What does this recently finalized OSHA regulation mean to all “General Industry” building owners? It means; if you employ people to work in your building, it better be safe from all recognized hazards. Or if you hire an outside electrical contractor it’s the building owner’s responsibility to make sure the worker is fully trained in NFPA 70E codes. According to the National Fire Protection Association, NFPA 70E, “Standards for Electrical Safety in the Workplace” these are just some of the codes: 110.1, 110.2, 200.1 and 205.3 that spell it out pretty clearly. The building owner or the owners designated representative is responsible for training, testing and documenting the training of qualified electrical workers. What’s more, they must develop a mitigation strategy to reduce the risks of an Arc Flash explosion, make sure every measure has been taken to ensure “safety related work practices” are in place, see to it electrical equipment is properly maintained to manufacturer’s specifications and ensure there is no evidence of impending failure. www.underwritersinsider.com

Today’s lawsuit follows an investigation by the Department’s Bureau of Fraud Deterrence (the Bureau), Allstate and OIFP. On behalf of New Jersey consumers, the Department is seeking a substantial, yet undetermined IFPA-mandated fine amount and Allstate is seeking reimbursement for personal injury protection benefits that Allstate paid on behalf of its customers. In 2015, the Bureau fined fraudsters more than $4.2 million in fines, surcharges and restitutions for various IFPA violations. “This lawsuit is the latest in a series of actions taken by the Department, Allstate and other insurers to protect New Jersey customers who insure 5.5 million private passenger autos and are charged nearly $7 billion in written premiums,” said Commissioner Badolato. “These and similar alleged fraudulent activities increase the cost of insurance to consumers.” It is important to note that a lawsuit simply sets forth allegations of wrongdoing. Ultimately, the evidence will be presented in court where a determination will be made in the matter. February 2017

FORMER GEORGIA INSURANCE AGENT ARRESTED FOR FRAUD
A
tlanta – Former insurance agent Christopher Lowell Jackson, 39, of Athens, was arrested earlier this month on warrants for five counts of insurance fraud and three counts of forgery. Georgia Department of Insurance Fraud investigators determined that Jackson filed bogus watercraft insurance claims and submitted forged documents for personal financial gain. “Insurance fraud ultimately hurts the Georgia consumer, who ends up paying higher premiums to cover losses,” Insurance Commissioner Ralph Hudgens said. “My office will continue to pursue all types of insurance fraud aggressively.” An investigation by Hudgens’ office revealed that on May 13, 2016, Jackson took out watercraft insurance policies on a 2000 Cobalt 210 boat with both GEICO and Allstate. Between May 15 and Aug. 7, the suspect filed a total of five boat towing claims on the same vessel with the companies touting engine failure off the coast Georgia. He was paid approximately $7,100 for three of the filed claims and withdrew attempts to collect on an additional two.

Following a three-month investigation, fraud investigators concluded that all of the submitted towing invoices by Jackson were fraudulent. Also, with help from the United States Coast Guard and the Georgia Department of Natural Resources, investigators determined that Jackson was never in possession of the vessel and that the boat and actual owner were in Kentucky.
On Dec. 19, Jackson surrendered his license to sell insurance in the state of Georgia. He turned himself in at the Clarke County Sheriff’s Office on Jan. 4 and was released on a $8,000 bond. The case will be prosecuted by the Clarke County District Attorney’s Office. Insurance fraud is a felony with a penalty of two to 10 years.

Lloyd’s Bank Survives 3 Days of DoS Attack

n early January, Lloyd’s Bank was almost continuously hit with cyber attacks over a 3 day period in an attempt to shut down it’s website. These type of attacks are called “Denial of Service” attacks and are intended to shut down the victim’s website. Halifax, Bank of Scotland, and TSB, which shares the Lloyds tech platform, were also affected by the attack. A spokesperson for Lloyds said “We experienced intermittent service issues with internet banking between Wednesday morning and Friday afternoon the week before last and are sorry for any inconvenience caused. We had a normal service in place for the vast majority of this period and only a small number of customers experienced problems. In most cases, if customers attempted another log in they were able to access their accounts. We will not speculate on the cause of these intermittent issues.”

the finished Teflon coating. However, Teflon can still release chemicals that may be toxic if it is overheated. According to the Environmental Working Group (non-profit organization out of Wash. D.C.), fine particulates will be released when Teflon is heated to more than 550 degrees. POLICYHOLDERS RECOVER $7.6 MILLION AFTER TURNING TO THE LOUISIANA DEPARTMENT OF INSURANCE FOR HELP

nsurance Commissioner Jim Donelon reports that insurance policyholders in Louisiana were able to collect an additional $7.6 million as a result of assistance provided by the Louisiana Department of Insurance (LDI). Commissioner Donelon says these funds are a result of staff from the LDI Office of Consumer Services working with company representatives to resolve consumer complaints that were filed with the office. These recovered funds are in addition to the original amounts offered to consumers by their insurance companies.
