-state competitors until almost the end of his Special Olympics trip. His job was to help carry the torch. Earlier this year, Grogan, who usually works as Dunwoody’s police chief, spent about 10 days as part of a team carrying the torch across parts of South Korea for the 2013 Special Olympics World Winter Games.

 Lilly Chin  The Westminster Schools, Senior Perhaps Lilly Chin was destined to love science from the time she was a toddler in her parents’ lab at Emory University. “One day I went up to my dad and asked, ‘Hey, what are you doing at that microscope?’” Lilly said. “He scraped some of my cheek cells and put them on a slide under the microscope and I remember he was pointing out, ‘Oh here’s the nucleus, here’s the mitochondria’ … That really stands out in my mind as the moment I knew I really wanted to do science in the future.” Since preschool, Lilly has developed a passion for math and science – first programming, then robotics, then starting on her first mathematics research project during her freshman year at Westminster. Over the past two years, Lilly has immersed herself in research projects in biology and bioengineering. After her biological research at Emory, in which she studied cancer cells, Lilly created a computer model to determine what would heal wounds fastest. “One thing I noticed in my internship experience is that there’s actually a pretty big gap between biology and engineering,” Lilly said. “I’d like to work toward connecting the two disciplines.” Chris Harrow, who taught Lilly Honors Calculus when she was a freshman, describes her as one of his most talented and enthusiastic students in the course. Class problems “simply dissolved in the face of the brute force of Lilly’s fast, experienced, creative, determined mind,” Harrow wrote in a letter recommending Lilly. “Lilly Chin is without equal as the most eager, independent learner I’ve

known in my 23-year career,” he wrote. Lilly returned his admiration as Westminster’s STAR student for 2013, an honor usually awarded to the senior with the highest SAT score in the class. She named Harrow STAR teacher. Lilly’s work has won her acclaim beyond Westminster. This year, she was among 40 finalists in the national Intel Science Talent Search. She won a $7,500 prize and will compete for prizes of up to $100,000. She was scheduled to be in Washington, D.C., March 7 through 13 for the final round of competition. Although competition is enjoyable for Lilly, her passion surpasses any desire for victory. “It’s fun just to see where you stand,” Lilly said. “It’s never really cutthroat – I have a lot of friends I’ve met through competition.” While she devotes most of her time to research, she also commits to a host of other extracurricular activities, such as tutoring through Mu Alpha Theta, a math honors society; serving as lead coder and captain for the robotics team; and attending various math competitions.

eDucatiON Student Proﬁle:  Emily DeMaio  Senior, The Marist School Emily DeMaio leads many parts of the Marist School community. She captains the varsity girls’ basketball team and has been the defensive captain since her sophomore year. Emily received the Lady War Eagle Award this year, which is given to one member of each team each year. “I really like the team aspect,” Emily said. “We all have to come together and support each other in order to win.” On the track, the 18-year-old holds the girls’ shot put record of 33 feet and 6 inches. Emily also participates in the discus event. Her goal is to make it to the state competitions this year. Emily also serves as co-president of The Fellowship of Christian Athletes at Marist. “Since I’m such a sports-oriented person, mixing in the faith aspect is really cool,” Emily said. Emily helps to organize the bimonthly breakfast meetings, as well as to select the speakers. In the program, she enjoys meeting new people and learning about their individual experiences. During Emily’s junior year, she tore the anterior cruciate ligament in her knee, so she had to have surgery. Her goal was to return to the court by her senior year. She did. “Therapy was very challenging,” she said. “It really taught me to work hard and never take anything for granted. I always tell my team to play like it’s their last game.” Derrick Engram has been Emily’s AAU basketball coach for five years. He describes her as a positive leader with determination, dedication to her game and style of play, and a team player.

Emily has found another way to inspire her peers. When she was younger, her grandfather would say a quote he had heard, and Emily would always write it down. Now, Emily shares a motivating quote with her teammates before every game. She also posts them on their lockers on game days. In school, Emily is a grade-level coordinator of the Peer Leader Program. She coordinates small gatherings between new students and their buddies. Emily helps younger peer leaders by giving them advice based on her past experiences in the program. Emily also is secretary for the Habitat for Humanity chapter at Marist. The group raises money through a variety of fundraisers in order to aid the building of homes through the Habitat program. “Her leadership skills are way beyond her age,” Engram said. “She can walk into a room or walk onto a team and automatically take the lead … eﬀortlessly.”

What’s Next: Emily is looking into a variety of colleges, and is currently undecided. She plans to major in either nursing or biochemistry. Emily has many nurses in her family, and after tearing her ACL, she aspires to be one also. –Stacy Bubes

The neighborhood is zoned for Heards Ferry Elementary School and Riverwood International Charter School. Holy Innocents’ Episcopal School is located in the heart of the community, next to the historic cemetery. The subdivisions are full of expensive houses on quiet streets, sitting at a safe distance from the congestion along Roswell Road. “These neighborhoods are some of the nicest in the metro area,” Lebowitz said. “We have really nice, hilly terrain.” Neighbors succeeded in keeping the cell tower out of their neighborhood. In the process, they noticed other things they thought needed work. The water tank near the proposed cell tower site was rusted and hadn’t been painted in 20 years. There was right of way at the intersection of Dupree and Mt. Vernon that Lebowitz described as a “mud bank.” Though the proposed site for the cell tower was in Sandy Springs, it actually belonged to the city of Atlanta. AT&T had also bought a nearby piece of property and installed utility boxes, Lebow-

As of March 1, the bill was still working its way through committees in the state House of Representatives. “Every municipality in Georgia has their own ordinance about how to deal with those,” Lebowitz said. “I think this is a typical kind of lobbying eﬀort by the telecommunications industry because they want to build more towers.” The Historic Cross Roads Community Association won’t make it easy for the telecommunications companies. The House bill has jolted the neighborhood into action again. “We jumped on it,” Lebowitz said. “We got -- I don’t know, maybe 50 -letters written to the legislators on that particular committee and our representatives, as well as others.”

6200 block of Roswell Road 30328 – On Feb. 11, a restaurant owner said that he saw someone pumping used grease into a white box truck from his grease container at the back of his restaurant. The woman said she had a work order to pump it but could not produce any documents. The two women got into the truck and left. The value of the lost grease was $100. One of the women came into the restaurant and had acted as a decoy earlier. Why do people steal used grease? “Yellow grease” is a commodity, which can be sold. Bigger rendering companies will turn leftover grease into animal feed, cosmetics, soap and other products. It is also used in renewable fuels.

A rre s t s 2100 block of Sandalwood Drive 30350 – On Feb. 10, a resident called the cops just before 1 a.m. when someone tried to get in the resident’s front door. An officer located a man near the apartment building. He said he was looking for his friend who was driving there to meet him. While the cops were there, the friend showed up. When asked, the friend said he was the man’s brother, and then changed the story, saying he was his friend. Both men had inconsistent stories. One of the men had 13 $10 bills on him that the officer recognized as counterfeit. The man said he had the money on him because “it looked cool.” He was arrested. The second man was arrested for loitering. 400 block of Morgan Falls Road 30350 – On Feb. 10, late at night, a man got drunk and tried to fight some other guys. He got beat up and was later arrested. 200 block of Windsor Gate Cove 30342 – On Feb. 10, just before 4 a.m., cops received a call of a suspicious person on Telford Place. The resident saw a car pull up into a driveway, stop, and park. A man came out of the dark and ran to the car, got in, and the car left. Officers checked the area and about 20 minutes later, found a car matching the description on West Kingston Drive. The car was speeding and the officer lost sight of it. Shortly after, the same officer saw a car matching the description on Peachtree Dunwoody Road. The car’s headlights were not on. The officer hit the blue lights and the car turned onto Balmoral Road, where it stopped, and a man exited and ran. The officer requested help and remained with the car, and found a wallet that looked to have been stolen. The owner of the wallet was visiting nearby and told the officers that someone smashed and grabbed it from his car on Windsor Gate Cove. A computer bag and laptop were also SS

He was nabbed and taken into custody. 5500 block of Roswell Road 30342 – On Feb. 11, Target employees called the police who arrested one man for stealing several CDs from the store at the Prado. The value of the theft was $180. Detectives charged a man and a woman with insurance fraud charges stemming from a Jan. 28 report filed on Harbor Pointe Parkway. The woman reported her car was stolen. She claimed that her boyfriend was the only other person who had access and he was with her. The investigation showed that she falsely reported the theft and the pair took the car to Forsyth County and set it on fire in order to collect insurance money. Detectives have charged a juve-

nile man with the robbery of a Pizza Hut delivery driver on Dec. 23. The juvenile and one other robbed the driver at the Lakes Apartments on Colquitt Road. They took $60, three pizzas and the pizza warmer. The juvenile will be charged as an adult. He was indicted on Feb. 15 by a Fulton County Grand Jury.

5500 block of Roswell Road 30342 – On Feb. 16, Target security caught two female juveniles stealing clothes. The two gave the police officer various names and dates of births that were all fake. The parents were called in and gave the proper information. The kids were charged with the thefts and providing false information. The items recovered were valued at just over $100. I-285/Riverside Drive 30328 – On Feb. 16, a patrol officer saw a car stalled out against the median wall on I-285. He approached the car and when the driver rolled the window down, the officer smelled marijuana. The man told the officer that he was “too scared” to move the car over to the right emergency lane. The officer manipulated the traffic so that the driver could get the car over to the right side and safely out of the way of oncoming traffic. The officer found two other men in the car and later found the marijuana in a backpack. The three men said they had no idea where the weed came from. They were charged accordingly. 8700 block of Roswell Rd 30350 – On Feb. 18, cops responded to the Publix store on a

shoplifting call. They met with store employees who detained a woman who stole bottles of Bayer aspirin and bars of soap by concealing them in her purse. After she was caught, she said she was sorry and would go back in and pay. She was charged with shoplifting and arrested. 800 block of Lake Placid Road 30342 – On Feb. 19, a cabbie called the cops after he dropped off a very drunk woman at the Calibre Springs Apartments just before 3 a.m. The woman got out of the cab and ran into the bushes. When the cops got there, she looked at them and said, “Really? Really? Really?” When they asked her her name, she said, “Really? Really? Really?” The officer tried to help her off the ground, but she kept taking drunken punches at him. She refused to tell the cops where she lived, so they arrested her. 6300 block of Peachtree Dunwoody Road 30328 – On Feb. 20, officers met with the staff at a discount store and a woman who had placed a DVD movie, as well as other items, in her purse in addition to what she had in the cart. She paid $100 for the items in the cart but did not pay for the concealed items totaling just over $79. She was stopped and then later charged with shoplifting. 3000 block of Spring Creek Lane 30350 – On Feb. 20,

two people were charged with disorderly conduct, having to do with possession of marijuana.

5600 block of Roswell Road 30342 – On Feb. 21, vice cops arrested a man who was charged on prostitution charges. He was advertising on a website as a transsexual prostitute.
