It’s just under a mile from Emerson “Bill” Peet’s home in Mount Vernon Towers to his mother’s home in Sandy Springs. But for Peet, the trip is an hours-long odyssey he has to plan a day around and risk his life to complete. That’s because Peet uses a wheelchair, and Mount Vernon Highway’s pedestrian paths are a jigsaw puzzle of dead-end, broken or nonexistent sidewalks. On a recent trip down that street, Peet pointed out the spot where a police officer stopped him several weeks ago for rolling in the road because there is no sidewalk. “He said, ‘Well, don’t be out here [in the street] anymore,’” Peet recalled, as if he and not the lack of sidewalks was the problem. “If you’re on wheels, you’re forced to break the law.” Peet, 50, has used a wheelchair since 1991, when a brain injury gave him severe balance problems. He’s become a popular figure at Mount Vernon Towers, dubbed its “mayor” by fellow residents, in his three years there. But he’s not new to the area—he’s a Sandy Springs native who grew up in the Mount Vernon Woods neighborhood. As the suburb became a city, he saw the increase in sidewalks. “It’s come in leaps and bounds, and now there’s something, but not near enough,” Peet said of Sandy Springs’

sidewalk installations. The city has spent millions fixing and installing sidewalks, and the City Council regularly debates ways to do more. City spokeswoman Sharon Kraun said the city is also working with the Atlanta Regional Commission on a “Complete Streets” plan, which designs streets for various types of users, not just cars. “We have been, from Day One, attacking the sidewalks, trying to upgrade, improve and add,” Kraun said. “We’ve got a lot of years to make up for. We’re very conscious of that.” City leaders often cite some good reasons for their sidewalk efforts, such as attracting active millennials to shopping districts or getting kids safely to schools. But spending a couple of hours traveling with Peet shows a more basic issue: sidewalk conditions that make it difficult and dangerous for many residents to visit businesses they like and people they love. Peet and his mother both live on the north side of Mount Vernon Highway, but there’s no direct sidewalk route. Peet only got a few hundred feet before the sidewalk abruptly ended, forcing him to cross the busy road. Sandy Springs aims to boost the impact fees paid by new real estate developments for the first time in seven years. With the city in the midst of a building boom, that could mean more money for parks, police and streets. “Our fees have not been updated since 2008,” Assistant City Manager Jim Tolbert said at the Nov. 3 meeting of the City Council, which directed him to hire a consultant to revise the fee structure. “There is room for growth in our fees without pricing ourselves out of the market.” Impact fees are intended to offset the increased costs the city pays to support new developments with services such as policing or infrastructure such as roads and sidewalks. In Sandy Springs, separate fees go to transportation, public safety, and parks and recreation, with an amount that may vary depending on the development’s type and size. The fee must be calculated based on the city’s actual costs—“you can’t just pick a dollar amount,” Tolbert said—so the formula can become complicated. But sample comparisons presented by Tolbert show that Sandy Springs’ fees are generally much lower than those of some neighboring cities. “I think you’ll see other communities have gotten out ahead of us…We’re a little bit behind,” he said. The highest total impact fee for a new residential unit in Sandy Springs is about $1,646. That’s higher than Atlanta, at around $1,500. But Milton and Roswell may charge for $4,000 and Alpharetta may charge nearly $6,500. Sandy Springs currently requires the SEE CITY, PAGE 5

Businesses to be checked for unpaid fees and taxes BY JOHN RUCH

Sandy Springs businesses that aren’t paying local taxes or fees may soon get a friendly reminder—and a bill—from a city-hired auditor. Sandy Springs City Council on Nov. 3 approved a contract with the firm Revenue Discovery Systems to audit the city’s collection of business and occupational license fees and taxes on hotel rooms, alcohol and car rentals, among other goods and services. That revenue could be substantial. The last time the city did this type of audit, in 2008, it found $3.8 million in new revenue, said city Finance Director Karen Ellis. And that was done internal-

ly by city staff going after “low-hanging fruit,” she said. City Councilman John Paulson said downside of the previous audit was some businesses “complaining they were being treated a little heavy-handedly.” City Manager John McDonough acknowledged the 2008 audit might have taken an overly aggressive tone and that the new deal will be more collaborative. RDS regional manager Ivan Figueroa said his company is “more successful with the kid-glove approach than the ‘gotcha’ approach.” The auditing contract goes into effect Dec. 1, McDonough said.

Donations to speed sidewalks Want to see a sidewalk installed in front of your home? In Sandy Springs, you can make that happen more quickly by offering to donate the right of way to the city. The city will accept statements of intended donations—which are not legally binding—through Feb. 1 for the potential projects in the 2016 Capital Sidewalk Program. Saving the city from having to purchase the rights of way will boost the project’s score in the system used to prioritize new sidewalks. Donation statements should be based on a sidewalk project proposed on the city’s master list, which can be viewed on the “Sidewalk Projects” page of the city’s website at sandyspringsga.gov. To start the process, interested residents should call 770730-5600 and ask for information about right-of-way donations for a scored sidewalk project. Residents will need the name of the project from the master list. City staff will review submitted requests, following up with residents to confirm the specified project and address any questions. City mulls hiking impact fees parks impact fee only on residential units at a rate of $165 per unit. Atlanta charges $246-$410 (only on singlefamily houses); Roswell charges $318$713; Milton charges over $3,100; and Alpharetta charges almost $5,000. Alpharetta and Atlanta also subject office and commercial developments to parks impact fees at different rates. “We’re due for an increase,” said resident Tochie Blad, speaking to the council in support of revising the impact fees. “We’re shy on parks and we’re shy on our parks budget,” she said, adding that higher fees also “might be a way to curb the rampant growth in our city.” Councilman Andy Bauman said he hopes a higher fee could help to fund new sidewalks and “get the homeowner out of the sidewalk construction business.” Tolbert will hire a consultant to conduct the complex analysis of city services required to update the impact fee rates. He said that in other communities, such consulting has cost $30,000 to $50,000. “This will not happen quickly” due to the complexity of the analysis, he said, adding it could take several months. On the other hand, he said, the timing is good because the revised fees parallel the current revision of the city’s Comprehensive Plan that sets development standards. walk at all. Along the way, he faces some steep slopes and ramps, a challenge he copes with by pushing himself backward in his chair. It’s a similar story on the way back. “This is great,” Peet said of a wide, smooth sidewalk—until it ended in a muddy trail that led to a curb with no ramps. Peet said there are many parts of town he would like to visit, but doesn’t because “it’s so much to do alone.” Tipped off to a little-known, wheelchair-friendly back path to Trader Joe’s, Peet paused and said, “That would open up a whole new world to me.” Trader Joe’s is next door to Mount Vernon Towers. That tip came from Peet’s new friend, Eric Mowris, whose mother just moved into the Towers. Eric and wife Cheryl recently moved to Sandy Springs, too. buying a small home on Hilderbrand Drive. The Mowrises are poster children for the empty nesters the city wants to attract with its downtown redevelopment, which is partly sold on new sidewalks. “I chose to live here in part…because Sandy Springs has stated its intent to be a walkable community,” Eric Mowris said. Sidewalks in his area are pretty good, Mowris said, though with such obvious gaps as a trail worn in the grass on Hammond Drive and such dangers as short times on pedestrian-crossing signals. While helping Peet around Mount Vernon’s obstacles, Mowris displayed a print-out for the new City Springs project and pointed out how many times its description calls it “walkable.” “I never heard that term ‘walkable,’” Peet said. “I’m learning as much as you are,” Peet said as he and Mowris traded tales of navigating Sandy Springs sidewalks. Starting with Sandy Springs a decade ago, Sen. Fran Millar (R-Dunwoody) has backed every effort to create a new city in Georgia. He sponsored legislation to start the cities of Dunwoody, Brookhaven and Peachtree Corners and, most recently, to set up a new central DeKalb County city called LaVista Hills. “It’s safe to say that I’ve supported every city that’s passed,” he said. But on Nov. 3, voters in the area that would have become LaVista Hills voted down the plan for that city. The margin was slim: just 136 more “no” votes than “yes” votes out of the 13,714 cast. Meanwhile, voters in a neighboring area overwhelmingly backed creation of a new city called Tucker. The Sandy Springs Reporter asked Millar for his reaction to the vote and his thoughts on future city-creation efforts in DeKalb County and the state Legislature. Here’s what he had to say.

Michael Holmes, Tup Holmes’ son, said the decision has been referenced 51 times in other cases. “It was a big deal,” Emanuel said. Bell and Emanuel were part of a group of about 75 people that gathered at the Bobby Jones clubhouse to mark

the 60th anniversary of the decision, released Nov. 7, 1955, with the formal opening of a new exhibit about the case called “Holmes v. Atlanta: Changing the Game.” The exhibit, sponsored by the Friends of the Bobby Jones Golf Course and put together by Georgia Tech professor Mary McDonald and her graduate students, includes information about Holmes, his family and the lawsuit. “We felt like it was a story that needed to be preserved,” McDonald said. “I think it’s got all sorts of really important issues connected to it. They actually played their first round under the judge’s order on Christmas Eve at North Fulton Golf Course. Bell remembers it was a more prestigious course than Bobby Jones. Others suggested the idea might have been to have that groundbreaking first round played somewhere other than Bobby Jones to avoid a racial confrontation. Bell remembers there were photographers on hand to record the event and said that some people may have shouted catcalls at the players. But he admits it’s hard to recall particulars now. The next day, Christmas Day,

“The lake is pretty—as much as I would like to fill it in at times,” said Gerri Schwartz, the property manager in charge of Peppertree Lake. It’s not the lake itself, nestled among homes in the heart of Sandy Springs’ Perimeter Center, that raises her ire. It’s the massive dam holding it back— and recent state-mandated repairs that may cost more than $60,000. Peppertree Lake Dam is one of 11 “high-hazard” dams in Brookhaven, Buckhead, Dunwoody and Sandy Springs—“high hazard” meaning that if they collapse, the subsequent flood likely would kill people. More than

20 similar dams failed and contributed to deadly floods in South Carolina last month. Many of Georgia’s dams are in private hands with homeowners on the hook for maintenance. Along the top end of the Perimeter, homeowners may grumble at the cost, but likely can afford it. Lower-income areas, or old dams where no owner can be found, can be a bigger problem. About 15 states have some type of grant or low-interest loan program for dam repairs, but Georgia is not among them, according to the state Environmental CONTINUED ON PAGE 13

‘MARTA Army’ seeks to make buses, trains more convenient BY CLARE S. RICHIE

Today at a MARTA bus stop, you’ll see the signature tri-colored sign attached to a pole and little else. The MARTA Army is working to change that through their adopt-a-stop initiative, Operation Timely Trip. The initiative seeks to improve bus riders’ experiences on metro’s Atlanta public transit. MARTA Army, an independent grassroots action group, was an idea sparked at the 2014 Georgia Tech Transportation Camp. The citizen group says it plans on using “boots-on-the-ground interventions to improve the physical, cultural, and social environment of the MARTA system.” “It’s tactical urbanism – citizens coming together to do small acts for large -scale change,” explained Simon Berrebi, a MARTA Army co-founder and Georgia Tech Transportation Systems Engineering doctoral student. The army is pulling together citizen soldiers from different Atlanta neighborhoods and backgrounds to reclaim ownership of MARTA and make it more accessible and convenient. Most MARTA bus stops don’t have bus route and destination information. The few that provide a route timetable only list times for the main locations on

the route, leaving the rider to guess at arrival times. MARTA Army’s first intervention will upgrade “a bus stop to show you where you can go, on which bus or route, and when,” said Berrebi. For citizens who adopt-a-stop, MARTA Army will provide training and printed timetables, making bus destinations more visible and hopefully more enticing. Co-founders Binh Dam and Harshath JR, who commute on MARTA, developed an app to produce the bus stop-specific timetables. “We can make informative signs on the spot,” Dam said, “which is an improvement that MARTA is excited about.” With initial support from In Our Backyard crowdfunding, MARTA, Georgia Tech and the city of Atlanta, MARTA Army was able to launch an adopt-a-stop initiative at the recent 2015 Transportation Camp. As of early October, more than 65 citizens had adopted bus stops. The army has a signup sheet at martaarmy.org/join-an-army where recruits can volunteer to adopt bus stops and to organize boot camps in their neighborhoods.

New ritual bath allows Jews to mark big life cycle events BY JOE EARLE

Rituals matter. People need ways to mark the big events – marriages, say, or deaths or births – that change their lives. Jews in metro Atlanta soon will have a new place for the traditional immersion ritual used to mark such big life events. The new Metro Atlanta Community Mikvah, a place for ritual baths, opens this month at Congregation B’nai Torah, 700 Mt. Vernon Highway, in Sandy Springs. A ribbon-cutting ceremony is scheduled for Nov. 15. “In the community, it’s a pretty big deal, if I do say so,” said Rabbi Joshua Heller of Congregation B’nai Torah, who said 20 synagogues and organizations in the metro area will rely on the facility. “This is one of the few religious resources that is shared so widely.” Alice Wertheim of Dunwoody, president of the board of directors of the new mikvah, said the facility will be open to anyone in the Jewish community who wants to use it. “This is a sacred space that brings together varied elements of the community, and that doesn’t happen very often,” she said. “Most open spaces are secular. This is a sacred space – that’s

what makes it different. It’s unique and it’s exciting, and it adds another dimension to the spiritual life of the community.” A mikvah is a special pool used for Jewish ritual immersion, according to MACoM, the nonprofit organization building the facility. “It’s a ritual accessible to anybody,” Wertheim said. In its brochure describing the new pool, MACoM says, “Traditional uses of mikvah include immersing when converting to Judaism, before getting married, before the Shabbat or other Jewish holidays, and to make a woman’s monthly cycle.” Similar facilities exist at a few other synagogues in metro Atlanta and the new one replaces an older one at B’nai Torah, Wertheim said. Heller said he expects the new facility to be used more than 300 times in its first year. The rabbi said he used B’nai Torah’s old mikvah regularly when preparing himself for services. “It’s an incredibly powerful ritual,” he said. “It’s an incredibly visceral experience. I would often come to the old mikvah on the eve of the Sabbath. It is a tremendously powerful spiritual experience.” The new pool is built to exacting standards, Heller said. “The laws of construction of a mikvah are among the most complicated in Judaism,” he said. A portion of the water in the pool “has to be water that flows without human hands or tools being involved,” he said. “No buckets. No pumps.” So, some of the water used in the pool is collected from the building’s roof, gathered in a pair of cisterns and delivered by troughs on the floor. The water is filtered, he said. The devices used to collect and deliver the natural water fill a room, but ensure the facility is kosher, he said. The building containing the new mikvah also has an area in a hallway leading to the pool where friends and family can gather to listen to the event as witnesses. The building also offers a pair of dressing rooms where people clean up before entering the ritual pool. “You’re not going into the pool to clean yourself,” Wertheim said. “You’re going into the pool as a way of marking the moment.”

Ruffini said. “We look at things differently.” As a female officer, Ruffini is a relative rarity among local cops. She is one of 11 female officers on Sandy Springs’ 125-officer force. Officer Celeste Rausch is one of 11 women among the 70 officers in Brookhaven. In Buckhead, Atlanta Police Officer April White is one of 349 women among Atlanta’s 1,921 officers. Until October, Dunwoody’s department hadn’t had a female officer

since 2012. Officer Rashida Moore joined Dunwoody Oct. 8 and was sworn in by the mayor at a City Council meeting Oct. 26. Police officials said few women applied for a job and of the few who did, none were qualified. Ruffini started with the Sandy Springs Police Department in May, after the department put her through the police academy to get certified. She said she had worked in the DeKalb County Jail and knew from Dunwoody officers that she wouldn’t get hired in the city because she wasn’t a sworn officer yet. Rausch, who started with Brookhaven earlier this year, keeps a set of pink handcuffs on the dashboard of her patrol car. She admits to having a feminine side and enjoying “dainty, girly” things, but she said there’s more to her than that. “I ride a motorcycle [off duty]. I work part-time sports broadcasting for Turner Sports,” Rausch said. “I’ve done a lot of things—shoot guns— that are, in my head, male things to do.” Rausch said she thinks a police force can effectively enforce and communicate with its citizens without having an officer to represent every ethnicity, faith or gender. White disagrees. She said she believes a police force needs officers who should represent the races, beliefs and gender in the community they serve. “Oftentimes, citizens are comfortable when they know the officer responding understands their customs, practices and religion, and can direct-

Drive—On Nov. 4, a resident said she returned home and noticed the door was not locked. She was sure she left it locked. She reported her Sony TV and Nintendo Wii game system missing. She suspects a man who lived with her about nine months ago. She said he was a thief and had stolen from her before. She said he didn’t have a key, but he had access to hers (meaning he probably made a copy of one.)

She abruptly got up and went to the door to leave. (She was intoxicated.) He offered an Uber ride, but she ran off. Later, she texted him saying she would pursue rape charges against him. He phoned the police. The responding officer tried several times to reach her by phone and text, but she did not respond. The man said he returned to his home and discovered his Ulysse Nardin Maxi Marine watch, valued at $5,600 and $250 cash was missing. Since that night there was no sexual assault claim made.

called to North Fulton Hospital to see a victim who said he was assaulted and stabbed several times in the forearm while at a gas station on Dunwoody Place. He told officers that he walked to the station to buy cigarettes. In line in front of him was a couple. They took a long time to check out, so he said something to them about taking so long. He had words with the man, then bought his cigarettes and walked outside. The same man came up to him and stabbed him in the arm. The victim ran off.
