igger used to be better in the luxury-home market. Not anymore. These days, buyers of million-dollar homes want less square footage than in years past. “People are scaling back,� said Walt Danley, president of Walt Danley Realty in Paradise Valley. Instead of massive 10,000- to 12,000-square-foot houses, they are looking for houses that are 4,000 to 6,000 square feet. “They do not want the hassle of furnishing and main-

taining a larger home when they won’t even be using some of these rooms,� said Julie Antunes, a Realtor with Russ Lyon Sotheby’s International Realty in Scottsdale. Smaller luxury resale houses can be hard to find. In the early 2000s, few were built because buyers considered larger homes to be more valuable. $350 million luxury condominium project, complete with a robotic valet and private elevators, is underway in what has become Arizona’s poshest neighborhood, Silverleaf in north Scottsdale. Sales will start in November for 213 units priced at $1 million and higher in the Sterling at Silverleaf development. Sterling at Silverleaf is in DC Ranch at Pima Road and Thompson Peak Parkway. Construction is scheduled to start early next year, so the first residents can move in during 2016. Scottsdale-based Cypress Development Group is developing a five-building condo project next to the 28 villas, designed by architect Bing Hu, that it began building in 2011. The condos range from 1,600 to 3,400 square feet. Penthouses in the four-story buildings will average 2,500 square feet. Cypress CEO Nathan Day and President Tanner Luster say the condos will be LEED-certified by the U.S. Green Building Council. Cypress purchased the land for the villas and condos in 2008. Before designing the condo project, Day and Luster traveled to Los Angeles, Miami and other luxury condo hotspots to check out the latest high-end amenities. The Sterling condos will include Calcutta marble kitchen countertops, SubZero and Wolf appliances, natural stone and wood floors, 11-foot ceilings, walkin closets with custom cabinets, deepsoak tubs and a built-in iPad system that controls home automation and security. Condo buyers also will have access to a 7,000-square-foot resident lounge with a demonstration kitchen, private dining room, library, fireplace, flat-screen TVs and a conference room. The valet will use battery-powered robots to move cars onto steel trays to park them. Homeowners can call up their car in minutes. Day said the project will be marketed to empty-nesters currently living in Paradise Valley as well as to people 50 and older worldwide.

Rents on the rise Renters are paying more for apartments and houses in metro Phoenix than they did a year earlier. The average rent on an apartment climbed 4.9 percent during the past year to reach $815 a month at the end of September, according to research firm See REAGOR, Page R3

Question: Our family has owned a convenience market in Glendale for more than 30 years. The lot next door to us has always been vacant. I remember my father saying years ago that, if this lot was developed, we might have a problem with parking. Last year we were notified that the owner of that lot submitted plans to Glendale to develop a beauty salon on that lot. Although a beauty salon, or almost any business, on that lot would be better for us than a vacant lot, I was concerned about what my father said about parking. I contacted a title insurance company to get a preliminary title report. This preliminary title report, for which I paid $300, showed that there was no parking problem between our two lots. Therefore, we did not oppose the construction of the beauty salon, which is scheduled to open in two months. The owner of the beauty salon now has shown me a recorded parking easement over our property that gives the beauty salon owner the right to have 20 parking spaces on our property. The loss of our property for 20 parking spaces will cause significant damage to our business. When I contacted the title insurance company to ask for some compensation for the loss of our property because of their mistake, the title insurance company admitted their mistake but said that they had no liability. What gives? Why did I pay the title insurance company $300? Answer: A title insurance company will generally not have liability for a mistake made in a preliminary title report and will only have liability if a title insurance policy is issued. Arizona Revised Statutes, Section 20-1562(5). The reason: For only a nominal amount such as your $300 payment, the title insurance company should not have liability without payment of the full premium for a title insurance policy. Here’s a look at 10 top features in million-dollar houses: Privacy “Location, location, location� says it all in this market. Preserve and hillside lots are preferable because of their seclusion, said Mario Espinoza, a broker with Scottsdale Luxury Properties. Other-view lots and equestrian lots also are popular, but golf-course lots are considered too public. Outdoor living spaces Outside amenities are as important as indoor ones in this price range. That’s because buyers use their backyards as entertainment spaces. A built-in barbecue grill is only one component. A pizza oven, full bar, smoker, refrigerator, burners and other kitchen features are among the must-haves, Danley said. A dining room, television-viewing space and pool, spa and water features are other popular amenities. Kitchens The kitchen is the “bragging point� of the home, Danley said. Commercial-style appliances are a must, with Viking, Dacor, Wolf, Thermador, Miele, Sub-Zero, Bosch and JennAir among the desired manufacturers, Antunes said. Think multiple dishwashers, ovens and refrigerators, as well as appliances that make life easier, such as warming drawers and microwave drawers.

RealFacts. Monthly rents on houses are up 5.8 percent from last year, according to Arizona State University’s W.P. Carey School of Business. “Rental homes remain popular for those who don’t want to buy a house or who can’t qualify for a home loan,� said Mike Orr, director of the Center for Real Estate Theory and Practice at the Carey School. “Fast turnover and low vacancy rates have pushed rents up.� An average rent figure for houses in metro Phoenix isn’t considered an accurate indicator. The many luxury houses that rent for $5,000 or more a month skew the number high. In September, there were 4,342 houses, not including vacation homes, for rent that were listed on the Arizona Regional Multiple Listing Service, according to Orr. That compares with 6,486 rental homes available Valleywide in September 2013.

This means customized finishes on walls, baseboards and backsplashes, and such upscale features as hardwood or woodlike-tile plank flooring.

Green building Luxury-home buyers are looking for houses that are energy-efficient as well as environmentally conscious in construction and amenities, Danley said. Some homes may have theater rooms, but sectionals have replaced the movie theater-type seating of the past. Construction job losses Phoenix lost the most construction jobs of any metro area in the nation during the past year, according to a new report. A decade ago, the area led the U.S. in homebuilding. The metro Phoenix construction industry contracted by 6,900 jobs during the 12 months ending Sept. 30, according to data released Wednesday by the Associated General Contractors of America. I am a handicapped resident and just moved into a new apartment community. The first floor units are handicap accessible, but they do not have grab bars in the bathrooms. Can I insist my manager pay for this installation?

Answer: No. Units built for occupancy after March 12, 1991 must meet handicapped accessibility guidelines. They must have sufficient reinforcement in the bathroom walls to support later installation of these devices. The grab bars themselves, however, are “adaptable features�. Management can require the resident to pay for these. If the bathroom walls are not strong enough to support these bars, the landlord has to pay to reinforce them.

Renters tend not to vote – and that trend should change Statistically, we know that people who rent vote in smaller numbers, but why should that be? Young people, professionals and families who choose to rent are no less invested in schools, or streets or health care. It’s your responsibility as a citizen to be part of this civic process! During the weeks leading up to any election, watching TV becomes an education in the vision and conspiracies surrounding candidates for local and

state office. We endure negative ads followed by a 30-second recap of all of the great things that these elected officials have done during their tenures. At the core of all of this rhetoric is the call to action to vote. Don’t be turned off by the campaigning of the few. Take advantage of your right as a citizen and participate in this great process. If you requested an early ballot, you can drop it off at any polling place. Hundreds of thousands of ballots are sitting on kitchen counters waiting to be completed and counted. Take this Sunday

morning and educate yourself about the candidates in your area. Depending on where you live, there are school override elections, bond packages, schoolboard elections and more. And don’t forget about the propositions and judges on the back of your ballot. Take just 15-20 minutes and complete your ballot. Even better, sit with your children and teach them how you are educating yourself on the issues and candidates. If you need to find your polling place for Tuesday’s election, go to azsos.gov

and click on the link in the Voter View box at the top of the page. On your way to work or on the way home, take 10 minutes and vote. This Tuesday, we have an opportunity to choose a new governor and numerous state leaders. On that same ballot, we can impact our cities, schools and hospitals by voting in municipal elections.
