DIY Divorce- Formally Record the Financial Arrangements
Over the course of a marriage or civil partnership, the financial affairs of couples are often intrinsically entwined with a jointly owned home, joint savings and or loans, together with accounts and pensions held individually. In addition, when you factor in monthly household commitments like utilities, phone and TV subscription packages, the prospect of unravelling financial affairs on a separation can seem extremely daunting but is a vital consideration when deciding to separate.
The decision to separate may be mutual, or instigated by one party to the relationship, with a couple then reaching agreement amicably over their financial affairs. This could include agreement between the couple over any child maintenance payments that one party may pay to the other.
Whilst reaching agreement amicably over separation, finances and custody of any children can make a separation less hostile, any informal agreement over the finances has no legal basis and so couples would normally seek the assistance of a solicitor to prepare a Consent Order. This is a legally binding document that records the agreement reached between the parties regarding their assets, debt and income.
A Consent Order is usually issued without anyone having to attend Court although the Court will consider if the arrangement is fair and may not grant the Order if it is significantly detrimental to one of the parties. Your solicitor would normally have considered this with you when seeking assistance to draw up a Consent Order.
Whilst many couples choose to take a DIY approach to separation, it is vitally important to consider a Consent Order to record the financial arrangement reached to ensure a clean break and ensure an ex will not be able to make a claim against you in the future for any change in circumstances, assets or income you may earn or receive which can provide vital peace of mind.
