Finders Keepers? T

his isn’t just a kids’ expression, it’s the law. But, there certainly are some rules when it comes to real estate. The current controversy involves the “finding” of cartoons penned by the late Ben Wicks (opposite). Ben was a prolific editorial cartoonist and political satirist. While he was a great creative mind and spirit, he was not good at looking after his things. After a lifetime of producing humorous cartoons in volume, he really never cleaned up after himself. He never had a moment to properly organize his life’s work. So, he stored it just about everywhere, including his three children’s homes. His son Vincent had about 3,000 of the cartoons. They had been left by movers, packed in green garbage bags when Wicks' son, Vincent, sold the house to Mr. Harnett and moved from Keswick to Vancouver in 1992. Shortly thereafter, the new owner’s brother Richard Harnett found the cartoons in plastic garbage bags in the garage. So, the legal question was “who owns the cartoons”? Basically, Harnett kept the cartoons “under wrap” until after Ben Wicks passed away. Harnett then surfaced in 2001 and wished to make some money by printing them in a book. Now, if there is one law that book publishers know very well it is the law of copyright. And, they said that the Wicks family must agree, since they inherited the copyright from Ben when he died in 2000. The Wicks family thought that Harnett should simply return the cartoons and perhaps be paid a small fee for “storage”. But, Harnett says he owns them! Now, the Wicks family had to sue for their return. The cartoons would have a value of perhaps $75,000 to $100,000. The trial Judge Thomas Lederer cautioned Harnett that "the onus is very high here to prove specific intent" to abandon the drawings, either expressly or by inference. This comment followed evidence that Ben stored his works in green plastic bags, ordinarily used for refuse. The legal principles that apply in a case like this are rather straightforward: • A finder gets to keep the property against everyone other than the true owner • The finder must have a legal right to be in the location where the find is made • The true owner only loses his property if it can be clearly demonstrated that he intended to part with it, abandon it or give it away So, hence the discussions about green plastic bags

left in a garage at the time of moving. There have been numerous Court rulings with respect to such cases. A finder who picked up some cash on the floor in a bank was allowed to keep it. The customer who lost it could not be located and it was found in the public part of the bank. In another case, a finder was obligated to turn the money over to the bank when it was found in the private office section of the bank where the public was ordinarily excluded, and he was present there, only upon invitation. A finder who came across some $100,000 hidden in the ceiling of a house that he purchased was obligated to turn the money over to the Crown. It was determined that the former owner, a member of the Hell’s Angels was the true owner, but that the money was in fact “proceeds of crime”, so it could not be retained. There are several cases that simply deal with money or assets overlooked and left behind by former owners. In most cases, the property is hidden, so it’s not really “abandoned” in a legal sense. What do you think about the Ben Wicks cartoons? Should they have been be returned to his estate? Here are the reasons why they should: • The property was valuable • The cartoons were stored • They were not abandoned • They were left behind by mistake • Ben Wicks is the rightful owner • Ben Wicks holds the copyright to their reproduction And, if you must argue the “other side”, here is the argument: • The property had limited to no value • The cartoons were not stored • They were placed in garbage bags • They should have been thrown out • The new owner of the house had the legal right to dispose of them • The brother having identified them was able to retain them It seems actually like a clever legal argument, however, there is a very significant issue in this

particular case. These were original works in which Ben Wicks retained ownership of the copyright. That right cannot simply be left behind in a plastic bag, even if it is opaque green and many people use it for garbage. And, if you don’t take it out to the curb, it’s probably not abandoned. The common law of “finders keepers” was never intended to deprive the true owner of his property. It was simply there to sort out who has the highest rights to the property if the true owner cannot be found or identified. Not much of an argument for Mr. Harnett, unless he can prove that Ben Wicks himself simply thought it was all garbage in the first place. In an 11-page decision, Superior Court Judge Thomas Lederer ruled the cartoons, depicting political figures back to the late 1960s, are the property of the late political cartoonist and not Richard Harnett. In his decision, Lederer said "the evidence is clear he (Wicks) sought to keep them all...The material was simply not left." The law governing abandonment, the judge said, requires "a total desertion, and absolute relinquishment of private goods by the former owner." This definition, he said, makes it clear there must be a specific intent to abandon the drawings. Lederer said the evidence showed Vincent Wicks never used the garage for garbage, only storage. Joined Together even after Divorce!

Y

ou probably never thought of this and it certainly doesn’t happen very often, but when it does it definitely causes havoc. Let’s take the case of Jim and Wendy. Wendy’s parents never really liked Jim. He was a truck driver and stopped in most evenings at a late night diner where Wendy worked while she was putting herself through school. One thing led to another and Cynthia arrived in nine months. Jim was a long distance trucker. He said he would do right by the child, and married Wendy. Her parents allowed the couple to stay in a small house that they purchased when

they were first married. So, they turned out the tenants and Wendy, Jim and Cynthia all lived in the house. The only problem was that he was never home, he never put any money towards the household expenses and eventually Wendy and Jim obtained a divorce. Yes, they made a little mistake. The house had been registered in the names of both Wendy and Jim. Not having any money to buy out his interest, Wendy went to her parents. They came to the rescue and bought out Jim’s interest in the property. Some time went by, Jim never paid any child support, he never came to visit

and after a period of time, they lost touch with him. Wendy’s father passed away and left his estate to Victoria (Wendy’s mother). One day tragedy struck! Victoria, Wendy and Cynthia went on a family vacation. They were involved in a car accident. Both adults were pronounced dead at the scene. Cynthia, because she was in a car seat survived but did not make it to the hospital. So, what happens to all the money? Wendy’s parents had Wills. They included survivorship provisions. In other words if the husband and wife were in a common disaster, the survivor had to live for at least 30 days before they would inherit the estate. This was initially intended to avoid double taxation of estates. However, Victoria’s Will did not include this provision in respect to other beneficiaries, only her late husband. Wendy, always intended to make a Will, but never really got around to it. You need to know some of the legal rules that will apply: • The younger is deemed to survive the elder • The insured (under a life policy) is deemed to survive the beneficiary • The laws of intestate succession will apply if there is no Will I should point out that the first two rules only apply in the case of uncertainty. In this case, the some of the facts are clear; Wendy and Victoria were both sur-

vived by Cynthia, even if it was for only a few minutes. Victoria’s estate went to Wendy. There was no common disaster clause. Her life insurance although made payable to Wendy as her beneficiary instead went to her estate. However, that was Wendy again. They just had to pay probate fees on the life insurance proceeds. Wendy’s estate went to her daughter Cynthia. This included all the money from Victoria’s estate. Now, what happens to Cynthia’s estate. Well, she didn’t have a Will, she was only 5 years old. All her money went to her parents equally (or the survivor of them). So, Jim was entitled to everybody’s money! This is not a good result. Wendy’s parents came to despise Jim. He was the last person on earth that they would ever give money to. They hadn’t seen him in over 4 years. Wendy didn’t care for him either, and particularly the fact that he never once called to see how Cynthia was. Again, he was the last person on earth that she would leave her money to. Wendy thought that since she was divorced from Jim, he was gone forever. No, not really, once married they were inextricably intertwined forever. So, the immortal words “til death do us part” applied in this case.

City dwellers driving Canada’s real estate market

H

omeowners who choose the convenience of city life over the more generous living space in suburbia are driving Canada’s real estate market, according to a new report jointly produced by consultancy Pricewaterhouse Coopers and the non-profit Urban Land Institute. The annual outlook on emerging real estate trends says the move downtown, which has emerged in the past few years, will continue as more Canadians decide to stay in or move back to urban cores. Much of this is due to changing demographics as young families and millennials forgo the white picket fence and house in the suburbs to take advantage of downtown living, where properties are smaller but offer more conveniences, said the 112-page report released recently. According to Statistics Canada, the most recent numbers available show that the population of urban centres grew 7.1 per cent between 2006 and 2011. Frank Magliocco, Canadian real estate leader at PricewaterhouseCoopers, said there are a number of factors behind the urban growth, including that Canadians are more aware of the environmental costs associated with urban sprawl as well as the cost in time and money of lengthy commutes. As well, provincial land use regulations that protect green spaces – for example Toronto’s Greenbelt involving

about 800,000 hectares of protected land from Peterborough, Ont., to Niagara Falls, Ont. – have made it more difficult to find land to develop and has pushed an explosion of condominium growth in major cities. But one of the concerns is what will happen to these urban properties once the younger generation grows out of them. “This continuing urbanization trend has fuelled the condo boom in Toronto and other cities, but some question what will happen as the lifestyles of today’s young urban singles and couples change. Will they move out of the city core in search of larger homes, schools and services, or will they – like their counterparts in other parts of the world – simply adapt to smaller living spaces?” the report asks. Magliocco said Canadian cities will either go the way of New York, where families are willing to sacrifice space to live in the city, or the way of London, where families are used to living outside the city and commuting downtown for work. The rapidly growing condo markets in cities such as Toronto and Vancouver have also raised concerns about an oversupply of units and whether the boom is overly weighted towards wealthy, foreign investors who lease the units to others. Meanwhile, an expected rise next year in interest rates from historically low levels may also influence demand in the

housing market. However, among the 1,400 people interviewed and surveyed for the report, which included private property investors and developers, commercial developers and real estate service firms, the consensus was that the Canadian market is strong enough to weather a bump in mortgage rates. “The improvement in the U.S. economy indicates that higher rates could be coming, but the economic stability in Canada and the United States will continue to attract foreign capital,” said the report. “In addition, retiring baby boomers are likely to flood the market with private capital as they look to turn stock options and retirement packages into stable, income-generating assets.” Overall, the report sees developers responding to the needs of downtown dwellers by building more mixed-used properties, which include residential and retail space. “Looking ahead, we can expect to see more and more retail and services along the streets of Canada’s city cores and along major transit arteries, especially where new developments predominate. Major brands are likely to move into these new spaces, too – though with new formats and smaller footprints,” said the report. The report also noted that Calgary, Edmonton and Vancouver, will see the most residential growth in 2015, a trend
