As I lIsten to the rAdIo, read the paper or watch the news of layoffs, bailouts and stock market plunges, I feel fear, and I know that I am not alone.

Our profession is extraordinarily vulnerable to these “uncertain times.” My parents were economists and, when I became a lawyer, it was a standing joke between us that I was a living, breathing transaction cost – precisely the sort of societal cost that they “assumed away” in all their carefully constructed economic models. e problem is, in today’s economy, everyone would like to assume us away. Honestly, I can’t blame them. I, too, am reviewing each and every line item in my budget. As a trial lawyer, I know fear well. Fear of failure, fear of humiliation, and the fear of “missing something” are my constant companions. ey have served me well over the years. As an early mentor told me, the fear of “taking one in the mush” in the middle of trial “in front of God and everyone” was the key to his success.

at is what I would call “positive fear.” For some time, my feelings about the economy were something else. I am, however, an optimist. Moreover, I am a woman of action. I decided to harness my anxiety in a positive WWW.CLEMETROBAR.ORG

As Benjamin Franklin said, “Out of adversity comes opportunity.” As Usual, e Media Makes ings Worse I started searching the internet for articles about women and the recession or lawyers and the recession. Initial results were not heartening. On July 22, 2008, Congress’ Joint Economic Committee (“JEC”) issued a report finding that women are increasingly vulnerable to job loss during the recession. e report reminded us that in the 2001 recession, not only did women lose jobs, but also, in its aermath, women’s employment rates did not recover to their pre-recession peak. Indeed, according to the JEC, as of 2008, the female employment rate was approximately six percentage points below where it would have been if the trend of women’s employment had continued its 1948-2000 trajectory. e Vice Chair of the JEC, Representative Carolyn B. Maloney of New York, summarized the Committee’s findings. “Women have been striving for equality with men in jobs and wages; Unfortunately what we’ve achieved is equality in losing jobs during the recession.” On September 14, 2008, the San Diego UnionTribune reported that the unemployment rate for women experienced its largest one month spike in 33 years between July and August 2008. Unemployment statistics for AfricanAmerican women were higher still and among single mothers and women with families, unCLEVELAND METROPOLITAN BAR JOURNAL
